A RESOLUTION: 2002 50 APPROVING SPECIAL STATION AUTO WASH EXCEPTION PRESENTED: April 9, 2002 ADOPTED: April 9, 2002 #SE 2001-08, LEESBURG WHEREAS, Mr. Thomas J. Magazzine trading as Magazzine Clean, LLC, has requested special exception approval to permit an automated single tunnel car wash with a detailing pavilion at Catoctin Circle; and WHEREAS, the property is located in the B-2 (Established Corridor Commercial) District; and WHEREAS, on February 21, 2002, the Planning Commission recommended conditional approval of this application; and WHEREAS, on March 26, 2002 the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for a car wash facility, as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE RESOLVED by the Town Council of Leesburg, Virginia as follows: Special Exception application #SE 2001-08, Leesburg Station Auto Wash, Mr. Thomas J. Magazzine, Catoctin Circle, identified in the Loudoun County Land Records as Tax Map 48K((2)) Parcel J (MCPI #232-40-3897) is hereby approved subject to the following conditions: 1) The hours of operation shall be from 7am to 9pm to limit impacts on residential neighborhood to the south with the exception of Sunday hours of operation which shall be 9am to 7 pm. -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION #SE 2001-08 LEESBURG STATION AUTO WASH 2) Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual, and that final plats, development plans, and construction drawings are subject to the applicable town regulations. 3) The Applicant will provide 25-foot buffers with S3 screening along the common boundary lines with the W&OD Trail and the Loudoun County Rescue Squad. Along the common boundary with the Rescue Squad, the applicant will utilize 'prickly' shrubbery to serve as a deterrent for people from trespassing on the Rescue Squad's property. In addition, the applicant will plant 12 additional trees adjacent to the Northern Virginia Regional Park Authority's property. The Applicant will provide evergreen trees a minimum of ten feet in height along the curve of the wash tunnel drive aisle that is closest to the Oakview Homeowners Association as shown on the special exception plat to shield the site from this adjacent residential neighborhood. A six (6) foot board fence shall also be added at this location until such time as the evergreen trees have matured and create and opaque screen, unless a fence is not wanted by the Oakview Homeowners. 4) The Applicant will not allow water from the site to go onto Catoctin Circle to eliminate the potential for icing. 5) The Applicant will address the issue of stormwater management at the Development Plan Phase. 6) The Applicant will indicate where the emergency access to the landlocked property to the south is to be located at the time of Development Plan approval. 7) All outdoor lighting fixtures shall not have a source of illumination that is visible beyond the site or cause illumination of adjacent properties in excess of 0.5 foot-candles, as measured at the site boundary. 8) The Applicant agrees to conform to a "train station theme" for the overall development of the Leesburg Station Auto Wash and further agrees that the proposed detailing station shall be in general conformance with the elevation prepared by Olivola Associates, Inc. dated September 11, 2001. 9) A water reclaim system shall be installed for the purpose of recycling the wash water. 10)The development shall be in general conformance with the special exception plan prepared by Bowman Consulting Group, dated September, 2001 and revised through February 21, 2002. The following adjustments may occur as a result of final site engineering and design: · Drive aisles to wash tunnel may be widened. · There may be two lanes and two cashier booths leading to the wash tunnel entrance. · Self-service vacuums may be eliminated. The detailing pavilion may be enlarged into the space formerly occupied by the self-service vacuums and the side awning may be eliminated. · The wash tunnel may be shortened. -3- A RESOLUTION: APPROVING SPECIAL EXCEPTION #SE 2001-08 LEESBURG STATION AUTO WASH PASSED this 9t_~h day of April 2002 B.
