Brewster Town Office Building Chairman Henchy convened the Planning Board meeting at 7:OOPM in the Brewster Town Office Building with members Taylor, Pierce, Remy, Tubman were present. McMullen and Bugle were absent. Minutes of the March 14, 2007 were accepted as corrected. All voted AYE. (5-0-0) APPROVAL NOT REQUIRED -ANR #2007-09. Application/Owner: Bennett & O'Reilly/Chad Kodak, Located at 1554 Main Street, Map 24, Lot 24 John O'Reilly present Henchy -had questions about the submitted plan. The plan divided a large lot into 2, one of which has 2 dwellings on it. Because this lot would be less than 120,000 square feet wouldn't this plan create a non- conforming lot? O'Reilly -Chad Kodak had checked with Victor, Building Commissioner. Victor said it would not create a non- conforming lot. Henchy -reconfirmed that he thought it would be non-conforming and wondered if he had a letter from Victor because the planning board had not seen any communication on this issue O'Reilly - no letter on hand Henchy -recommended that we continue this hearing and get Victor's input O'Reilly -didn't think the planning board needed to approve the zoning questions in an ANR Henchy -again requested that we continue and asked the applicant if he agreed O'Reilly -sure Taylor - had a question on view easements Planning Board Minutes 04-11-07 Page 1 of 3 O'Reilly- the views are pre-existing so they do have a view Taylor -asked if they had a permit for the easements O'Reilly -yes Motion by Taylor to continue the ANR. Second-Remy VOTE 5-0-0 Bennett & O'Reilly/Craig Bordon, Located at 1567 & 1573 Main Street, Map 24 Lot 7 8~ 8 -preliminary discussion for preliminary sub-division plan John O'Reilly present. O'Reilly -asked to withdraw plans Motion by Taylor to withdraw plans. Second-Remy VOTE 5-0-0 Don Baker -Informal discussion: determination of access and address, Map 34, Lot 46-1 Don & Martha Baker present Henchy -read the memo submitted from Jillian Douglass, Assistant Town Administrator. Then he asked how did the Bakers plan to get to their land? Baker - he planned to get there on a small road from Rte 137 and Gulls Way. He stated that he has legal access to cross over the Rail Trail and has an exemption for all public and private crossing. The rail trail has even put in aprons and has installed signs that warn of the bike crossing. The fire chief has ok'd the road, stating that it has the 14 feet width and with the bike trail upgrade it has been constructed better then many of the town's roads. Don plans on maintaining the road and will keep it up to standards. Taylor -Has someone been doing clearing out on the property? Baker - he has taken down a few trees on his property for a well. Henchy -reviewed Map 64 and determined that the rail trail was 86 feet wide and the Bakers had 180 feet of frontage on the road in question. Baker - in order to get to lot, he plans on accessing from Rte 137 down Gulls Way going down the edge of the rail trail and then over to his property Taylor -can the access accommodate the building process -which includes heavy construction vehicles? Baker -yes Planning Board Minutes 04-11-07 Page 2 of 3 Baker -spoke with Fire Captain Romme and Fire Chief Jones -they would like to make sure the road has a unique name and is easy to identify. Baker recommended "Old Road" or "Old Cartway" Taylor -stipulated that the name applied only to the road that extends from the Rail Trail to Western boundary line of Baker's property (Map 34 lot 46-1) Henchy- will we call it "Old Road"? Baker -requested "Old Cartway" feeling that there should not be any conflict in town -this name doesn't seem common and shouldn't be already taken. Henchy - ok and then your next step would be go to the fire dept. and they will give you a number Motion by Taylor to recognize the road from Gulls Way to the western boundary edge of Map 34, lot 46-1 as Old Cartway. Second-Remy VOTE 5-0-0 Motion to adjourn made by Taylor, second by Remy.
