HomeMy Public PortalAbout2002_06_25_r099The Town of Leesburg, lrglnla PRESENTED .hme_23._20ff2 RESOLUTION NO. 2 0 0 2- 9 9 ADOPTED 3~ae,_.ZS._Z01~ A RESOLUTION: INITIATING · AMENDMENTS TO THE !.EESBURG ZONING ORDINANCE TO PERMIT TRANSMISSION ANTENNAS AS PART OF A HIGH-SPEED INTERNET ACCESS PROVIDER HOME OCCUPATION WHEREAS, it is the intent and desire of Council to promote and enhance opportunities for Intemet access in the Town of Leesburg to serve its citizens; and WHEREAS, the Home Occupation regulations (Article 15 of the Zoning Ordinance) currently prohibit exterior alterations to the appearance of structures which change the residential character of a property; and WHEREAS, amending the Home Occupation regulations to permit small transmission facilities with limitations will allow high-speed intemet access to be provided more widely and efficiently throughout the Town of Leesburg; and WHEREAS, the public necessity, convenience, general welfare and good zoning practice require the proposed amendments. TI-IEREFORE, RESOLVED by the Council of the Town Leesburg in Virginia as follows: SECTION I. The following amendments are hereby initiated and referred to the Planning Commission for recommendation: Section 15A-q. PERMITTED I-IOMF, OCCIIPATIONS The following uses may be permitted home occupation uses, subject to the requirements of this Article. (1) Artist and sculptor... (3) Exterior Alterations. No alterations to the exterior appearance of the principal residential building, any accessory structure, or premises shall be made which changes the residential character of the property except that one tran~qrnis.qion antenna not to exceed eighteen (1 R) inches in height may he erected on the roof of the nrincinal stmctnre in the case of a hiph-sneed internet access nrovider. Free~qtanding antenna~ are not permitted. SECTION 11. The Planning Commission shall hold a public hearing to consider these amendments to the Zoning Ordinance, and report its recommendation to the Town Council pursuant to Chapter 22, Title 15.2-2204 of the 1950 Code of Virginia, as amended.
