HomeMy Public PortalAbout2001_06_12_r092The Town of Leesburg, rg ma PRESENTED June 12, 2001 RESOLUTION NO. 2001-92 ADOPTED June 12, 2001 A RESOLUTION: INITIATING AMENDMENTS TO THE SUBDIVISION AND LAND DEVELOPMENT REGULATIONS AND ZONING ORDINANCE REGULATIONS WHEREAS, development review fees have not been reviewed since 1996 to determine the appropriate charges for various plan reviews; and WHEREAS, the Town Council in adopting the FY 2002 Budget agreed that the town the existing development review fees and recommend appropriate staff needed to review changes; and and WHEREAS, a preliminary development review fee analysis has been completed by staff; WHEREAS, the preliminary findings are based on the following: 1) a comparison of the annual expenditures the town has devoted to the review of development plans in the FY 2002 Budget in relation to the amount of revenues collected annually from development review fees; and 2) a survey of the development fees charged by several area jurisdictions; and WHEREAS, the proposed amendments to the Zoning Ordinance are required by the public necessity, convenience, general welfare and good zoning practice. THEREFORE, be it resolved by the Town Council of the Town of Leesburg in Virginia as follows: SECTION I. read as shown below: The Subdivision and Land Development Regulations shall be amended to SECTION 13-54 FEES DIVISION 1 GENERAL Fees and charges to be paid to the Town for the review of plats and plans, for the inspection of facilities required to be installed by this Article and for variances shall be as follows: -2- RESOLUTION: INITIATING ORDINANCE AMENDMENTS REGARDING FEES (a) (b) (c) (d) (e) (fl (g) (h) (i) For preliminary pigs the fee shall be $599 $2,000 plus $25 $100 per lot or division of land. (Amended 10/23/96) For extensions of a preliminary plat or development plan approval, the fee shall be $200 for an administrative approval and an additional $150 if Planning Commission action is required. (Added 8/9/94) For final pigs the fee for first submissions shall be $5fi~ $1,000 plus $!9 $50 per lot or division of land, plus the amount extended from the quantity of public improvements at the following rates: Type of Public Improvement Storm Sewer Water Main Curb & Gutter Sidewalk Sanitary Sewer Streets Overlot Grading Other major utility facilities Unit Rate $3.75 per linear foot 1.59 1.75 per linear foot 0.75 per linear foot 1.35 per linear foot 1.75 2.00 per linear foot 1.20 per linear foot $125 each lot 1% of construction cost For correction plats the fee shall be $500, plus $50 per lot. For final plats the fee for the second and subsequent submissions of construction drawings shall be $600. For Minor subdivision plats the fee shall be $259 $500, plus $25 $100 per lot. For Boundary Line Adjustments the fee shall be $16u2 $300, --~"~ For Boundary Line Vacations far the fee shall be $!50 $300. For preliminary development plans the fee for first submissions shall be $2,000 plus $59 $100 per acre and the fee for second and subsequent submissions shall be $600. For combined preliminary/final development plans, which have been specifically authorized by the Land Development Official, the fee for first submissions shall be $3,000 plus $25 $100 per acre, plus the amount extended from the quantity of public improvements at the following rates: -3- RESOLUTION: INITIATING ORDINANCE AMENDMENTS REGARDING FEES (k) (1) Type of Public Improvements Storm Sewer Water Main Curb & Gutter Sidewalk Sanitary Sewer Streets Overlot Grading Other major utility facilities Unit Rate $3.75 per linear foot !.50 1.75 per linear foot 0.75 per linear foot 1.35 per linear foot 1.75 2.00 per linear foot 1.20 per linear foot $125 each lot 1% of construction cost For combined preliminary/final development plans the fee for second and subsequent submissions shall be $600. For minor modifications to approved final development plans or construction drawings, when authorized by the Director of Engineering, the fees shall be $!00.00 $75 per sbm~ lot requiring a change. Such modifications shall be for the relocation of utilities, landscaping or similar minor modifications. Minor modifications shall not be deemed applicable to the relocation or enlargement of any buildings shown on the final development plan, which shall require the submission of a new application. For review of public improvements not submitted as part of a subdivision or development plan application the fee shall be 1% of the construction costs. For rough grading plans the fee shall be $!00 $200 per acre. (m) For variations the fee shall be $!99 $300 each (section varied). (n) For no adverse impact certifications the fee shall be $!00 $500. (o) For a Traffic Study the fee shall be $1,000. (p) For a Floodplain Study the fee shall be $1,500. (q) For a DCSM Modification the fee shall be $!00 $200 each. (r) For each Easement Plat the fee shall be $!00 $200. For request for authorization for combined preliminary/final development plans the fee shall be $100. RESOLUTION: INITIATING ORDINANCE AMENDMENTS REGARDING FEES SECTION I1. The Zoning Ordinance shall be amended as shown below: ARTICLE 6. PLANNED DEVELOPMENT REGULATIONS Section 6A-5. GENERAL PROCEDURES (2) Fees. Fees to be paid to the town for consideration of planned development petitions and applications shall be as follows: (Amended 10/23/96) a. Sketch plan review and comment, the fee shall be $500.00. A petition for concept plan approval and amendment of the Town Plan, the fee shall be $2,000.00. An application for rezoning plan approval and establishment of a planned development district, the fee shall be $2,999.99 $5,000.00 plus $100.00, per acre for PRN, PRC or PEC districts. do An application for preliminary plat approval for all or part of a planned development, the fee shall be $599.99 $2,000.00 plus $59.99 $100.00 per acre for PRN, PRC or PEC districts. eo Any concept plan o~ and proffer amendment to an approved rezoning shall be accompanied by the appropriate land development application and a fee of $2,999 $5000, ~'~"~w~ ~.~v¢~n ....... w- ~-~. A proffer amendment only shall be accompanied by the appropriate land development application and a fee of $2,000. An application for preliminary development plan approval for all or part of a planned development, the fee for first submissions shall be $2,000.00 plus $59.99 $100.00 per acre. The fee for second and subsequent submissions shall be $600.00. ARTICLE 11 - SPECIAL EXCEPTION REGULATIONS Section 1 lA-4. APPLICATION, REVIEW, AND ENFORCEMENT PROCEDURES (3) Submission Requirements. All applications for special exception uses shall be accompanied by the following items: fo A review fee of $500.00 per accessory to a dwelling and $1,000.00 for-all-oth~ ~v~-~-~'~ ~.~r~.v.~*~ ....... ~ for special exception uses for not-for-profit organizations and $3,000.00 for special exception uses for profit organizations. (Amended 10/23/96) -5- RESOLUTION: INITIATING ORDINANCE AMENDMENTS REGARDING FEES ARTICLE 13 - AMENDMENTS Section 13A-2. INITIATION OF AMENDMENTS Amendments to the Zoning Ordinance shall be initiated only in the following manner: (2) Amendments to the zoning boundaries or classification of property shown on the Zoning Map may be initiated by property owners of the land proposed to be rezoned, by the filling with the Council of a Zoning Map amendment petition addressed to the Council, which petition shall be on a standard form approved by the Planning Commission and provided by the Zoning Administrator, and accompanied by a fee of $2,999.99 $5,000.00, plus $100 per acre, and other material and data required in said form. Any Town Plan Amendment shall be accompanied by the appropriate land development application and a fee of $2,000.00. The Planning Commission shall hold a public hearing to consider these amendments and report its recommendation to the Town Council pursuant to Chapter 22, Title 15.2-2204 of the 1950 Code of Virginia, as amended.
