Mayor Harker called the regular meeting of the City Council to 2. order at 7:30 P. M. Elder Harold Calkins of the Seventh Day Adventist Church gave the invocation followed by Mayor Harker 3. leading the audience in the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker ABSENT: Councilmen -None ALSO PRESENT: City Attorney Martin, Planning Director Dragicevic;. Administrative Asst. Recupero, City Manager Koski 5. APPROVAL OF MINUTES: Regular meeting of March 1, 1966. The Deputy City Clerk corrected the minutes to add as follows: "Councilman Nunamaker moved that the Ministerial Assn. be given permission to hang banners and signs for 'Holy Week' with insurance requirements, Councilman Dickason seconded, and the motion carried unanimously." This was omitted in the minutes under item #14. Councilman Dickason moved to approve the minutes as corrected, Councilman Merritt seconded, and the motic: was unanimously carried. UNFINISHED BUSINESS: 6. ORDINANCE NO. 66-1901st re,,:,., City Attorney Martin read tide to Ordinance No. 66 -190 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 406, 409, 506, 509, 607, 610, 707, and 710 OF ARTICLE IX OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO YARD REQUIREMENTS, Councilman Merritt moved to waive further reading of Ordinance Mo. 66 -190, Councilman Nunamaker seconded, and the motion carried unanimous 1 y. PUBLIC HEARING: SULTANA STREET IMPROVEMENT: 7:30 P. M. Councilman Merritt moved to open the public hearing, Councilman Nunamaker seconded, and the motion carried unanimously. City Manager Koski presented the proposed project and recommend- ed the Council accept the private street known as Sultana betweer Sereno and Acasco with a right of way of 50 ft. The property owners have agreed to construct curb and gutter less the 50 rebate with the City to provide the engineering and paving. He advised all property owners except one had dedicated road right of way and recommended condemnation for this one property as the owners will not dedicate.. This property is at the southwes corner of the T intersection with Sereno-Dr. Mayor Harker announced that now was the time for anyone wishing to speak in favor of the improvement to speak. H. E. Mannschrcck, 5063 Sultana, was in favor and felt the-im- provement would improve the whole area 100X. E. C. Olsen, -5069 Sultana, Ron Christie -5114 Sultana, Mrs. Olsen,- 5069 Sultana, Norm Browner_5043 Sultana, Chet Radwan -5092 Sultana, all spoe in favor of the improvement. No one else carne forward to speak in favor. Mayor Harker asked for anyone opposing the improvement to come forward to speak, Henry Note, 5231 Sereno, stated he was opposed to the improve- ment as p fanned as it would completely take the yard away from one of the housa., on his lot, He presently has curb and gutter and his property is all fenced, He recommended they make a cu 1 de sac. Mrs. Nolte also spoke in opposition. No one else came for and to speck against this improvement. Councilman Dickason moved to close the public hearing, Council- man Merritt seconded, and the motion carried unanimously. 874 Council Minutes, March 15, 1966, pegs 2 Mr. Scott of the Los Angeles County Road Dept. explained that a cul de sac in this area would be undesirable as this would force the residents of Sultana to use Pentland for access onto Rose- mead which would be a much greater traffic hazard than via Sereno. Also t'ddeni.ng access toaSereno Drive would give `w,etter police and fire protection. He brought out that it would be about 15 ft. at that corner that would be involved. Councilman Dickason, in view of the testimony of the proponents, moved to approve the street design as presented and to authorize action by dedication or other action under Chapter 27 improvement Act, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilnen -None ABSENT: Councilmen -None 7. PETITION RE KENNEL 4906 ENCINITA AVE. City Manager Koski presented a petition signed by 83 property owners in the southwestern part of the City protesting the noise of dogs housed at 4906 Encinita. Report from the Health Officer indicates the general sanitation was satisfactory and meets with requirements in general, weeds need removal around the runs, and there were no flies or odors at the time of inspection. The zoning enforcement inspector