MEDINA CITY COUNCIL MEETING MINUTES OF JUNE 20, 1995
The City Council of Medina, Minnesota met in regular session on June 20, 1995 at 7:30
P.M. in the City Hall Council Chambers with Mayor Anne Theis presiding.
Members Present: John Ferris, James Johnson, Ann Thies, Philip Zietlow and Mayor
Theis.
Members Absent: None.
Also Present: Police Chief Rick Rabenort, Public Works Director Jim Dillman, City
Engineer Shawn Gustafson, City Attorney Ron Batty and Clerk -Treasurer Jeff Karlson.
1. Adoption of the Agenda
Moved by Thies, seconded by Mayor Theis, to adopt the agenda with the following
additions:
(1) Long Lake Improvement Project
(2) Discussion of Trees
Motion passed unanimously.
2. Minutes
Moved by Johnson, seconded by Thies, to approve the minutes of the June 6, 1995
regular meeting, as written. Motion passed unanimously.
3. Dennis Hecker -- Final Plat Approval for Lot Subdivision
Dennis Hecker, 3072 Willow Drive, asked the council to approve a revision to his
preliminary plat. The buyer of Lot 2 wanted the property line for the existing house on
Lot 1 moved further to the east so it would not be so close to the existing barn. The
revised plat showed Lot 1 with 14.04 acres and Lot 2 with 25.7 acres.
Shawn Gustafson recommended that the city inc,uae a 30 foot wide driveway easement
on Lot 1 as a condition for approval.
Moved by Johnson, seconded by Fern;s, affect city staff to prepare a resolution
granting final plat approval to Dennis Hecker with the inclusion of a 30 foot c'r;veway
easement for access to Lot 2. Motion passed unanimously.
4. Don Pear son/Michael Seeland -- Lot Line Rearrangement
Donald Pearson, and Michael Seeland requested approval for a lot lin& rearrangement
of their properties located cn Homestead Trail.
Moved by Ferris, seconded by Thies to authorize city staff to prepare a resolution
granting final plat approval to Don Pearson and Michael Seeland. Motion passed
unanimously.

5. Ordinance Amending Section 851.01 of the Code of Ordinances
Moved by Johnson, seconded by Thies, to adopt Ordinance No. 285, "An Ordinance
Amending Sections 805.01 et seq. of the Code of Ordinances Adopting the 1994
Uniform Building Code."
Ayes: Ferris, Johnson, Thies, Zietlow and Mayor Theis. Nays: None.
Ordinance No. 285 adopted on a 5-aye and 0-nay vote.
6. Discussion of Water Drainage Concerns
Jim Dillman said there were two areas in Medina that had serious water drainage
problems and he asked for direction from the council as to how he should proceed.
One area was Peter Lake and the other area was north of Medina Road between
Tamarack Drive and Willow Drive. At the Peter Lake area, the drainage flows through
a railroad culvert and eventually over a rock dam. Dillman said Bonestroo shot
elevations recently and there was 18 inches between the south side of the tracks and
the top of the rock dam. Dillman said there did not appear to be any obstruction except
for cattails and other vegetative matter. He suggested digging a channel through the
cattails to relieve the water flow problem. The rock dam had recently been removed
but the DNR could require that it be put back.
Mayor Theis asked if putting in a channel would accomplish anything.
Dillman said the rock dam was causing some restriction creating a semi -submerged
floating bog. Dillman said the complaints from residents along Peter Lake was that the
water was backing up.
Theis pointed out that this situation was common in Medina during the summer months.
She said one possibility would be to establish a need scale so that the City would not
have to fix everyone's water problem at once.
Dillman said he preferred to tackle each problem one at a time rather than do a
comprehensive, citywide water study.
Phil Zietlow asked how long the rock dam had been there.
Bernard Dalbec, 2932 Pioneer Trail, said the rock dam was on his property and was
there when he moved into the home in January 1986.
Zietlow asked why the rock dam was put there in the first place.
Dalbec said the former property owner probably put it in for aesthetic purposes.
Gustafson said the City would need to acquire a permit from the DNR to permanently
remove the rock dam. He said the cost to remove the dam and dig a channel could be
as high as $25,000.

