A RESOLUTION: PRESENTED June 11, 2002 2002-96 ADOPTED June 11, 2002 STATEMENT OF TOWN COUNCIL POLICY CONCERNING VACANCIES IN THE OFFICE OF A COUNCIL MEMBER WHEREAS, Section 2-7 of the Code of the Town of Leesburg provides Council may by Ordinance adopt such rules as it deems proper for the regulation of its proceedings; and WHEREAS, Section 2-6 of The Code of the Town of Leesburg provides vacancies in the office of a council member shall be filled for the unexpired portion of the term by a majority vote of the remaining members of the Council; and WHEREAS, in a situation in which a vacancy on Council occurs as the result of an election of a sitting council member to the office of Mayor, Town Council has historically observed the practice that the council member who received the next highest number of votes in the same election that resulted in the vacancy, would be the member of the council selected by the majority of council to fill the unexpired council term; and WHEREAS, the Town Council practice ensures to the maximum practical extent that the will of the voters of the Town of Leesburg will be observed and establishes a common practice for guidance of future council members and reviewing tribunals. THEREFORE, RESOLVED by the Council of the Town of Leesburg, Virginia as follows: SECTION I. Vacancies in the office of a council member due to a duly held councilmanic election shall be filled for the expired portion of the term by majority vote of the council which shall give great weight in selecting such member to an individual who was not elected in such duly held councilmanic election, but received the next highest number of votes in such election. -2- RESOLUTION: STATEMENT OF TOWN' COUNCIL POLICY CONCERNING VACANCIES IN THE OFFICE OF A COUNCIL MEMBER PASSED this 11t~ day of June 2002.