advised Mr. Shook operates a private non - commercial kennel, and he is a breeder primarily. This is considered a kennel because he has more than four animals. The City Manager advised under our zoning ordinance the building must be completely sound proof with an 8 ft. solid masonry wall. This kennel has fibre glass in walls and ceiling which is not a sound proof building. Also there is no 8 ft. masonry wall and the runs should be constructed to our requirements which is that they be inclosed. The original license was issued in March, 196': and renewed this year in Marti. He reccmmended in light of the moratorium placed on kennels ela no further action be taken at this time pending Planning Commission action. After discussion Councilman Tyrell moved to set this for June 7 also and get a report back from the Planning Commission and if necessary a public hearing can be set at that time, Councilman Merritt seconded, and the motion carried unanimously. J. M. Waterman, 4943 Encinita, states hers a kennel owner and he would like to work with the Planning Commission. NEW BUSINESS: 8. APPROVAL OF PLAN FOR BALDWIN AVE. RECONSTRUCTION: City Manager Koski presented the plans for the Baldwin Ave. re- construction together with an estimated cost of $211,838.55, which is proposed to be financed by 2107. gas tax funds, with construction date of August 1. Acquisitions will be completed by March 28 and trees, bushes and obstructions will be removed. He proposed to go to bid in June with completion set for Sept. 1; 1966, and will be covered in the 1966 -67 budget. Telephone facilities will be underground on both sides of the street. Councilman Tyrell moved to approve, Councilman Nunamaker seconder roll call vote to carry the motion as follows: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None DOUBLE DR. LANDSCAPING & SPRINKLER INSTALLATION: The City Manager presented a letter from Krelle & Lewis stating the landscaping has been completed on Double Dr. and recommending the work be accepted and the contractor be paid $3208.95 and leaving a 1O% retention, Councilman Tyrell so moved, Councilman Merritt seconded, and the motion carried unanimously. 10. ORDINANCE NO. 66 -189: 6uilding Code Amendment increasing grading fees. The City Attorney arivi sec: the County has increased their fees and requested the City do Iire::� se. He then read title to Ordinance No. 66 -109 AN OR)IWA CE AMENDING ORDINANCE NO. 62 -65 OF THE CITY OF TEMPLE CITY RELAi' I NG TO FEES FOR GRADING PERMITS Councilman Tyrell moved to waive further reading, Councilman Nuns maker seconded and the motion carried unanimously. As this was the first reading no further action was takena 875 Council Minutes, March 15, 1966, page 3 • 11. RESOLUTION NO. 66 -585: appointing part time and temporary em- ployees. City Manager Koski presented Resolution No. 66 -585 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PART - TIME AND TEMPORARY EMPLOYEES. Councilman Tyrell moved to adopt, Councilman Merritt seconded, and the rnotion carried unanimously. The City Manager presented Resolution No. 66 -590 A RESOLUTION OF THE CiTY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING BENIGNA MAURA AS PARK MAINTENANCE MAN, Councilman Tyrell moved to adopt Resolution No. 66-590 Councilman Merritt seconded, and the motion was unanimously carried. 12. TRAFFIC COMMISSION RECOMMENDATIONS: item 5. Policy on Church Signs: recommend policy as follows: a. Utilize existing signal standards, light posts, at intersec- tions with placement of signs on far side of intersection. b. Place signs at first major arterial east, south, north or west of the church as determined by field investigation. c. if more than one church involved at any location utilize same pole. d. If no signal standards or light posts available should use a 4x4 redwood post. e. Placement of all church signs will be done by sign posting crew of Traffic. Engineer. f. Must conform to uniform size (18" x 24" maximum). g. Signs to be furnished and paid for by the Church. h. Must be porcelain enamel. Traffic Engineer presented the above recommendations. Councilman; Nunamaker moved to approve, Councilman Tyrell seconded, and the motion carried unanimously. item 7. Curb Marking Policy: recommended policy change in green, yellow and white curb markings. Engineer