APPROVING FINAL PAYMENT TO BEARING CONSTRUCTION FOR
THE BIOLOGICAL NUTRIENT REMOVAL PROJECT IN THE
AMOUNT OF $140,361.00
WHEREAS, Beating Construction has completed all contractual obligations as set forth in
the Biological Nutrient Removal (BNR) Upgrade Agreement dated July 13, 1999 and subsequent
contractual terms of the October 20, 2000 BNR Tender Agreement; and
WHEREAS, in consideration of the final payment, Beating Construction agreed to waive
further compensation and claims; and
WHEREAS, the Director of Utilities recommends final payment to Beating Construction in
the amount of $140,361.00 for BNR construction.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
The Town Manager is hereby authorized to execute final payment on the Water Pollution
with Beating Construction, in the amount of
Control Facility BNR Construction contract
$140,361.00.
