Brewster Town Office Building Chairman Henchy convened the Planning Board meeting at 7:OOPM in the Brewster Town Office Building with members Taylor, Pierce, Remy, Tubman, McMullen, Bugle were present. Minutes of the April 11, 2007 were accepted as corrected. LEGAL HEARING -Baker -Map 34, Lot 46-1; determination of access and address Present applicant Martha and Don Baker Henchy: stated that this issue had been discussed during an informal discussion at a previous Planning Board meeting. Mr. Henchy wanted to know if there were any new comments or questions. Romme - An abutter, who has property further down the dirt road, would like to build on his lot. The road by his property is labeled "Ancient Way" and is shown on an 1824 document which is available for review. The Rommes would access their property from Rte. 124. However, The Rommes felt that since the Planning Board was naming a portion of that road the chosen name should extend down to cover the entire dirt road. The road name should not stop at the end of the Baker's property but extend thru to Rte. 124. Henchy - took a drive down the road to inspect - It appears the road was designated in 1800 and subsequently it was listed as "Proprietary Way" when the Town purchased for the Police Headquarters and the Cemetery. It would make sense to name the whole road "Old Cartway". However, the Planning Board would need to advertise this separate section and have a specific Legal Hearing on Romme's request. Romme -his deed indicated that he has right through the Police Dept and then down to his property. Mr. Romme was not looking for access but would like to have the entire road named. Mr. Romme supplied a plan which indicated the dirt road in front of his property and how it extends down to the Baker's property Taylor -would like to keep a copy of the plan for the Town Henchy - Mr. Henchy felt, based on the Planning Board's review of the facts along with the fire department's recommendation that the road have accessibility from Rte. 137 then the board could Planning Board Minutes 05-09-07 Page 1 of 3 approve the name "Old Cartway" for Baker's property. Taylor -felt there may be legal issues for giving access to Romme's property when the access would cross over Town property. Henchy -found that apparently there had been an agreement made by the Town to give access to property owners via the "Ancient Way" - he felt additional research needed to be made on this point. Douglass -Assistant Town Administrator, wanted to express the opinion of the Selectman's office, to access the Romme's property over Town property it would need to be approved through the Selectman's office Romme -mentioned that Anglers Cartway and Old Owls Pond as examples of road names that cross over Town Property Henchy -Stated that the Planning Board needed to advertise and notify abutters of Romme's request Tubman -would this hold up Bakers decision if we included it now? Romme - if it would hold up the Bakers then make the decision on his request and we will file our own application Henchy - if we extended this request then it would hold up the Bakers. Henchy confirmed the name for the Bakers' application -Old Cartway. It was determined that the Bakers would access their property from Rte 137 and across the Rail Trail. The road name would be for the property from Gulls Way to the western boundary line of Map 34 lot 46-1. Motion by Bugle to approve the road from Gulls Way to the western boundary edge of Map 34, lot 46-1 as Old Cartway. Second -Remy VOTE 7-0 INFORMAL DISCUSSION -Brewster Whitecaps Baseball Club -request the use of the Town Hall field for baseball clinic for one week during the week of June 18 - 22 from 8 am -noon Present: Claire Gradone Gradone -would like to use the field for one week only June 18-22 Taylor -She is very tired of seeing the parking on both sides of the road. It is a serious safety issue and would like it addressed Gradone -said she recognized her concern and would address in a letter to the club Motion by Bugle made to approve the use of the field as outlined provided the Whitecaps Club provides staff to monitor the parking. Second -Remy VOTE: 7-0 Planning Board Minutes 05-09-07 Page 2 of 3 INFORMAL DISCUSSION -Nauset Public Schools -request to use the Eddy Elementary School for the summer programs. Present: Superintendent, Michael Gradone, Principal, Denise Fronius Gradone -Noted that there were 3 programs that would be utilizing the school: 1) children that require year round education 2) Brewster after School Program 3) Brewster Rec. Program Fronius -Mentioned that there were additional maintenance plans at Stony Brook -They will be working on the gym and cleaning out the rooms on the second floor for the Cape Cod Collaborative Henchy -would like to waive the special permit requirement - He has spoken with Charlie Summer, Town Administrator and they feel that when the Town uses the buildings it should be ok and it is time to clean up this special permit requirement. He would like to issue a short term waiver for tonight's request and schedule a modification hearing for the Fall -Nauset schools could file an application over the summer Gradone -agreed and would like to avoid coming back every year for this issue Bugle - requested a close watch of the traffic and if needed have Police intervention -Henchy, mentioned that Bugle should be recussed from this discussion -Bugle agreed Gradone - if traffic became a problem then they would add a police detail Douglass -Agreed that the Selectman recommended this waiver but thought it might become fuzzy if you don't become specific on the traffic issue. Motion by Pierce made to approve the temporary waiver. Second -Remy VOTE: 6-0 Motion to adjourn made by McMullen, second by Taylor. All vote AYE Respectfully submitted, ..
