A RESOLUTION APPROVING AN AMENDMENT TO THE TOWN OF FRASER
SUBDIVISION REGULATIONS (RESOLUTION NO. 1979-11-3) TO CHANGE CERTAIN
FEES AND CHARGES AND TO PROVIDE FOR CERTAIN ADDITIONAL FEES AND CHARGES
AS SET FORTH HEREIN
WHEREAS, the Town of Fraser Planning Commission and the Board
of Trustees adopted Subdivision Regulations October 3, 1979 and November
7, 1979, respectively; and
WHEREAS, the Town of Fraser Planning Commission has
recommended certain changes to said Regulations regarding fees and
charges for various activities controlled by said Subdivision
Regulations in order to cover the costs of the Town in handling,
reviewing and enforcing those requirements of the said Regulation; and
WHEREAS, a public hearing has been held on said proposed
changes pursuant to public notice having been given as required by
Section 10.2 of said Subdivision Regulations.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
TOWN OF FRASER, COLORADO, AND THE PLANNING COMMISSION OF THE TOWN OF
FRASER, COLORADO, THAT SECTION 10.3 OF THE FRASER SUBDIVISION
REGULATIONS BE AMENDED TO READ AS FOLLOWS:
1. In order to cover the costs of reviewing, processing and
enforcing these Regulations for any subdivision, including
variances and exemptions therefrom, there shall be charged and paid
by the applicant the fees set forth herein.
2. All fees provided for herein shall be paid in full on the
following dates:
a. For normal subdivision review - at the time of
filing any documents with the Town Clerk for sketch plan
approval;
b. For minor subdivision - at the time of filing any
documents with the Town Clerk for approval of such minor
subdivision;
c. For any exemption from these Regulations - at the
time of filing any documents or request (written or oral) for
such exemption, whichever first occurs.
d. For any Plan changes to a previously approved
subdivision, including a planned unit development (unless
controlled by separate Ordinance), condominium or townhouse
plat - at the time any request is made orally or in writing,
or documents filed, whichever first occurs.
e. No matters covered herein for which a fee is due and
payable shall be considered by Planning Commission or Board of
Trustees until the full amount of the described fees shall
have been paid. No part of the fees shall be refunded on
account of any denials, partial processing, withdrawal of part
or all of any requested application, or changes in these
Regulations subsequent to the payment of any such fees.
3. Subdivision fees shall be calculated as follows:
a. Residential (including condominium, townhouse, and,
if regulated, apartments):
(1) 1 through 5 lots or units - $100.00 per lot or
unit with a minimum fee of $400.00;
(2) More than 5 lots or units but less than 26 -
$50.00 per lot or unit with a minimum fee of $500.00;
(3) More than 25 lots or units but less than 101 -
$40.00 per lot or unit with a minimum of $1040.00;
(4) More than 100 lots or units - $30.00 per lot or
unit with a minimum of $3000.00.
b. Commercial (where land is zoned for commercial uses;
includes linear, condominium, townhouse and rental structure)
((if regulated by these Regulations)) subdivisions designed
and intended for commercial uses):
(1) $200.00 per 10,000 square feet or fraction
thereof of floor space (including walls) - for
condominium, townhouse and, if regulated, rental
structures - with a minimum of $500.00;
(2) $200.00 per acre or fraction thereof for a
linear subdivision - with a minimum of $500.00.

c. Industrial (where land is zoned for industrial uses;
includes linear, condominium, townhouse and rental structures
(if regulated by these Regulations) subdivisions designed and
intended for industrial uses):
(1) $100.00 per 10,000 square feet or fraction
thereof of floor space (including walls) - for
condominium, townhouse and, if regulated, rental
structure - with a minimum of $500.00;
(2) $100.00 per acre or fraction thereof - for a
linear subdivision - with a minimum of $500.00.
d. Minor Subdivision fees are as set forth in Section
9.9.
e. Subdivision exemption.
(1) $100.00 per lot or unit created by the
exemption with a minimum of $250.00;
(2) $150.00 for any exemption not involving the
creation of a lot or unit, such as boundary dispute,
encroachment line correction or changing of lot lines.
f. Phased Subdivision. (This fee applies to a
subdivision where all requirements of these Regulations are
not being initially complied with, but will be met at a later
date at such time as later phases or areas of the subdivision
are given final town approval for development and sale.)
(1) $100.00 per acre or fraction thereof, of the
entire area included in the Development Plan or project;
(2) For each phase of area of the subdivision given
final town approval and for which all subdivision
requirements are being then complied with, there shall be
subdivision fees, in addition to those in (1) above, as
described otherwise in this Paragraph 3 of Section 10.3.
Designated phases or separate filings as part of the same
subdivision shall not be consolidated for purposes of
determining subdivision fees - but shall each be
considered as a separate subdivision.

g. Subdivision General Development Plan Changes and/or
Re-Reviews: (This fee will apply to any residential, commer-
cial or industrial general development plan that has
previously been granted final approval, when the plan changes
are not major such as to require a fee for re-subdivision, but
the new plan changes the building arrangements or other
general planning aspects for which the Town has previously
agreed and for which changes the developer is required to
obtain approval from the Fraser Planning Commission or Board
of Trustees. This fee also applies to re-review of
Subdivision General Development Plans, updating improvement
agreements, or similar activities, as required by any
regulations, original subdivision requirements, or by
contractual obligations.)
(1) $100.00, or 5$ of the subdivision fee
previously paid, whichever is greater, plus any Town
expenditures for Town Attorney, Town Planner, independent
engineers, water Attorneys or other such expenditures.
h. Resubdivision
(1) Fees shall be determined in the same manner as
new subdivisions described above.
(2) A resubdivision occurs whenever lot lines,
airspace divisions, townhouse lots, rental units if
regulated herein, are to be made to a previously approved
subdivision final plat.
i. Variances from these Regulations
(1) $200.00 for each variance requested.
4. Section 9.9 entitled "Minor Subdivision Fees" shall be
changed so that the fees shall be $100.00 per unit or lot created
with a minimum of $250.00. All other provisions of Section 9.9
shall not be changed by this Amendment.
