A RESOLUTION: PRESENTED February 12; 2007, 2 0 0 2- 2 7 ADOPTED Fehmary 12:2007 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LEESBURG, VIRGINIA CONCERNING ANNEXATION OF TERRITORY IN LOUDOUN COUNTY, VIRGINIA WHEREAS, on November 27, 2001 the Town Council adopted a resolution proposing the annexation of certain areas within Loudoun County; and WHEREAS, since adoption of that resolution, the Town Council has conducted further study and received valuable input from citizens both within Leesburg and the County; and WHEREAS, the Town Council is of the opinion that annexation of the following areas is in the best interest of the Town: (1) the parcels identified as Areas 2, 2A and 2B in the Urban Growth Development Plan Study, (2) the parcel identified as Area 6 in the Urban Growth Development Plan Study; and WHEREAS, the Town Council is of the opinion that the following areas should no longer be considered for annexation to the Town: (1) the parcels identified as Area 3 in the Urban Growth Development Plan Study, (2) the parcels identified by the AllFirst Petition as the "Hunter-Dowdy Parcels" unless a covenant is recorded against such properties precluding use of such properties for a commercial electrical generating plant and related facilities, (3) those parcels owned by Luck Stone Corporation zoned MR-HI (Mineral Resource - Heavy Industrial), and (4) the parcels identified as Area 1 in the Urban Growth Development Plan Study WHEREAS, the Town Council proposes that any annexation agreement entered into between the Town and the County should include language that the Town will reduce the level of development in that area south of the Town (previously identified as Area 2 in the Urban Growth 2 A RESOLUTION: CONCERNING PROPOSED ANNEXATION AREA Development Plan Study) substantially below the intensity currently proposed in the County's adopted General Plan to a range in the neighborhood of two to three million square feet of non- residential development over the next 20 years, so long as such agreement also includes language which would require the County to reserve the right-of-way for Crosstrail Boulevard bom Route 15 to the Dulles Greenway and which would specify that Crosstrail Boulevard will be considered for construction at such time as Route 15 south of Leesburg has reached a level of service lower than "D" as determined by VDOT. THEREFORE, RESOLVED by the Council of the Town Leesburg in Virginia in a meeting assembled on the 12 day of February, 2002: 1. That the Town Council directs its Town Manager and special legal counsel to prepare a new map identifying the areas now proposed for annexation and to take all other steps necessary to prepare a filing with the Virginia Commission on Local Government; 2. That the Town Council further directs its Town Manager and special legal counsel to notify the Commission, pursuant to Section 15.2-2907(E) of the Code of Virginia (1950), as amended, that the Town desires to negotiate, under the direction of the Commission's designated mediator, an agreement with the County for the annexation of said territory to the Town; 3. That the Town Council further directs its annexation committee to continue negotiations with the County's annexation committee to reach an agreement based on this resolution. 3 A RESOLUTION: CONCERNING PROPOSED ANNEXATION AREA 4. That the Town Manager is directed to publicize this revised annexation proposal and to seek input from the public before an annexation petition is filed. 5. That the Town Manager is authorized to take all other such actions necessary to accomplish the objectives set forth herein. PASSED this 12th day of February 2002.
