HomeMy Public PortalAbout2002_07_09_r131The Town of eesburg, '-,. rgtnta PRESENTED July 9, 2002 RESOLUTION NO. 2 0 0 2 - l 3 1 ADOPTED July 9, 2002 A RESOLUTION: AUTHORIZING TIME EXTENSIONS FOR COMPLETION OF THE PUBLIC IMPROVEMENTS AND APPROVING SUBSTITUTE PERFORMANCE GUARANTEES FOR COMPLETION OF THE PUBLIC IMPROVEMENTS IN POTOMAC STATION SECTIONS 2AB, 2AB-l, 2CD, 2GH, 2EF, 3AB, 4, 4 WATER AND SEWER EXTENSION, 6A, POTOMAC STATION DRIVE (PHASE 1) AND THE POTOMAC STATION COMMUNITY CENTER WHEREAS, corporate surety bonds from the Frontier Insurance Company were provided as security to guarantee installation of public improvements as shown on plans approved by the Director of Engineering and Public Works for Potomac Station Sections 2AB, 2AB-l, 2CD, 2GH, 2EF, 3AB, 4, 4 Water and Sewer Extension Plan, Potomac Station Drive (Phase 1) and the Potomac Station Community Center and were approved by the following resolutions and dates: Section 2AB - Resolution #96-59 adopted on March 26, 1996 Section 2AB-1 - Resolution #97-106 adopted on May 13, 1997 Section 2CD - Resolution #97-48 adopted on February 25, 1997 Section 2GH - Resolution #98-79 adopted on March 24, 1998 Section 2EF - Resolution #97-264 adopted on November 12, 1997 Section 3AB - Resolution g97-263 adopted on November 12, 1997. Section 4 - Resolution #97-93 adopted on April 22, 1997 Section 4 W&S Ext. Plan - Resolution #97-270 adopted on November 25, 1997 Section 6A - Resolution g97-253 adopted on October 28, 1997 Community Center - Resolution #97-94 adopted on April 22, 1997 Potomac Station Drive (Phase 1) - Resolution #99-59 adopted on April 10, 1999 and; WHEREAS, these sections of Potomac Station are located in'Loudoun County and the town's bonded improvements are water and sanitary sewer only; and WHEREAS, according to the State Corporation Commission Bureau of Insurance listing dated April 17, 2001, the Frontier Insurance Company had their Virginia license suspended or impaired; and WHEREAS, Goose Creek Communities, L.L.C., the developer of Potomac Station Sections 2AB, 2AB-l, 2CD, 2GH, 2EF, 3AB, 4, 4 Water and Sewer Ex. tension Plan, Potomac Station Drive (Phase 1) and the Potomac Station Community Center, has requested that the Town Council accept corporate surety A RESOLUTION: -2- AUTHORIZING TIME EXTENSIONS FOR COMPLETION OF THE PUBLIC IMPROVEMENTS AND APPROVING SUBSTITUTE PERFORMANCE GUARANTEES FOR COMPLETION OF THE PUBLIC IMPROVEMENTS IN POTOMAC STATION SECTIONS 2AB, 2AB-l, 2CD, 2GH, 2EF, 3AB, 4, 4 WATER AND SEWER EXTENSION, 6A, POTOMAC STATION DRIVE (PHASE 1) AND THE POTOMAC STATION COMMUNITY CENTER bonds from the Gulf Insurance Company as a replacement for the corporate surety bonds from the Frontier Insurance Company and is requesting approval of the same; and WHEREAS, the developer has not completed all the required public improvements in accordance with the approved construction drawings and town standards within the two-year period agreed to in the contracts for public improvements and previously approved time extensions; and WHEREAS, the public improvements for these projects are substantially complete and the developer has requested a time extension to June 30, 2003 to complete the inspection and acceptance process; and WHEREAS, the Director of Engineering and Public Works recommends approval of the substitute performance guarantees and time extension to June 30, 2003 for Potomac Station Sections 2AB, 2AB-l, 2CD, 2GH, 2EF, 3AB, 4, 4 Water and Sewer Extension Plan, Potomac Station Drive (Phase 1) and the Potomac Station Community Center. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The substitme corporate surety bonds from the' Gulf Insurance Company in the amount of $20,550.20 for Section 2AB; $16,137.84 for Section 2AB-l; $29,856.64 for Section 2CD; $11,791.12 for Section 2GH; $9,516.79 for Section 2EF; $21,860.19 for Section 3AB; $42,118.40 for Section 4; $1,616.12 for Section 4 water & Sewer Extension Plan; $12,377.09 for Section 6A; $62,335.40 Potomac Station Drive (Phase 1); and $130,038.00 for the Community Center in a form approved by the town attorney are approved. SECTION II. The corporate suretY bonds from the Frontier Insurance Company in the amount of $20,550.20 for Section 2AB; $16,137.84 for Section 2AB- 1; $29,856.64 for Section 2CD; $11,791.12 for A RESOLUTION: -3- AUTHORIZING TIME EXTENSIONS FOR COMPLETION OF THE PUBLIC IMPROVEMENTS AND APPROVING SUBSTITUTE PERFORMANCE GUARANTEES FOR COMPLETION OF THE PUBLIC IMPROVEMENTS IN POTOMAC STATION SECTIONS 2AB, 2AB-l, 2CD, 2GH, 2EF, 3AB, 4, 4 WATER AND SEWER EXTENSION, 6A, POTOMAC STATION DRIVE (PHASE 1) AND THE POTOMAC STATION COMMUNITY CENTER Section 2GH; $9,516.79 for Section 2EF; $21,860.19 for Section 3AB; $42,118.40 for Section 4; $1,616.12 for Section 4 Water & Sewer Extension Plan; $12,377.09 for Section 6A; $62,335.40 Potomac Station Drive (Phase 1); and $130,038.00 for the Community Center are released contingent upon approval by the town attorney of the substitute corporate surety bonds from the Gulf Insurance Company. SECTION III. A time extension to June 30, 2003 for Potomac Station Sections 2AB, 2AB-l, 2CD, 2GH, 2EF, 3AB, 4, 4 Water and Sewer Extension Plan, Potomac Station Drive (Phase 1) and the Potomac Station Community Center for installation of pUblic improvements is hereby approved.