Envall presented the recommendations to the Council. Councilman Merritt moved to approve item 7, Councilman Nunamaker seconded, and the motion carried unanimously. Item 9. Trade `.!ends Apartment, Rosemead parking problem: re- commend sign "Park Parallel" on west service road at 5351 Rosemead. The Traffic Engineer presented the recommendation stating due to angular and wrong -way parking there was a problem in the cul de sac west service road. Following discussion Councilman Nunamaker moved to approve subject to tha jurisdiction of the C i ,. Councilman Dickason seconded, and the motion carried unanimously: Item 11. Recommend granting permission to High School to uniform "funder supervision of the staff) "No Parking" signs ad- jacent to school property on Temple City Blvd. east and west from Camino Real south to Lemon Ave., and both sides of Lem Ave. from Temple City Blvd. to Oak Ave. in inclement weather to be coordinated with Sheriffs Dept. and contingent upon legal decision of the City Attorney. Engineer Envall presented the above recommendation. He advised the school parking lot cannot be used during wet weather and the new lot will not be ready until next school term. Also the City Attorney advised there was no objection to covering during this period of time. Following discussion it was brought out that there would be very little wet weather before next fall when the parking lot would be available. Councilman T ;s,ell moved to deny Councilman Dickason seconded, and the motion was carried by the following called vote: AYES: Councilmen- Dickason, Merritt, Nunamaker, Tyrell NOES: Councilmen- Harker ABSENT: Councilmen -Mone Item 12. Recommend approval of Baldwin Ave. channelization in conjunction with street widening. No action taken on Item 12 as this has already been approved under. Agenda item 8, 13. PLANNING COMMISSION RECOMMENDATIONS: a. Lot split ordinance approved and recommended to the Council for adoption. Planning Director Dragicevich presented the above recommendation from the Planning Commission following study of the proposed ordinance, and explained the various changes involved. 876 Council Minutes, March 15, 1966, page 4 City Attorney Martin presented Ordinance No. 66 -191 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING ORDINANCE NO. 63 -107 WITH REFERENCE TO MINOR LAND SUBDIVISIONS. Councilmar; Tyrell moved to waive further reading of Ordinance No. 66 -191, Councilman Merritt seconded and the motion carried unanimously. 14. RESOLUTION NO. 66 -568: Warrants & Demands in the sum of $39,132 Nos. 7733 through 7828. City Manager Koski presented Resolution No. 66 -586 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS iN THE SUM OF $39,132.31, DEMAND NOS. 7733 THROUGH 7828. Councilman Nunamaker moved to adopt Resolution No. 55 -586, Councilman Tyrell seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None 15. PETITION FOR IMPROVEMENT OF LOMA AVE. & ,!AiVER OF DEBT LIMIT FOR SANITARY SEWERS. City Manager Koski advised he had received a letter from the County Engineer submitting a petition for improvement of Loma Ave,. Ave. with sanitary sewers and recommended the Council agree to consider if returned by July 1, 1966. Councilman Tyreli moved to approve, Councilman Merritt seconded, and the motion carried unanimously. 16. REQUEST FROM REGISTRAR OF VOTERS: Use of City Hall and facilities, for a check -in center for primary election June 7 and general election on November 8. The City Manager presented the above re- quest. Councilman Tyrell moved to grant, Councilman Nunamaker seconded, and the motion carried unanimously. 17. COMMUNICATIONS: City Manager Koski presented a charitable solicitation request from the Junior Class of Temple City High School to conduct a car wash on April 16 at Rays Standard Station for prom activiti:. Councilman Tyrell moved to grant, Councilman Nunamaker seconded, and the motion was unanimously carried. 18. