January 8, 2002 20024 1 ADOPTED January 8, 2002 AMENDING THE 2002 LEGISLATIVE PROGRAM WHEREAS, the Virginia Housing Study Commission has recommended that the General Assembly amend the Code of Virginia to treat manufactured houses the same as single family homes for zoning purposes; and WHEREAS, the Town Council is seriously concerned that this change would be a dilution of local authority in land use regulation, and would take away one of the few tools localities possess to help ensure some consistency in neighborhoods; and WHEREAS, the Council is concerned that manufactured houses may pose more of a fire and safety concern than stick-built houses; and WHEREAS, the Legislative Transition Task Force established under the Virginia Electric Utility Restructuring Act has recommended new administrative and regulatory procedures that would take away local authority in land use regulation over the siting new electric generation facilities; and WHEREAS, local governments play an important role in ensuring that new electric generation facilities do not adversely impact residential areas and are in compliance with local comprehensive planning documents; and WHEREAS, the staff recommends that the Council take positions in opposition to these proposed changes. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the 2002 Legislative Program is hereby amended as follows: -2- A RESOLUTION: AMENDING THE 2002 LEGISLATIVE AGENDA 1. The Town urges the General Assembly to oppose the recommendation of the Virginia Housing Study Commission to amend the Code of Virginia to treat manufactured houses the same as single family houses for zoning purposes. This change would be a dilution of local authority in land use regulation, and would take away one of the few tools localities possess to help ensure some consistency in neighborhoods. 2. The Town urges the General Assembly to oppose any new administrative and regulatory procedure recommendations of the Legislative Transition Task Force, established under the Virginia Electric Utility Restructuring Act, that would take away local authority in land use regulation over the siting new electric generation facilities. 3.
