PRESENT: Mayor Brad Andersen, Council members; Dennis McArthur, Jane Shaw, Dan
Gubler, Treasurer Ron Nelson, Public Works Supervisor Zech Prouse, Police/Code
Enforcement Officer Shannon Basaraba, City Clerk Robyn Keyes

Mayor Andersen brought the meeting to order.
Conditional use permits: Mayor Andersen explained that he, along with, Clerk Keyes,
Officer Basaraba, had reviewed the conditional use permits and discussed coming up
with a system to track and review the permit and the application process, Mayor
Andersen turned the time over to Officer Basaraba. Officer Basaraba said that he had
researched the state regulations of conditional use permits, and concluded that the City
could revoke the permit if the user moved from the original location. The new occupant
would be required to apply for their own permit if the new occupant wanted to use the
building for the same conditional use. Officer Basaraba also suggested imposing an
expiration date of one year on the permit and that it may be renewed for a fee as long as
the conditions were the same, if the conditions had changed then they must apply for a
new permit as a way of keeping track of the activity of the user. Officer Basaraba noted
that not any of the conditional use permits that had been granted had an actual permit
with the conditions stated on the permit and signed by both the City and the user. City
Clerk Keyes typed a new conditional use permit along with a new permit application.
Mayor Andersen agreed that a signed permit, good for one year was a good idea. Council
member Gubler said that he was opposed to the renewal fee if the user was not in the
business of making money, but agreed that if the permit was for a business, then a
renewal fee would be acceptable along with the requirement of obtaining a business
license. Mayor Andersen agreed that perhaps a $10 renewal fee would be justified for
businesses, but not for a non -business related permit and that part of the conditions would
be to obtain a business license. Diane's Day Care was discussed. Mayor Andersen
explained that the owner, Randy Kofoed, had originally requested to change the property
from a commercial zone to an R-2 with the intent of building a house and running a day
care from the house. What Randy actually did was build a commercial building, which
took place under a previous administration, before the City had a planning and zoning
commission. Officer Basaraba said that what Mr. Kofoed said he was going to do, and
what he actually did, was completely different. Officer Basaraba would like to have new
regulations put in place, like yearly renewals, to avoid this kind of situation from
happening. The Mayor suggested drafting a permit with the conditions for Mr. Kofoed's
day care and if he does not sign the permit, then his property would be changed back to a
commercial zone.
Hinton's conditional use permit was discussed. Hinton's have a conditional use permit
for an apartment in their home. One of the conditions was that the permit is only valid as

long as the Hinton's live in the house. The Hinton's have moved, but still own the house
and were under the impression that, since they owned the home, they could still use it as
a multi -family dwelling. Council member Gubler said that the City needed to stick to the
guidelines and follow the conditions of the permit. Council member Shaw agreed. Mayor
Andersen said that he had talked with the City attorney about several families living in
one house and the attorney said that as long as they were related they could live together
under the Federal Housing Act. Council agreed that the conditions clearly stated that the
Hinton's needed to be living at the residence in order for the conditional use permit to be
valid and that Hinton's permit was revoked.
Officer Basaraba said that he had talked to Guy Bliesner with the school district and
discussed the speed limit signs in front of the school. Officer Basaraba would like to have
the speed limit signs moved to the boundaries of the school grounds and not placed right
before the cross walk and that there is inconsistency with placement of the speed limit
signs, which make it difficult to enforce the law regarding the school speed zone. Guy
Bliesner agreed and would like to add blinking yellow caution lights to the area as part of
the safe routes to school grant. The three way intersection at Free Ave. and 50th was also
discussed with Mr. Bliesner and he agreed that the intersection could be considered part
of the safe routes to school and could be included in the grant. Council member
McArthur asked if the City would be require to have an engineering company look at the
intersection, Officer Basaraba said that the school district already had a company look at
the intersection as well as the County and suggested that the City of Iona get with
everyone involved to see what the requirements would be, along with a cost.
Tax ID number. Council member McArthur informed the council members of the City's
tax ID number in the event that they were buying goods for the City.
Officer Basaraba had to leave the meeting early and requested giving his report before he
left. Officer Basaraba said that the new car was ready and that the company needed to
receive the payment by Friday, October 24, 2008. Officer Basaraba also informed the
Council of the cost for installing the lights and equipment in the new vehicle, the cost is
$1,769.82 from Premier Vehicle and the cost of installing reflective decals, which is
$399 with Auto Trim Design. Officer Basaraba has also found companies that would buy
the existing radio and video system in the existing vehicle which would help cover the
cost of the new equipment. Officer Basaraba has finished his on-line P.O. S. T. tests and
is waiting for the written test. Once the new vehicle is ready, he will start to patrol.
Mayor Andersen stated concern with Officer Basaraba patrolling before the written
P.O.S.T. test and the liability that might be involved. Officer Basaraba said that he would
talk with the county about the issue since the County does the same thing. Officer
Basaraba said that he would like to talk to the County about the possibility of patrolling
the City's impact area. Mayor Andersen said that he thought that there was a place in the
City's Code Book that mentioned patrolling our impact area. Officer Basaraba said that
he would contact the county to see if an agreement needed to be drafted. The Mayor and
Council agreed that patrolling the impact area was a good idea. Council member Gubler
asked what other companies Officer Basaraba contacted regarding equipment installation.
Officer Basaraba said that he had contacted Teton Communication and that they could