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: '�1. H. Dunham, 9425 Gidley, stated he was a kennel owner and was also representing other kennel owners in the City, and presented a set of standards the kennel owners have agreed to abide by. He also recommended the Planning Commission work out suitable buffer zoning between the M1 and residential areas. Mrs. Ray McClellan, 5345 Barela, stated she signed the petition and she complained about the noise and asked why licenses were issued last year at 4906 and 4916 Encinita with out conforming to the zoning ordinance. Mayor Harker advised this matter is now under study. Paul Schwinn, 5444 Baldwin Ave., stated he owned the second prop- erty south of Daines Dr. on the east side. He asked about going south on Baldwin with the median development and the City Manager advised there would be a break in the median at Raines Dr., also that Baldwin Ave. would be a connecting link between San Bernard; Freeway and the new Foothill Freeway to be constructed. Mr. Schwinn asked for a copy of the plans, was advised at the present time there were none available but that a copy of the lay -out could be purchased through the Engineer's Dept. for around $1. and when received the City Manager will deliver it to him. Jerry McClellan, 4904 Encinita, asked a number of questions regar ing kennel operations and our ordinance covering them. He was advised this is under study and these petitions and complaints will be considered June 7 following a report back by the Plannirc Commission and further study by the Council. 19. MATTERS FROM CITY OFFICPALS: Cpuncilman Dickason asked when the sidewalk plan would be produc- ed and the City Manager advised it would be presented at the study session on April 4. 877 1 1 Council Minutes, March 15, 19669 page 5 Councilman Merritt suggested possibly a study session be held to consider the number of break -ins in the business area in recent months and possible need of more coverage. Discussion followed and the City Manager advised Capt. Pascoe Is presenting a report and a program which will be proposed to the Chamber of Commerce. Mayor Harker stated he was disappointed with the appearance of the Temple Center banners. Councilman Nunamaker advised the town was packed for the Treasure Hunt. City Manager Koski presented Resolution No. 55 -587 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, CALL. ING FOR SEALED BIDS ON BONDS TO BE ISSUED TO REPRESENT UNPAID ASSESSMENTS UPON LANDS IN VEHICKE PARKING DISTRICT NO, 3 OF SAID CITY. Councilman Tyrell moved to adopt Resolution No. 6 -587 Councilman Nunamaker seconded, and the motion carried unanimously. The City Manager presented a report from the Park Dept. that two Palm trees in Temple City Park were infested. Removal is recommended at a cost of $195. The other palms have been sprayed` There is no replacement called for. Councilman Dickason moved to approve, Councilman Nunamaker seconded, and the motion carried unanimously. The City Manager presented another recommendation from the Park Dept. that the Sycamore trees on Las Tunas Dr. be removed. The new parkway trees„ the same as used in the commercial area, have been planted and he recommended removal of Sycamores. Councilma^ Nunamaker moved to take them out, Councilman Dickason seconded, motion carried with only Councilman Tyrell objecting. City Manager Koski presented Revolution No. (6 -588 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADOPTING AND SUBM I T- TIING A BUDGET FOR EXPENDITURE OF FUNDS ALLOCATED FROM THE STATE HIGHWAY FUND TO CITIES. He advised this was for Baldwin Ave. an,_ the funds are not submitted until budgeted. Councilman Tyrell moved to adopt Resolution No. 66-588, Councilman Nunamaker se- conded, and the motion carried unanimously. The City Manager ex plained this applied to the 1965 -66 budget. The City Manager presented Resolution No. 66 -589 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADOPTING AND SUBMIT- TING A BUDGET FOR EXPENDITURE OF FUNDS ALLOCATED FROM THE STATE HIGHWAY FUND TO CITIES. This resolution applies to the 1966 -67 budget.Councilman Merritt moved to adopt Resolution No. 66 -589, Councilman Tyrell seconded, and the motion carried unanimously. The City Manager requested authorization to purchase a Polaroid camera for the sum of $110. in order to better cover various pro- jects the staff is working on in the field to be submitted to the Council with reports. Councilman Merritt moved to approve, Councilman Nunamaker seconded, and the motion was carried unani- mously, 20. ADJOURNMENT: Councilman Merritt moved to adjourn to a personnel session, seconded and carried unanimously. Council adjourned at 9 :55 P. M.
