HomeMy Public PortalAboutPlanning Board -- 2007-09-26 MinutesRoll Call Vote: Henchy: Aye Taylor: Aye McMullen Aye Tubman: Aye Cabezas Aye Pierce: Aye LEGAL HEARING -CORRIDOR OVERLAY PROTECTION DISTRICT - #COPD 2007-21 Applicant; Brown Lindquist Fenuccio &Raber Architects, Inc., Owner; Camp Wono, Inc. (Cape Cod Sea Camps), Located at 3057 Main Street, Assessor's Map 8, Parcel 8. New boathouse facility to replace existing facility and to better serve the current sailing program. Present for Applicant: Tim Sawyer of Brown, Lindquist Fenuccio &Raber Architects and Camp Wono Brown: Presented the application and stated that the applicant has revised the plan. The applicant would no longer be demolishing the existing structure. The Camp would be replacing many of the teaching equipment. They do not intend to expand the use of parking. It would continue with seasonal use. Henchy: Read the Department reviews and then asked if you could you see the building from the road? Applicant: The building is over one thousand feet away and can't be seen from the road. Henchy: Opened the floor to the public - no comments McMullen: the applicant went before the DPRC today. DPRC signed off and felt the project looked good including the lighting was minimal and the landscaping requirements were basic -just reseeding. Tubman: Requested a new plan with the additional change outlined. Applicant: Submitted 3 copies of the new plan Henchy: Opened the floor to the Planning Board. Cabezas and Pierce: were ok with the revised plan - no additional comments. Taylor: Have you been to the conservation committee? And mentioned that the old structure may be required to add sprinklers. Applicant: Yes and the Conservation Committee would like them to put in a split rail fence. McMullen: Mentioned that at the DPRC meeting the Fire Chief asked for alarms not sprinklers. Henchy: Should we add any conditions to the decision? No -just require a set of new plans and a updated narrative stating what they will be doing on the property. Motion by Taylor to draft a decision and sign at our next meeting. Second by Pierce. All vote Aye LEGAL HEARING -Special Permit Application for Pre-existing Lot of record, lacking street frontage (Dirt Road Access Bylaw) - # 2007-22 Applicant; Diane & Arthur Romme, Located off Route 124, Assessor's Map 34, Parcel 49. Proposed single family house and barn. Present for applicant: John McCormick, Attorney; Owner: Art and Diane Romme McCormick: presented plans and applications. The owners would like to build a house and a barn on their property. They intend to access their property from Rte. 124. They would have a private well and bring in electrical from Rte. 124. In addition, in order to meet town department requirements they would need to remove 3 trees along the dirt road. The owners have over 5 acres of land it is on apre-existing lot, a Planning Board Meeting Page 2 of 4 09-26-07 covenant has been executed and the Romme's agree to maintain the dirt road. Henchy: Read the Dept. Reviews and asked if members of the Board had any comments on the Police Departments concerns? In addition, Mr. Henchy stated that he had been on this road recently and felt there was access. However, he wanted to know if there would be any grading or improvements to the way? Romme: they planned to do some grading and bring the way up to the Fire Departments requirements. Henchy: any issues with bicycles traveling on the road? Romme: Currently, the bikes and cars share the way without any problems. Most of the bikers are coming from the Sweetwater Campgrounds. When the road is widened to 12 feet there really shouldn't be an issue. McCormick: The road will only be used by one house so there really shouldn't be much traffic. Henchy: Opened the floor to the Board. Taylor: Read Myer Singer's letter and felt that the Board should get their own legal opinion. Ms. Taylor wanted to make sure that the Board was doing everything it should be doing because the applicant will be crossing over Town properties. McCormick: Actually, the letter Ms. Taylor is referencing was not submitted with this application. The Singer letter referenced when the applicant was asking to go through the cemetery to access his property. The applicant has been before the Selectman and they recommended that they go to the Planning Board and determine if they have access from Rte. 124. If they had access from Rte 124 then there would be no need to cross over Town Property. Taylor: The Police Dept. asked about the apron on the road -would you take responsibility for that? Romme: yes, they would put in an apron. Henchy: Let's make this a condition of the decision. Motion to close the public hearing made by Tubman. Second by Pierce. All vote Aye. Motion to prepare a favorable draft decision to be reviewed at the next meeting made by Pierce. Second by McMullen. All vote Aye. LEGAL HEARING -Road Name Application - #2007-23; Applicant; Diane & Arthur Romme, Located off Route 124, Assessor's Map 34, Parcel 49. Proposed road name. Present for applicant: John McCormick, Attorney; Owner: Art and Diane Romme McCormick: presented application Henchy: The name of the road is currently Propriertors Road. The Romme's would like to change the name to Proprietors Cartway or continue with the name the Planning Board issued to the Bakers, "Old Cartway". Taylor: Could see a conflict if the road has two names. Chief Jones: The Town currently has many roads named with "Old" . Taylor: If we changed the road name would we create any problems for the Bakers? Would the Bakers get a new number? Planning Board Meeting Page 3 of 4 09-26-07 Chief Jones: It shouldn't be a problem. Tubman: the applicant has only 6 signatures not the 8 of all the owners on the street... where are the other 2? Romme: One property owner they couldn't find. The Doyle's house is on Rte. 124 and it isn't an issue for them. Pierce: Based on this information let's name the road Proprietors Cartway. Ms. Pierce felt this should apply to the whole way from Rte. 124 to Gulls Way. Motion by Pierce to name the road Proprietors Cartway from Rte. 124 to Gulls Way. Second by Tubman. All vote Aye. Informal Discussion: Proposed Zoning By-Law Amendments -the text of the proposed by-law amendments are available to inspect in the Planning Board's office. A discussion and a review of the meeting with the selectman occurred Other Business: Allard -Map 42, lot 14; A letter had been submitted from Steve Allard regarding the change of use on the property. The Planning board felt that the revised use would not cause a problem and was ok. Performance Bonds: 1. McShane: - Henchy will go out and inspect 2. Acropolis Enterprises: -the clerk should reference Zona Drive and see if they can find the date the treasurer was looking for. 3. Greenland Pond - a discussion occurred and several Board members remembered that a neighbor had asked to take the bond money to use it for a path to the pond. The Board needed to find out if legally the bond can be turned over. Motion by Pierce to adjorn. Second - Cabezas. All AYE.
