AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A
PRELIMINARY PUD PLAN AMENDMENT FOR PROPERTY LOCATED AT 925 SOUTH
COUNTRY CLUB DRIVE AND FINAL SUBDIVISION PLAT OF WESTPORT PLAZA
SUBDIVISION, A SUBDIVISION OF THE CITY OF JEFFERSON, MISSOURI.
WHEREAS, Edward Storey, owner of the real estate hereinafter described, having
submitted a Preliminary PUD Plan Amendment and Final Subdivision Plat
of said real estate, being located in Jefferson City, Cole County, Missouri,
and described as follows:
Part of the Southwest Quarter of the Southeast Quarter of Section 8,
Township 44 North, Range 12 West, in the City of Jefferson, Cole County,
Missouri; more particularly described as follows: Beginning at an iron pipe
at the southwest corner of the southwest quarter of the southeast quarter of
said Section 8; thence North 05 Degrees, 30 Minutes West, along the
quarter section line, 318.90 feet to an iron pipe at the southwest corner of
the property described in Deed Book 373, Page 864 in the Cole County
Recorder's Office; thence leaving the quarter section line North 83
Degrees, 14 Minutes, 18 Seconds East along the south line of said
property, 95.00 feet to an iron rod at the southeast corner thereof; thence
North 07 Degrees, 55 Minutes, 16 Seconds West, along the east line of
said property, 89.97 feet to a PK nail in concrete on the south right-of-way
line of South Country Club Drive per Deed Book 431, Page 56 in the Cole
County Recorder's Office; thence along a curve to the right 214.21 feet to a
PK nail in concrete (chord = South 80 Degrees, 42 Minutes, 40 Seconds
East, 212.84 feet and a radius of 545.36 feet); thence South 69 Degrees,
28 Minutes, 01 Seconds East, 27.95 feet to a PK nail in concrete at the
northwest corner of the property described in Deed Book 649, Page 990 in
the Cole County Recorder's Office; thence leaving the south right-of-way
line of South Country Club Drive South 20 Degrees, 29 Minutes, 47
Seconds West, along the west line of said property, 177.51 feet to a PK
nail in concrete at the southwest corner thereof on the north line of the
property described in Deed Book 659, Page 843 in the Cole County
Recorder's Office; thence leaving the southwest corner of the property
described in Deed Book 649, Page 990 in the Cole County Recorder's
Office and going North 68 Degrees, 24 Minutes, 25 Seconds West, along
the north line of the property described in Deed Book 659, Page 843 —
20.11 feet to an iron rod; thence South 09 Degrees, 34 Minutes, 11

southwest corner of said property on the south line of the property
described in Deed Book 294, Page 644 and on the south boundary line of
the southwest quarter of the southeast quarter of said Section 8; thence
leaving the southwest corner of the property described in Deed Book 659,

Degrees, 04 Minutes, 50 Seconds West, along the section line, 115.13 feet
to the Point of Beginning, subject to all easements and restrictions existing

WHEREAS, it appears that the procedures set forth in the Zoning Code relating to
Planned Unit Developments have in all matters been complied with, as said
property owner submitted to the Planning and Zoning Commission and City
Council a Preliminary PUD Plan Amendment for the above referenced
property.

WHEREAS, it appears that said plat has been fully and properly signed and accepted
by the owner of said subdivision, known and referred to as the Final
Subdivision Plat of Westport Plaza Subdivision, that all taxes have been
paid, that in all respects the requirements of Chapter 445, RSMo, entitled
"Plats" have been fully complied with by the owner of said subdivision, and
that in all respects the requirements of the Planning and Zoning
Commission of the City of Jefferson, Missouri, relating to plats and
subdivisions have been complied with.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Preliminary PUD Plan Amendment, on file as Case No. P16022 in
the Jefferson City Planning Division, is hereby approved for the land referenced above.
Section 2 The Final Subdivision Plat of Westport Plaza Subdivision, lying, being and
situated within the corporate limits of the City of Jefferson, Missouri, as shown by the said
plat attached hereto and made a part of this ordinance, is hereby approved and accepted
by the City Council of the City of Jefferson, Missouri.
Section 3. Common Areas and Public Land. No common areas are proposed and
no lands are dedicated to public use with this PUD Plan. The Final Subdivision Plat
dedicates public easements for utility purposes.
Section 4. The Mayor and City Clerk are hereby authorized and directed to endorse
acceptance of said plat hereon and to certify the approval of said plat under the seal of the
City of Jefferson.

its passage and approval.

