A RESOLUTION:
PERMITTING WITHDRAWL W~HOUT PREJUDICE OF CATOCTIN
SQUARE REZONING APPLICATION
WHEREAS, by letter dated October 16, 2001, counsel for the application asked that ZM
#2000-07 Catoctin Square rezoning application be permitted to be withdrawn without prejudice;
WHEREAS, Section 13A-7 of the Zoning Ordinance provides that Council may permit a
rezoning application to be withdrawn without prejudice, allowing the application to be
resubmitted at any time;
WHEREAS, new filing fees would be required in the event the applications were
withdrawn and then resubmitted;
WHEREAS, staff recommends that the applications be permitted to be withdrawn
without prejudice.
THEREFORE, RESOLVED, the Council of the Town of Leesburg in Virginia
that ZM #2000-07, Catoctin Square rezoning application be withdrawn without prejudice.
