HomeMy Public PortalAbout2002_05_14_r070The Town of Leesburg, 'lrglnla PRESENTED: May 14, 2002 RESOLUTION NO. 2002- 7 0 ADOPTED: May 14, 2002 A RESOLUTION: APPROVING SPECIAL EXCEPTION #SE 2001-09, LOT 11, CARDINAL INDUSTRIAL PARK, TO PERMIT A VEHICLE DISPLAY/EMPLOYEE PARKING LOT WHEREAS, Mr. John Dunzweiler has requested special exception approval to permit a vehicle display/employee parking lot on Lot 1 l, Cardinal Park Drive; and WHEREAS, the property is located in the B-3 (Community Retail/Commercial) District and in the H-2 (Historic Corridor Overlay) District; and WHEREAS, on March 21, 2002, the Planning Commission recommended conditional approval of this application; and WHEREAS, on April 23, 2002, the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for a vehicle and equipment service facility, as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE RESOLVED by the Town Council of Leesburg, Virginia as follows: Special Exception application #SE 2001-09, Lot 1 l, Cardinal Industrial Park, Mr. John Dunzweiler, Lot 11, Cardinal Park Drive, identified in the Loudoun County Land Records with Tax Map Identification Number 189-29-1134-00, is hereby approved subject to the following conditions: 1. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual, and that final plats, -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION #SE 2001-09, LOT 11, CARDINAL INDUSTRIAL PARK development plans, and construction drawings are subject to the applicable town regulations. 2. Prior to the issuance of a zoning permit, the applicant shall submit detailed engineering drawings prepared by a licensed engineer which address grading, drainage, storm water management, erosion control, landscaping, lighting, and buffering. These are subject to Town review and the sole approval authority of the Town. If the development of the site as detailed in these drawings requires installation of public improvements with a value exceeding $3000.00, a development plan will be required. 3. If a development plan is required, than the applicant shall be responsible for providing full road frontage improvements along the Cardinal Park Drive frontage of Lot 11. 4. The applicant shall incorporate necessary measures, including modification to the plan (which may require a reduction in paved area) to insure that the site's storm water management obligation is satisfied. 5. A fence is to be constructed and maintained along the northwest and southwest property lines. The fence shall be approved by the Board of Architectural Review. 6. A heavy gauge chain shall be anchored across the ingress and egress points (between this proposed parking lot and the existing dealership) at the close of business, and during those times when the dealership is not open for business. 7. All lighting shall be in accordance with the lighting plan dated October 24, 2001 and revised through April 13, 4002. 8. All landscaping shall be provided and maintained as shown in the landscaping plan dated October 24, 2001 and revised through April 13, 2002. 9. There shall be no inoperable vehicles stored or parked on-site. 10. All parking areas are to be constructed and maintained with an all-weather dustless surface. 11. This special exception shall be in substantial conformance with the special exception plan dated October 24, 2001 and revised through January 17, 2002 and received April 17, 2002.
