He suggested that the board approve the Decision with modifications. The applicant was under a tight deadline. McMullen: Suggested that they receive an email copy of the Decision and approve the Decision with modifications and authorize Chairman Henchy to sign on the Planning Board's behalf. Motion by McMullen to approve Decision with modifications. Second. Cabezas. Vote 5-0-0 Henchy: AYE Taylor: AYE Tubman: AYE Cabezas: AYE McMullen: AYE Preliminary Plan #2007-14 -Applicant: Stringer -Located at 436 Satucket Rd., Assessor's Map 37, Parcel 63-0-R. Proposal for a Preliminary Plan to divide property into two lots Present: Phil Scholomiti, Ryder & Wilcox; Arthur and Sylvia Stringer Scholomiti: Presented the preliminary plan and application. He noted that the lot was zoned RL and RR and requested 2 waivers. The 2 waivers are as follows: 1. Waive section 290.11 through 290.20 -request to waive all road and associated road construction including installation of water, underground utilities and drainage. 2. Request to waive 25 foot minimum property line set back requirements relative to the proposed way (Section 290.11 B) Scholomiti: The applicant is requesting the waivers because they will access Lot 1 through a private way or you may consider it a driveway. Henchy: If the driveway/private way was only going to serve one lot then they would consider. He recommended that the driveway/private way have a name. ~~ Scholomiti: the "way would be built for fire and safety access. He also presented a letter from the abutter -who had no problems with waiving the 25 foot set back. Since the Stringers were presenting this application as a Preliminary Plan it would require that any other subdividing of the lot would need to come before the Planning Board. The Stringers, who live on Lot 2, would continue to access their property through the dirt way as outlined on the plan. Henchy: Read the Dept. Reviews. And Mr. Henchy requested that any future development of Lot 1 would require a review of the Planning Board. He said the "way" should have a name and it needs to be cleared through the Fire Dept. Mr. Henchy asked it there were any comments from the Board. No comments. There was a general consensus to approve the preliminary plan as submitted.
