RESOLUTION NO. 2002-179 ADOPTED November 13, 2002
AUTHORIZING TIME EXTENSIONS FOR COMPLETION OF PUBLIC
IMPROVEMENTS AND APPROVING PERFORMANCE GUARANTEES
FOR DRY Mil J. TOWNHOUSE SUBDIVISION PHASES 2A AND 2B
WHEREAS, K.L. Olde Towne, L.L.C., the developer of Dry Mill Townhouse Subdivision
Phases 2A and 2B has not completed all the required public improvements in accordance with the
approved construction drawings and town standards within the two-year period agreed to in the
contract for public improvements; and
WHEREAS, the developer has requested a time extension to complete the public
improvements; and
WHEREAS, corporate surety bonds in the amount of $40,775.00 for Phase 2A; and
$64,737.75 for Phase 2B, from the Lumbermens Mutual Casualty Company were provided by the
developer to guarantee the installation of public improvements; and
WHEREAS, the town's Director of Engineering and Public Works recommends a time
extension to June 19, 2003 for completion of the PUblic improvements in Dry Mill Townhouse
Subdivision Phases 2A and 2B; and
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. The corporate surety bonds from the Lumbermens Mutual Casualty Company
in the amounts $40,775.00 and $64,737.75 are approved to guarantee the installation of public
improvements in Dry Mill Townhouse Subdivision Phases 2A and 2B.
SECTION II. A time extension to June 19, 2003 for Dry Mill Townhouse Subdivision Phases
2A and 2B for completion of the public improvements is approved.
