RESOLUTION NO. ADOPTED July 24, 2001
A RESOLUTION: AWARD OF THE CONSTRUCTION CONTRACT FOR
CATOCTIN CIRCLE WIDENING PROJECT TO RUSTLER
CONSTRUCTION FOR $4,385,700.00 CONTINGENT UPON
FULL EXECUTION OF THE TOWN/STATE AGREEMENT
WHEREAS, the Catocfin Circle Widening Project is partially funded by the
Virginia Department of Transportation and administered by the Town;
WHEREAS, in response to a public solicitation for bids for this Catocfin Circle
Widening Project, the Town received bids on May 29, 2001 from the following finns:
· Rustler Construction, Inc.
· Fort Myers Construction Co.
$4,385,700.00
$5,115,000.00
WHEREAS, this is a "Lump Sum" contract; and
WHEREAS, the bids were evaluated by the Capital Projects Manager in
accordance with the bid documents and the Town Purchasing Policy; and
WHEREAS, The Commonwealth Transportation Board approved award of this
contract to Rustler Construction Inc., of Hemdon, Virginia at their June 21, 2001 meeting.
WHEREAS, A resolution to approve the Town/State Agreement and authorize the
Town Manager to execute this Agreement is underway; and
WHEREAS, the construction and management of this project is anticipated to be
$4,911,984,00; and
WHEREAS, the VDOT Urban funds in the amount of $3,911,984.00 will be
allocated for construction and management; and

FULL EXECUTION OF THE TOWN/STATE AGREEMENT
WHEREAS, the FY 2002 Capital Improvement Program indicates that funds in the
amount of $1,084,000 are available from the Loudoun County Gas Tax and that these funds
are ear-marked for this project; and
WHEREAS, the Town/State agreement will be fully executed after the VDOT
Commissioner has approved it;
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
Section I: The Town Council hereby authorizes the use of $1,084,000.00 from the
Loudon County Gas Tax and $3,911,984.00 from the Urban Funds for a total amount of
$4,995,984.00 towards construction and management of the Catoctin Circle Widening
Project and credit account 902.9206.700.725 for the total amount; and
Section II: Award the construction contract of the Catoctin Circle Widening Project
to Rustler Construction Inc., for a lump sum amount of $4,385,700.00, contingent upon full
execution of the Town/State Agreement;
Section 1II: Authorize the Town Manager to execute this contract.
