A RESOLUTION: PRESENTED: November 26, 2002 2002-18 6 ADOPTED: November 26, 2002 APPROVING SPECIAL EXCEPTION #SE2002-03, FIRST CITIZENS BANK, TO PERMIT A BANK WITH DRIVE-THRU WINDOWS WHEREAS, District; and WHEREAS, WHEREAS, First Citizens Bank of North Carolina, has requested special exception approval to permit a bank with drive-thru windows at Catoctin Circle, NE; and the property is located in the B-2 (Established Corridor Commercial) October 3, 2002 the Planning Commission recommended conditional approval of this application; and WHEREAS, on November 13, 2000 the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for a bank with drive-thru windows, as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE RESOLVED by the Town Council of Leesburg, Virginia as follows: Special Exception application #SE 2002-03, First Citizens Bank, located on Catoctin Circle, NE identified in the Loudoun County Land Records at Tax Map 48 Parcel 120, (MCPI 231-20-8764) and Tax Map 48 Parcel 12lA (MCPI 231-20-7445) is hereby approved subject to the following conditions: Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION #SE2002-03, FIRST CITIZENS BANK, TO PERMIT A BANK WITH DRIVE-THRU WINDOWS Standards Manual, and that final plats, development plans, and construction drawings are subject to the applicable town regulations. 2. The applicant will be in substantial conformance with the special exception plat for First Citizens Bank prepared by Bowers & Associates, Ltd. dated May, 2002 as revised through October 31, 2002. 3. The stonewall adjacent to Waterford Holdings property will be removed. 4. The applicant shall provide a sidewalk approximately four foot wide along its entrance to the bank from East Market Street provided it is determined at Development Plan review that the resulting vehicle travel way meets Town requirements for an entrance from East Market Street. Both the travel way and the sidewalk shall fit within the existing 32-foot wide easement shown 'on the special exception plat dated May 2002. 5. The special exceptiOn plat will indicate the onsite traffic circulation pattern. 6. The applicant will provide lighting along the pedestrian access from East Market Street and around the ATM drive-thru window. 7. The applicant will place the trash dumpster near the East Market Street entrance and away from the residentially zoned areas. 8. The applicant will screen along the residentially zoned properties to the S3 criteria, completely evergreen with an emphasis on Holly trees and in consultation with the Town arborist. 9. The applicant will save the existing pine trees located behind the existing barn building. 10. Once the existing barn building has been removed, the site of that structure and the non-grassed area around that site will be planted with grass and landscaped in accordance with the Town of Leesburg regulations.
