RESOLUTION NO. 2002-23 ADOPTED February 12, 2002
A RESOLUTION: AWARDING THE FREEDOM PARK CONSTRUCTION CONTRACT TO
TUCON CONSTRUCTION CORPORATION FOR A TOTAL LUMP SUM
AMOUNT OF $2,386,727.00 THAT INCLUDES USE OF ALTERNATE 1 IN
THE AMOUNT OF $27,727.00 TO SOD THE BASEBALL FIELDS INSTEAD
OF SEED
WHEREAS, in April 1999, the Town of Leesburg purchased a seventy-seven acre tract of land
along Evergreen Mill Road and Tolbert Lane known as the Grenata property; and
WHEREAS, the Town Council designated approximately twenty (20) acres of the total tract to
be used as a future park to accommodate youth football, girl's softball, little league baseball, and youth
soccer; and
WHEREAS, in May 2000, the Town Council awarded a contract to Dewberry & Davis to design
and engineer the park site for future development; and
WHEREAS, in October 2001, the Town Council named the park site "Freedom Park" in honor
of those who gave their lives on September 11, 2001, and those past, present, and future who embody
and defend freedom; and
WHEREAS, the Town of Leesburg's Capital Improvement Program includes funding for the
construction of Freedom Park; and
WHEREAS, the Freedom Park construction project includes development of four, two hundred
foot ball fields for little league baseball and girls' softball, one full-size athletic field for youth football
and soccer, bleachers, dugouts, sports lighting, field irrigation, a service building for public restrooms,
storage, and concessions, asphalt trails, landscaping, and all work related thereto; and
WHEREAS, in November 2001, an Invitation for Bids (IFB) was issued for the construction of
Freedom Park in accordance with Section 8.1, Competitive Sealed Bidding of the Town of Leesburg
Purchasing Policy; and

WHEREAS, on January 22, 2002 nine sealed bids were received allowing four (4) different
alternates; and
WHEREAS, the four (4) alternates were: Sod the baseball fields instead of seed; delete
the furnishing and installing of the paddock style fencing and wood gates except along Evergreen
Mill Road; delete all above ground sports lighting equipment; and delete interior landscaping except
along Evergreen Mill Road and Tolbert Lane.
WHEREAS, The contract may be awarded to the lowest responsible and responsive bidder with
any or all alternates the Town chooses; and
WHEREAS, bids received were publicly opened in accordance with the bid documents;
and
WHEREAS, bids were received from the following companies in the total amounts including the
use of Alternate 1 to sod the baseball fields rather than grass seed, as listed below:

WHEREAS, the bids were evaluated by the Capital Projects Administrator pursuant to the bid
documents and the Town of Leesburg' s Purchasing Policy; and

AMOUNT OF $2,386,727.00 THAT INCLUDES USE OF ALTERNATE 1 IN
THE AMOUNT OF $27,727.00 TO SOD THE BASEBALL FIELDS INSTEAD
OF SEED
WHEREAS, Tucon Construction Corporation is determined to be the lowest responsive and
responsible bidder at a total lump sum bid amount of $2,386,727 for construction of Freedom Park; and
WHEREAS, the Director of Parks and Recreation and the Capital Projects Administrator
recommend approval of an award of contract to Tucon Construction Corporation in the amount of
$2,386,727 for construction of Freedom Park.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
The Town Manager is hereby authorized to award, on behalf of the town, a total lump sum
contract with Tucon Construction Corporation in the amount of $2,386,727 for construction of Freedom
Park, which includes placing sod in the baseball fields instead of grass seed.
