BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF McCALL, IDAHO: Section 1. That Chapter 3 of Title VI of the Village Code of McCall, 11,.:1aho, be and tLe fnme is hereby rcpealed. Section2. PURPOSE: The purpo!:4e of this Ordinance is to provide certain minimum standards nnd requirements to safe- guard life or limb, health, pieperty and public welfzire by regulating and controlling the c:csign, construction, erection, alteration, moving, demolition, quality of materials, use occupancy and maintenance of all buildings and structures in thecoCpnty, except as specifically exempted by this Ordinance. /77 Section 3. That Section 301 (c) is hereby deleted and the following is rubstituted in place there- of: "Section 301 (c) Plans and Specifications. With each application for a building permit and when required for en- forcement of any provisions of this Code, two sets of plans and specifications shall be suhmitted. The Building Official may require plans and specifications to be prepared and de- siTied by an engineer or architect licensed to practice in the State of Idaho. Exception: When authorized by the Building Inspector plans for Group I occupancy of Type V construction not exceeding to stories in height above grade, Croup J--1 occupancy and fences in Group J-2 occupancy need not be prepared by a licensed engineer or architect. (C) Snow Loads. That Section 2305 (c) of said Uniform Building Code be amended Ly adding the following: "The minimum nominal design snow load for !cCal1 1-n911 be designated as 100 pounds per :.quare foot and the Building Inspector may require structures to be designed for heavier loadings in certain locations of the City - known to ex- perience heavier snow falls." Section 9, PRO\IIDING FOR CERTIFIED COPIES: Not less than three copies of each of the codes enumerated in S,_,ction 5 here- of duly certified by the City Clerk , are on file for use and examination by the public in the office of the City Clerk of McCall, Idaho. Section 10. APPROACHESTOCITY STREETS AND STATE HIGHWAYS: That the Building Inspector shall require the installation of a driveway approach to the City Streets or State Highway that provides continuity of drainage along the right-of-way as re- quired by the City Superintendent. Section 12. PERMITS FROM OTHER AGENCIES: That prior to the issuance of a building permit the Building Inspectorshall require evidence of approval by other governmental agencies to install (a) electric service, (b) water system, (c) sewer system, (d) plumbing system, (e) mechanical heating vs tem and (f) approach to State Flighwav, if applicable. Section 13. (2) Appeals of Board decisions shall be in such form and manner as provided by the Idaho rules of civil procedure. Sc tion 25. INJUNCTION -AFFIDAVIT SETTING OUT NONCONFORMITY: The City may obtain from a district court having jurisdiction, a temporary injunction enjoining the construction of a building or installation of manufactured buildings on nny luilding site upon affidavit of the dcpartmont Olat such building does not con- form to the requirements of this act or to the rules and re- gulations adopted pursuant to this act or any other act of the State of Idaho relating to building construction. The affidavit must set forth such violations .in detail. The injunction may be made permanent, :in the discretion of the court. Section 26, VIOLATIONS MISDEMEANORS: (I) Any person who wiltully violates any provision of this ordinance or who wilfully violates any provision of the codes enumerated herein, is guilty of a midemeanor, and upon conviction, shall be fined not more than Lhrce hundred doilars (Y300.00), or jmprisoned for not more than ninety (90) d6ys or by both such fine and intprisonment. (2) A separate violation is d(H-Filed to have occurred with respect to each building not in compli,mce with this act. Each day such violation continuos constitutes a ,t-parate offense. Section 28. SEVERAIVI_LITY: if ,-Hly portion of this ordinance, or the application of such provision to any rorsen or circum- stance, shall be held invalid, the 1-,11)-ndcr of Chis ordnance, or the application of such provision to porons or circumstances other than those to which it is held invalid, H)all not be affected thereby. Section 29. CONFLICTING ORDINANCES: Any ordinance, or parts thereof, in .conflict herewith shall he and the same are hereby repealed.
