HomeMy Public PortalAbout2002_07_23_r140The Town of Leesburg, rg ma PRESENTED J~ RESOLUTION NO. 2 0 0 2 - 'l 4 0 ADOPTED Inly_23C2~3~ A RESOLUTION: OVERTURNING THE ZONING ADMINISTRATOR'S INTERPRETATION OF THE COMPOSITION OF THE NEIGHBORHOOD RETAIL CONVENIENCE CENTER FOR #ZM-90 GREENWAY FARM PLANNED RESIDENTIAL NEIGHBORHOOD WHEREAS, on January 8, 1991, Council approved rezoning #ZM-90 to establish the Greenway Farm Planned Residential Neighborhood with proffers and a concept plan; and WHEREAS, on April 1, 2002 Ms. Patty Brown of Dulles Commercial Real Estate requested a proffer interpretation regarding the makeup of the Greenway Farm Neighborhood Retail Convenience Center; and WHEREAS, on May 8, 2002, the Zoning Administrator issued a proffer interpretation that held that (1) an 8,000 square foot freestanding office building does not comply with the approved proffers and Preliminary Development Plan for Greenway Farm, and (2) Professional offices alone do not constitute a Neighborhood Retail Convenience Center under the proffers; and WHEREAS, on May 24, 2002, Mr. Robert Sevila filed an appeal on behalf of Douglas Herbert, D.D.S. and Behzad Parva, M.D. (appellants) to the Leesburg Town Council as authorized by Section 15.2- 2301 of the 1950 Code of Virginia, as amended; and WHEREAS, on July 8 and 22, 2002 Council heard the appeal; and WHEREAS, Council has determined that (1) an 8,000 square foot freestanding office building does comply with the approved proffers and Preliminary Development Plan for Greenway Farm, and (2) Professional offices alone can constitute the first phase of the Greenway Farm Neighborhood Retail Convenience Center under the proffers; and WHEREAS, appellant has agreed that the medical office building within the Greenway Farm Neighborhood Retail Convenience Center shall be submitted to the Leesburg Board of Architectural Review -2- RESOLUTION: OVERTURNING THE ZONING ADMINISTRATOR'S INTERPRETATION OF NEIGHBORHOOD RETAIL CONVENIENCE CENTER FOR #ZM-90 for approval. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The Town Council hereby overturns the zoning administrator's interpretation of the Neighborhood Retail Convenience Center under #ZM-90 and clarifies that the approved proffers and Preliminary Development Plan for Greenway Farm to permit (1) a 10,000 square foot freestanding office building, (2) professional offices alone can constitute the first phase of the Crreenway Farm Neighborhood Retail Convenience Center, (3) the exterior of the medical office building within the Greenway Farm Neighborhood Retail Convenience Center shall be submitted to the Leesburg Board of Architectural Review for approval, and (4) any changes to the remainder of the Neighborhood Retail Convenience Center must be submitted to and approved by the Town Council.
