A RESOLUTION: 2001-1t~7 INITIATING AMENDES AND LAND DEVELOPMENT ADMINISTRATIVE REVIEW · PRESENTED gl14/2001 ADOPTED gl14/2001 TO THE I.EESBURG SUBDMSION REGULATIONS TO ESTABLISH AN AND APPROVAL PROCESS FOR PRFJ JMINARY DEVELOPMENT PLANS AND PREIJMINARY SUBDMSION PLATS EXCEPT IN PLANNED DEVEI DPMENTS WHEREAS, it is the intent and desire of Council to provide a preliminary development plan and preliminary subdivision plat review process that utilizes the expertise of both Town staff and the Planning Commission in the most efficient manner; and WHEREAS, the Leesburg Subdivision and Land Development Regulations grant the Planning Commission authority to review preliminary plans and preliminary plats for compliance with Town development ordinances, but no authority to impose conditions of approval other than to achieve administrative compliance with those ordinances; and WHEREAS, in accordance with Section 15.2-2258 of the 1950 Code of Virginia, as amended, the Council may designate staff as its agent for review of preliminary development plans and preliminary subdivision plats; and WHEREAS, administrative review of preliminary plans and plats by staff, except in those cases involving planned developments, will enable the Planning Commission to concentrate on the consideration of the long range planning and zoning goals of the Town; and WHEREAS, the public necessity, convenience and general welfare require the proposed amendments. THEREFORE, RESOLVED by the Council of the Town Leesburg in Virginia as follows: SECTION I. The following amendments to the Leesburg Subdivision and Land RESOLUTION: -2- INITIATING AMENDMENTS TO THE I.F. ESBURG SUBDIVISION AND LAND DEVELOPMENT REGULATIONS REGARDING THE PRELIMINARY PLAN AND PRELIMINARY PLAT APPROVAL PROCESS Development Regulations are hereby initiated and referred to the Planning Commission for recommendation: Amend Sections 13-53(b), 13-55.1, 13-55.2, 13-57(d), 13-85(b)(5), 13-90(a) and 13-90(b) to designate staff as Council's agent for the review and approval of preliminary development plans and preliminary subdivision plats except in those cases where a proposed preliminary development plan or preliminary subdivision plat lies within a Planned Development Zoning District. SECTION II. The Planning Commission shall hold a public hearing to consider these amendments to the Subdivision and Land Development Regulations and report its recommendation to the Town Council pursuant to Chapter 22, Title 15.2-2204 of the 1950 Code of Virginia, as amended.
