WHEREAS, the Leesburg Baptist Church has requested special exception approval for construction of three classroom buildings at its existing location; and WHEREAS, the property is located in the R-4 (Single Family Residential Zoning) District; and WHEREAS, on April 19, 2001, the Planning Commission recommended conditional approval of this application; and WHEREAS, on May 22, 2001, the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for the expansion of a general education school, as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE RESOLVED by the Town Council of Leesburg, Virginia as follows: Special Exception application #SE 2001-03 the Leesburg Baptist Church identified in the Loudoun County Land Records as Tax Map #48, parcel 55 as shown on the Special Exception Concept Plan, received on April 13, 2001 and any future version of the plan that incorporates the conditions contained herewith, is hereby approved subject to the following conditions: RESOLUTION: 2 APPROVING SPECIAL EXCEPTION #SE 2001-03 LEESBURG BAPTIST CHURCH 1) Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual, and that final plats, development plans, and construction drawings are subject to the applicable town regulations. 1) The Department of Engineering and Public Works cannot recommend issuance of a zoning permit for the modular classrooms until the Applicant provides an engineered plan to demonstrate compliance with all applicable town ordinances. 2) Prior to construction the Applicant must demonstrate an adequate channel for storm water discharge, sufficiency of storm drainage, or provide sufficient storm water management. 3) Two speed bumps be placed at a designated cross over point in the parking area aisle way where it passes between the play area and the classroom structures; a speed limit sign shall be placed on either side of the cross over; a yellow striped crosswalk should be painted in this area, as well. All these actions shall be completed at the time Phase 5C (parking lot) is constructed. 4) A 3.5-foot high privacy style fence shall be placed starting in the northwest comer, for at least 50 feet, along the western boundary line. This is to be completed at the time the modular units are placed onsite. (This is currently shown on the proposed special exception plan). 5) The placement of additional screening subject to approval by the Town and prior to the issuance of occupancy permits for the proposed classroom buildings. This screening should consist of approximately 3 to 4 arborvitae, juniper, or pine trees, spaced similarly to what is existing onsite to the north of the planting location. These plantings should be 6 feet minimum in height at the time of planting. 6) The proposed HVAC units are not to create a noise level that will exceed 55 dBA as measured at any point on the applicant's property lines as certified by an acoustical engineer acceptable to the Town and licensed in the Commonwealth of Virginia. Prior to the issuance of an occupancy permit for any of the modular buildings, Applicant shall retain such an acoustical engineer to conduct a study to determine that the proposed HVAC units meet a continuous noise standard of a maximum of 55 dBA at its northern and western property lines. If the study determines that mitigation measures are needed, Applicant will adopt the recommendations of the acoustical engineer to meet the 55 dBA noise level. 8) This special exception shall be in substantial conformance with the special exception plan dated February 20, 2001 and revised through April 12, 2001.