Amendment and FinalSubdivision Plat to dividethe property,consisting of 1.96 acres,into4 lots.
The property is located on the south side of South Country Club Drive 250 feet west of
Fairgrounds Road and is described as part of the Southwest Quarter of the Southeast Quarter of
Section 8,Township 44 North,Range 12West(Osage County Land Surveying,Consultant).
Mr.Barron described the proposal and explained that the property consists of an existing
commercial office development with multiple buildings served by shared parking and driveway
access.He stated that the property owner wishes to divide the remaining complex into four lots,
one lot per building.Mr.Barron explained that two ofthe four lots would be flag lots,with narrow
strips of property connecting tothe city street.He stated that two separate drive entrances will allow
access to the development.Mr.Barron explained that Cherry Hill Dental is not a part of the
subdivision plat.He stated that signage easements located at each of the drive entrances are
shown,with a private agreementto be put in place granting each ofthe lot's the ability to place a
sign in theeasement if done so in accordance with the city sign code.Mr.Barron explained thatthe
private sewer line easement that servesthe existing building on proposed lot 2 and the Cherry Hill
Dental building is proposed to be platted as a publicsewer easement.
Mr.Ralph Kliethermes,Osage County Land Surveying,spoke regarding this request and
explained thatthe driveway and sewereasement maintenance agreements are being prepared by
John Landwehr.Mr.Kliethermes concurs with staff comments and recommendations.
No onespoke in opposition to this requestand no correspondence was received.
Mr.Barron gave the Planning Division staff report.Mr.Wade gave the Engineering Division staff
report.
Mr.Nunn moved and Mr.Dutoi seconded to recommend approval of the Preliminary PUD Plan
Amendmentto the City Council.The motion passed 8-0 with the following votes:

ENGINEERING STAFF RECOMMENDATION-
Recommend approval,subjectto technical itemsbeing addressedprior to the plat being
considered by the City Council.
Existing Infrastructure Summary
•Public infrastructure exists in the vicinity.
•Sidewalk exists along South Country Club Drive.
• No infrastructure improvements are necessary for this subdivision at this time.
• The property currently contains four (4) buildings and associated parking lots.
•Utilities exist in the vicinity to serve the subdivision.
Future Sanitary Sewer Extension
• All proposed lots are currently served by sanitary sewer. Lots 2 and the adjacent property
to the east are served by a common private sanitary sewer service with private easements
currently in place.
• A 20' public sanitary sewer easement is being proposed across a portion of proposed Lot
2 and proposed Lot 4 to insure that in the future, a City main extension can replace the
currently private sewer, at the expense of the affected property owner(s).
•Additional maintenance provisions concerning this sewer are being considered in the
private driveway, sewer, signage and ingress/egress agreement(s)to be executed along
with the proposed plat.
Technical Corrections
• Any technical corrections to the plat will be transmitted to the consultant prior to the
Planning and Zoning Commission Meeting.

Subdivision Plat.Request filed by Edward Storey, property owner, for a PUD Plan Amendment and Final
Subdivision Plat to divide the property, consisting of 1.96 acres, into 4 lots. The property is located on the
south side of South Country Club Drive 250 feet west of Fairgrounds Road and is described as part of the
Southwest Quarter of the Southeast Quarter of Section 8, Township 44 North, Range 12 West (Osage County
Land Surveying,Consultant).
Nature of Request
The property consists of an existing commercial office development with multiple buildings served by shared
parking and driveway access. The property was developed in multiple phases between 1987 and 2006, and
two buildings have been divided off from the original complex (one in 1995 and one in 2014). The property
owner wishes to divide the remaining complex intofour lots, one lot per building.
Two of the four lots would be flag lots, with narrow strips of property connecting to the city street. The
zoning code permits flag lots with a minimum 35 feet width on the pole portion of the lot. This subdivision
proposes widths of 24 feet, and is therefore a deviation from normal zoning code provisions proposed within
the PUD Plan. The subdivision also proposes lot lines within 3 feet of existing buildings, which is less than
the 10 feet setback required for a typical office or light commercial zoning district.
Ingress/egress and utility easements are shown on the subdivision plat, and maintenance agreements
(associated with the driveway serving the lots and the existing private sewer line serving lot 2 and the Cherry
Hill Dental property) are proposed to be put in place. Signage easements located at each of the drive entrances
are shown, with a private agreement to be put in place granting each of the lots the ability to place a sign in
the easement if done so in accordance with the city sign code.
The private sewer line easement that serves the existing building on proposed lot 2 and the Cherry Hill Dental
building is proposedto be plated as a public sewer easement. The existing sewer line would remain a private
line, but the public easement would allow for construction of a sewer main line, if the property owners of the
two buildings ever desire to upgrade the line to a public line and remove themselves from the maintenance
responsibilities associated with the private line.
Zoning History
October 8,1987 - PUD Plan for Phaseone of the development, consisting of five buildings, was approved.
December 14, 1995- PUD Plan Amendment to divide off a 0.21 acre tract from the development plan.
February 13,1997 - Request for an off premise sign was denied.
November 18,1999 - request for an off premise sign was approved for a limited time period.
May 12, 2005 - Revised PUD Plan to modify the site layout was approved.

Staff Analysis
ThePUDplan amendment proposes no changes to the existing arrangement of buildings and driveways,only
a deviation from normal zoning code requirements for flag lots to permit a narrower lot width at the street
connection and smaller setbacks than the standard setbacks for an office or light commercialdistrict. Both
deviations from normal zoning code provisions are meant to accommodate the division of the existing
development so that each building is on a separate lot and, when paired with ingress egress easements and
private maintenance agreements typical forsuch developments,have little impact on the development nature
ofthe areaor surrounding property.The Final Subdivision plat meets the requirements of theCityCode with
the above exceptionsand subjectto technicalcommentsand corrections identified by city staff. The private
ingress/egress easements and maintenance agreements,once executed,are sufficient to ensure proper utility
and vehicle access to each of the lots.