not get some of the necessary equipment and that their installation fee was twice as much
as Premier Vehicle. Mayor Andersen recommended getting two different bids for the
service and said that the City had been very happy with the service from Teton
Communications and that they are local. Officer Basaraba said that Premier Vehicle
covered Pocatello and Blackfoot and was starting to cover Idaho Falls. Council member
Gubler asked about the separate radio quote on the Premier Vehicle estimate. Officer
Basaraba said that he was just seeing how much a new radio would be and that he would
continue to use the existing one for as long as he could. Council member Gubler said that
he thought Teton Communications might give the City a radio and that he would talk
with them about a new radio.

POLICE TOPICS
CITY COUNCIL/MAYOR ANDERSEN/PUBLIC,
PARKING ORDINANCE — Changes to parking ordinance. I believe we should change the parking
on the roadway from Thanksgiving to Easter Sunday from 6:00 a.m. to 12:00 p.m., Monday thru
Friday, to assist Zech with plowing the city roadways, rather than making this all hours between
Thanksgiving and Easter Sunday. This will also help with compliance by the citizens.
OVERDUE WATER BILLS — I believe we should make this effective 30 days after the approval of
this change. Everyone at the 70 day past due point shall have their water shut off and fees will
begin to accrue 40 days after the approval of this bill as well. This will ensure universal
compliance and give people a reasonable amount of time to be notified and pay their existing
balances.
CONDITIONAL USE PERMITS — Upon further review, I found that we can restrict these permits
to almost anything we like and that is reasonable. I would suggest adding an expiration of 1
year to this permit and allow a renewal as long as nothing has changed from the initial
Conditional Use Permit. I would then require a new renewal fee to be paid. This would help use
to stay on top of the permits that are out there.
- SCHOOL SPEED ZONE — I talked to Guy Bleisner and he will be discussing with the school district
on the 24th about the change in the location of the speed zones to the beginning of the school
property. He will also be looking to have the flashing lights added to the signs in 2009 as soon as
they get their 2009 funding for the safe routes to school grant.
- 3 WAY INTERSECTION ON FREE — I've discussed this with Guy as well. I believe that intersection
can be changed to a 3 way stop with minimal work. I have discussed this issue with Guy as being
an issue that would be part of the Safe Routes to School Grant. He agreed and would be willing
to work with me to figure out a way to try and make this work. If the council would like I will
continue this work to try and accomplish this to become a 3 way stop.
WHERE DOES THIS CITY SEE ITS BOUNDARIES GOING? —This way I can look to expand the scope
of my patrolling to help with enforcement issues and also help with revenue that will be created
for the City of lona while not just impacting the locals. I would then be dealing with the County
to come up with an agreement on my boundaries to patrol.
FUNDING TO INSTALL ALL EQUIPMENT — I've attached a copy of the 2 estimates to completely
install all the equipment in the new Tahoe and install the decals on the outside of the Tahoe.
I've picked the cheapest option for the decals, but this will suffice for our patrol car since the
light bar is extremely bright and there are also headlight and taillight flashers on the Tahoe.
Once this vehicle is equipped, I will begin to do enforcement around the City of lona.
- COMPANY TO BUY BACK OUR RADAR & VIDEO SYSTEM — The Radar Shop would be willing to
buy the radar back for $100 and I am waiting on the dollar amount for the video system which
should be more in the ballpark of $400-$500.
- LIFELOC FC20 BREATH TESTER — I am looking to become part of the Traffic Enforcement
Mobilization Effort in the State of Idaho. This will allow me to work specific enforcement in our
area (DUI, Seatbelts, Aggressive Driving) to insure safety. I can use this as an opportunity to
purchase LIFELOC and/or other equipment necessary for enforcement. I can also use this as an
option for overtime pay for Police Department Employees without costing the City of lona
money.
