A RESOLUTION GRANTING AN EXTENSION TO THE PERIOD OF VALIDITY
OF THE PRELIMINARY PLAT OF THE VILLAGES, OF TIFFIN, PHASE 1,
AND FURTHER APPROVED THE REVISED PRELIMINARY PLAT RECEIVED
AND THE NEED TO AMEND CERTAIN PROVISIONS OF THE ORIGINAL
DEVELOPERS AGREEMENT DATED MARCH 19, 2007
WHEREAS, the Preliminary Plat and the Development Agreement for The
Villages of Tiffin, Phase 1, a subdivision to Tiffin, Iowa, were approved by the
Tiffin City Council on February 15, 2007, under .Resolution No. 2007-7, and
pursuant to the Tiffin Subdivision Section 5.08 the validity of. the Preliminary
Plat has expired.
WHEREAS, the Subdivider/Owner, "The Villages, L.C.", hereinafter
"Villages LC", desires to proceed with the development of the subdivision by
filing a "Revised Preliminary Plat Villages of Tiffin, Phase One" with the City on
February 21, 2008.
WHEREAS, the City desires to extend the period of validity of the original
approved "Preliminary Plat" and to acknowledge the date of receipt of the
"Revised Preliminary Plat".
WHEREAS, the City needs sufficient time to examine the "Revised
Preliminary Plat" as required in Tiffin Subdivision Ordinance Section 5.07(D).
WHEREAS, in contemplation of approval of the "Revised Preliminary
Plat", the parties need to amend applicable provisions of the unrecorded
"Developer's Agreement" approved February,21, 2007, and dated March 19,
2007.
NOW, THEREFORE, BE IT RESOLVED by the CITY OF TIFFIN, IOWA,
that the validity of the "Preliminary Plat The Villages of Tiffin, Phase 1, Tiffin,
Iowa," approved February 15, 2007, is hereby extended for one year. The City
approved the "Revised Preliminary Plat". The City notes the needy to amend
certain provisions of the Developer's Agreement in contemplation of approval of
the "Revised Preliminary Plat".
ON THE 12th day of March 2008, at a regular meeting of the Tiffin City
Council, Tiffin, Iowa, Councilperson John Wright introduced A RESOLUTION
GRANTING AN EXTENSION TO THE PERIOD OF VALIDITY OF THE
PRELIMINARY PLAT OF THE VILLAGES, OF TIFFIN, PHASE 1, AND
FURTHER APPROVED THE REVISED PRELIMINARY PLAT RECEIVED AND
-THE NEED TO AMEND; CERTAIN PROVISIONS OF THE ORIGINAL

WHEREUPON, the Mayor declared that the A RESOLUTION GRANTING AN
EXTENSION TO THE PERIOD OF VALIDITY OF THE PRELIMINARY PLAT
OF THE VILLAGES, OF TIFFIN, PHASE 1, AND FURTHER APPROVED THE
REVISED PRELIMINARY PLAT RECEIVED AND THE NEED TO AMEND
CERTAIN PROVISIONS OF THE ORIGINAL DEVELOPERS AGREEMENT
DATED MARCH 19, 2007, be adopted and signified his approval of the same
by affixing his signature thereto.
PASSED, by the Council on the 12th day of March 2008, and approved by the
Mayor on the 12?" day of March 2008.
