AUTHORIZING SETTLEMENT OF THE STILES CASE
WHEREAS, the parties to the case of Stiles v. Town of Leesburg, et al. (CA-00-628-A) have
reached a settlement in accordance with the terms of the attached Memorandum of Understanding, dated
May 31, 2001, which has been signed by Mr. Stiles and his counsel;
WHEREAS, the settlement has been recommended by the Town's outside counsel, John Brandt,
the Town Attorney and the Town Manager; and
WHEREAS, funds have been budgeted in the FY 2002 budget to cover the settlement.
THEREFORE, RESOLVED by the Council of the Town of Leesburg, Virginia as follows:
SECTION I. The Mayor is authorized and directed to sign a settlement agreement in accordance
with the terms of the attached Memorandum of Understanding, in a form approved by the Town Attorney.
SECTION II. Upon execution of the settlement agreement by all parties, the amount of the
settlement to be paid by the Town over and above the amount to be paid by the Town's insurer shall be
$965,295, to be funded as follows: $500,000 from the general fund and $465,295 to be borrowed from the
Utility Fund for one year at market interest.
