RESOLUTION NO. 2002-33 ADOPTED March 12, 2002
A RESOLUTION: APPROVING CHANGE ORDERS 13 THROUGH 18 FOR THE SOUTH
KING STREET IMPROVEMENTS PROJECT IN THE AMOUNT OF
$146,233.28
WHEREAS, the Town of Leesburg has approved a Capital Improvement Project known
as the South King Street Improvements Project; and
WHEREAS, the Leesburg Town Council awarded a construction contract in the amount
of $972,849 to Rustler Construction Incorporated in April 2000 to complete the South King
Street Improvement Project; and
WHEREAS, the plans included the installation of curb, gutter, storm drainage, sidewalks,
water and sewer line replacements and new pavement improvements; and
WHEREAS, the Town Council added fiber optic conduit and street lights to the project
by Resolutions #2000-187 and #2000-224; and
WHEREAS, Change Orders have been necessary due to unforeseen conditions, BAR
requirements, easement agreements, varied quantities and field conditions which were not
anticipated during the design process of the project; and
WHEREAS, the Capital Improvements Policy Manual requires that Change Orders in
excess of 25% of the contract amount be approved by Town Council; and
WHEREAS, the amount paid to Rustler Construction to date is $1,318,196.92; and
WHEREAS, Change Orders #13 through #18 required to close this project total
$146, 233.28; and

KING STREET IMPROVEMENTS PROJECT IN THE AMOUNT OF
$146,233.28
WHEREAS, scope of work and amount of Change Orders #13 through #18 are included
with the attached memorandum dated February 19, 2002; and
WHEREAS, these Change Orders exceed the 25% of the amended contract amount; and
WHEREAS, after executing these Change Orders the total increase in the construction
contract amount will be 37%; and
WHEREAS, the South King Street Improvements project has sufficient money in the
budget to cover the associated costs; and
WHEREAS, the Director of Engineering and Public Works and the Capital Projects
Administrator recommend approval of the change orders.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follow:
The Town Manager is hereby authorized to approve and execute Change Orders No. 13,
14, 15, 16, 17, and 18 for a total amount of $146,233.28.