Mayor Theis asked how the council could justify any expenditures for correcting these
types of drainage problems.
Dillman said unless a property owner is affected by the problem, no one really cares
about drainage issues. Dillman added that four property owners were affected by Peter
Lake.
Gustafson said the Peter Lake area would always be prone to flooding. Gustafson said
the council could request CP Rail to clean out the drainageway since the railroad
owned the culvert.
Jim Dillman said there was also a drainage problem in the area north of Medina Road
between Tamarack Drive and Willow Drive.
Val Higgins, 1766 Morgan Road. said this problem had been building up for years and
nothing was being done to resolve it. Higgins said something was disrupting the
natural flow of the water causing the whole area to flood.
Dillman said he recently learned that there were two separate wetland areas and one
culvert was not being cleaned out regularly.
Ferris said the City needed to make sure that city -owned culverts were unplugged and
the water was flowing the way it should. He said there was little else that the City could
do.
Gustafson pointed out that hardcover was not creating the problem.
Dillman said the City could become involved with private culverts to a certain extent.
Ann Thies asked if the City had something in the ordinance that required property
owners to clean their private culverts.
Dillman said he was not aware of anything that addressed private culverts.
Dillman noted that the City was required to complete several water studies such as the
Water Conservation and Emergency Preparednees Plan and to adopt certain
ordinances such as the MPCA's urban "best management practices" for stormwater
runoff, and the National Urban Runoff Program for stormwater ponding.
As far as Peter Lake was concerned, Zietlow said the City should keep going back to
the railroad and ask that they keep the culvert free from obstruction.
Dillman said the trash guard was getting plugged up and the DNR would like the
railroad to bring it back to a 50-foot radius.

7. Vacation of Street and Utility Easement
In a memo to the City Council, Planning and Zoning Assistant Sandie Larson noted that
a 60 foot street and utility easement along the southerly boundary of the Navajo Hills
Subdivision had been vacated in July 1988, but the resolution was never signed.
Ron Batty said he noticed that the minutes mentioned the vacation of a 30 foot
easement while the resolution showed a 60 foot easement.
Moved by Ferris, seconded by Zietlow, to table the question of the easement until the
discrepancy is resolved and staff has had an opportunity to address the need for a trail.
8. Approval of Liquor Licenses
Phil Zietlow asked what other cities were doing to determine the cost of on -sale liquor
licenses.
The Council agreed to review the fees being charged by the City for liquor licenses
during their second meeting in August.
Moved by Ferris, seconded by Thies, to approve the renewal of liquor licenses for the
period of July 1, 1995 through June 30, 1996, for the following establishments:

9. Change Date of First July Council Meeting
Moved by Mayor Theis, seconded by Zietlow, to change the date of the first July
council meeting to Wednesday, July 5, 1995, due to Independence Day. Motion
passed unanimously.
10. Long Lake Improvement Project
Phil Zietlow said he had a meeting with Martha Hartfiel of the Minnehaha Creek
Watershed District (MCWD) in May but had had zero communication from the District
since that meeting. Zietlow said he was not contacted about a public hearing which
was held May 25, 1995. He said he recently received a copy of the EAW and the City
had until July 19, 1995 to respond to the project. Zietlow said MCWD had already
started condemnation proceedings on over 12 acres of Jack Wahlfors' property where
they intended to put a wet detention basin. Approximately 142,000 cubic yards of soil
would be excavated and removed from within the project easement for basin
construction. Zietlow said it would probably take 15,000 truckloads to haul the dirt
away. He said the wear and tear on city streets would be tremendous. Zietlow said it
was time to spend some money by getting the City's engineering staff involved to
determine if this was a fiscally responsible project.
Ron Batty said the Council needed a legal basis to stop the construction project.
John Ferris said the objective was to stop the Minnehaha Creek Watershed District
from moving ahead with their large scale construction plan if it would not significantly
clean up Long Lake.
Jack Wahlfors, 1525 Deer Hill Road, said the District wanted a big project whether it
did any good or not.
Moved by Zietlow, seconded by Thies, to direct Ron Batty to analyze the legalities of
the proposal; and to authorize Bonestroo to review the most recent plans, report, and
EAW prepared by Wenck Associates, Inc. for the Minnehaha Creek Watershed District.
As part of the review, water samples and measurements may be taken to verify that the
data used in the study is accurate. Motion passed unanimously.
11. Discussion of Trees
Jim Johnson said he noticed that Lundgren Bros. Construction had begun development
of Foxberry Farms and he was concerned that the heart of the mature forest area might
be destroyed. Johnson said most developers do not seem to care about tearing down
trees. He said measures should be put in place in the ordinance to prevent developers
from carelessly tearing down trees.

Moved by Johnson, seconded by Thies, to direct staff to look into tree ordinances that
other cities might have and to check the minutes related to the Foxberry Farms Addition
to find out how tree preservation was addressed. Motion passed unanimously.
12. Payment of Bills
Moved by Thies, seconded by Mayor Theis, to approve payment of Order Check
Numbers 14700-14751 for $39,298.73 and Payroll Check Numbers 14398-14411 for
$12,390.80. Motion passed unanimously.
13. Adjournment
Moved by Zietlow, seconded by Thies, to adjourn the meeting at 9:15 p.m. Motion
passed unanimously.
