TOWN.BREWSTER.MA.US THE BREWSTER BOARD OF HEALTH REGULAR MEETING TUESDAY, DECEMBER 4, 2007 AT 7:OOPM TOWN HALL, ROOM A Present: Dan Brightman, Chairman, Joanne Hughes, Vice Chairman, James Reynolds, Keith Johnson, Andrew Petty, Nancy Ellis Ice, Health Director and Tammi Mason, Administrative Clerk 7:00 Emily Gould-33 Rogers Road-oil tank variance Motion: JH-grant variance. JR seconded. 5 yes. 7:10 JT's Seafood-request to be declared a fast food restaurant Bud Noyes, owner, wants to have his restaurant declared fast food because he only uses paper products. He would like to be allowed to have 122 seats which is what the septic design is for. Motion: JR-change to fast food and allow 122 seats. JH seconded. 5 yes. 7:20 Eagle Surveying-variance request for 22 Sheffield Road Steve Haas represented the client. This system's SAS failed and they cannot meet the lot line setback. He is asking for the new SAS to be 5 feet from the lot line. JH spoke about this lot being in Zone 2. Motion: JH-grant variance request. AP seconded. 5 yes. 7:30 Coastal Engineering-well variance request for 22 Gull's Way John Schnaible represented the client. The following variances are being requested: 1. To allow a private well to be located less than 10' from the property line 2. To allow the proposed well to be installed in a well protection zone that includes 1 septic system Motion: JH-grant variance requests. KJ seconded. 5 yes. 7:50 Sweetser Engineering-request for I/A system at 1105 Millstone Road Winston Steadman, owner of property was present. Spoke about the type of I/A system he was installing and that this is an existing 4 bedroom house. Motion- JR-grant permission for I/A system. AP seconded. 5 yes. 8:10 Jeffrey Bornemeier-new owner of Thai Orchid (formerly Thai Aroi) No changes being made to restaurant. Ellis-variance request for 68 Hinckley Road Jason Ellis represented the client. He stated that this is an existing 3 bedroom dwelling that is under an order of upgrade by the Board of Health. The following variances are being requested: 1. Proposed SAS to be placed 3.6' from slab foundation 2. Modify construction in fill to 1' along sides of proposed SAS 3. No reserve area provided NI read a letter from an abutter that stated they had no objection to the project. Motion: JR-grant variance requests. JH seconded. 5 yes. 8:30 J.C. Ellis-variance request for 480 Lower Road Jason Ellis represented the client. He stated that his clients are selling their home and need to upgrade the system. The project has been approved by the Conservation Commission. The following variances are being requested: 1. Modify 5' excavation to below SAS only 2. No reserve area provided 3. Proposed SAS less than 10' from water line 4. Proposed leach area within 100' of bordering vegetated wetland AP questioned the water line and if it will be double sleeved if the concrete is lower than it. It will be a mounded system. JH questioned the bordering of the vegetated wetland. Motion: AP-grant variances as requested with Environmentally Sensitive Area conditions applying. KJ seconded. 5 yes. 8:40 J.C. Ellis-variance request for 91 Governor Bradford Road Jason Ellis represented the client. He stated that his clients are doing a kitchen extension and cannot meet the setback from the foundation wall to the SAS. He is asking fora 13' variance. They will be relocating the septic tank to accommodate this addition and that there will be a barrier placed on site. Motion: JH-grant variance request. AP seconded. 5 yes. 8:50 Bennett &O'Reilly-variance request for 250 Sheep Pond Drive John O'Reilly represented the client. He stated that they would like to put an addition on while keeping the existing septic system less than 300' from the pond. Motion: JR-grant permission for 3 bedroom septic with design plans that show 3 bedrooms. AP seconded. 5 yes. BOH 12/4/07 Minutes Page 3 9:00 Discuss letter from Richard Judd re: Septic inspection report cover page RJ asked that the Board consider changing the cover page to state that "system is closer than 300' to pond" is under ~~evaluation needed by Board of Health" instead of under'~failed system". The Board agreed to make the change. The Clerk will do the new form. 9:10 Bayside Seafood &Market-variance request for Unisex Handicapped bathroom Todd Hoyt, Owner told the Board that he needed the Board of Health's blessing before the State would approve any such request. Motion: JR-send letter to state that there is no objection to the unisex handicapped bathroom. AP seconded. 5 yes. 9:20 Chillingsworth-discuss ongoing dumpster complaint Meeting adjourned at 9:30PM Robert Rabin, Owner was present. He explained the on going history and that he as done things to try and resolve this issue. The Ritter's, who are abutters, spoke about their problems with this dumpster. Motion: JH-the Rabin's must request an early pick up from their rubbish removal company and that the trash gets picked up more often and if there is one more violation the dumpster must be moved. JR seconded. 5 yes. Have the inspector do few unannounced inspection. 5 yes. 1. Discuss Nickerson property on Clay Hole Road Noted Bills to be paid: JR-pay bills. KJ seconded. 5 yes. 1. Certificate of Compliance for Pleasant Bay Health & Living Center 4. Food inspections sheet 5. Monthly report for Brewster Manor 6. Assistant Health Director's monthly report for October Add on's JH spoke about emails and the Conflict of Interest laws. She also gave an update on the WQRC.
