HomeMy Public PortalAbout2001_09_25_r161The Town of 1 .eesburg, lrglnla RESOLUTION NO. 2001.161 A RESOLUTION: PRESENTED September 25; 2001 ADOPTED September 25, 2001 INITIATING AMENDMENTS TO THE ZONING ORDINANCE FOR THE DEFINITION OF DUPLEX, ADMINISTRATIVE REVIEW IN THE H-1 DISTRICT, NUMBERS AND DIMENSIONS OF OFF-STREET PARKING SPACES, AISLE WIDTHS, INCREASD BUFFER REQUIREMENTS AND ELIMINATION OF THE 15 PERCENT MAXIMUM BUFFER YARD LIMITATION AND AUTHORIZATION OF A JOINT PUBLIC HEARING WHEREAS, it is the intent and desire of Council to complete the comprehensive revision to the Zoning Ordinance to incorporate the recommendations of the 1997 Town Plan in as expeditious a manner as is practicable; and WHEREAS, certain provisions of the Zoning Ordinance should be amended in advance of the comprehensive revision to the Zoning Ordinance.in order to better realize the intent of the 1997 Town Plan; and WHEREAS, consideration of these amendments will enhance the effectiveness of the existing Zoning Ordinance; and WHEREAS, the public necessity, convenience, general welfare and good zoning practice require the proposed amendments. THEREFORE, RESOLVED by the Council of the Town Leesburg in Virginia as follows: SECTION I. The following amendments are hereby initiated and referred to the Planning Commission for recommendation: 1. Revise Article 18 Definition of Duplex to require a common party wall and Section 3E- 5(2)(b) to amend Duplex side yard requirements for the R-6 single-family District. 2. Revise Section 5A-4(1) to grant authority to the Preservation Planner to administratively approve Historic District Zoning Permit applications for lampposts, light fixtures, fences and residential walkways. 3. Revise Section 8A-8(1) to increase the number of parking spaces required for detached, townhouse, duplex and multi-family uses in certain cases. RESOLUTION: INITIATING AMENDMENTS TO VARIOUS SECTIONS OF THE LEESBURG ZONING ORDINANCE AND AUTHORIZING A JOINT PUBLIC HEARING 4. Revise Section 8A-9 to modify the dimensions of standard parking spaces and to eliminate compact parking spaces. 5. Revise Section 8A-9 to specify dimensions for physically handicapped accessible parking spaces. 6. Revise Section 8A-9(4) to require 24-foot two-way travel aisle widths in private parking lots. 7. Revise Section 9A-18 to require a 35-foot landscaped buffer between commercial uses over 10,000 square feet and residential uses. 8. Revise Section 9A-20(2) to remove the 15% maximum buffer yard limitation and replace it with administrative criteria for permitting waivers under certain conditions. SECTION II. Pursuant to Chapter 22, Title 15.2-2204 of the 1950 Code of Virginia, as amended, a notice that the above described Zoning Ordinance Text Amendments will be considered jointly by the Leesburg Town Council and the Leesburg Planning Commission shall be published in the Loudoun Times Mirror on September 26, 2001 and October 3, 2001 for a Joint Public Hearing to be held on Wednesday, October 10, 2001 in the Council Chambers Leesburg, Virginia, 20176.
