Discussion of Subdivision Regulations b. Discussion of Procedures for Rezoning PLANNING BOARD Minutes October -7, 1982 Frank Sheffield presided. Members present were Brody, Cannity, Goodwin, Holman, Martin, Plambeck, and Page. The meeting was called to order at 7:30 P.M. Frank Sheffield asked for comments or suggestions on a policy regarding rezoning requests and the procedure for consideration of those requests. Sheffield suggested that rezoning requests should be made at least one week prior to the Planning Board's next meeting so that the Zoning Officer could mail out information on the request along with the agenda. He felt that the Planning Board needed the time to consider the request prior to the meeting. He noted that the rezoning request from Willie Laws had not come in early enough to be considered in such a manner. Rick Cannity pointed out that the County Board of Commissioners meets to consider rezonings only four times a year in a regular joint public hearing with the County Planning Board. In this case, Cannity suggested asking the Town Board to set a public hearing for the Laws rezoning since a written policy had not been approved. Myron Martin and Nancy Goodwin noted that changes had been made, but a retyped copy had not been presented. The changes had been made in early 1982. Cannity suggested that when the Planning Board agreed on a written policy, perhaps the Town Board should be asked to approve that policy on rezoning procedure also. Mr. Laws was then invited to discuss the rezoning request. He stated that no one had notified him in 1979 when his land at the intersection of Highway 70 and St. Mary's Road was put under the Town's jurisdiction and zoned by the Town's Zoning Ordinance. The Gulf Station on the Laws' property has been in operation over 30 years. Laws obtained a zoning permit for a 40 by 80 foot building to be used for commercial purposes in the Spring of 1980 from the Town's Zoning Officer. Laws felt that he should have been notified about the zoning. He also pointed out the commercial uses located across the highway from his businesses. He stated that he just found out that he is in a non- conforming use. He said that he would like to request that his request be sent to the Town Board and that the Planning Board ask the Town Board to set a public hearing to consider the rezoning request. Discussion of the zoning, rezoning request, and referral to the Town Board was held by the Planning Board. Concern was expressed regarding access and the lack of barriers to limit entrance and exit to and from Laws'. land under review. Barbara Page made a motion to refer the rezoning request to the Town Board and ask for a public hearing on the request. Myron Martin seconded the motion. The motion passed unanimously. Under old business the mobile homes on Nash and King Streets were considered. The thirty days had expired for the notice sent out by the Zoning Officer. The next step is for the Zoning Officer to refer the matter to the Town Attorney who is to refer it to the Town Board. Mobile home parks in existence in December, 1979 and still in existence in December,- 1982 ecember,1982 are to come into compliance with the Zoning Ordinance. Letters had not been sent out by the previous Zoning Officer. The current Zoning Officer was instructed to publish notification in the News of Orange and notify mobile home owners to regarding Section 9 of the Zoning Ordinance. Minutes of the Sept. 16, Aug. 19, and June 3 meetings were amended on motion by Hilda Brody and -seconded by Barbara Page. Committee reports were made. The meeting was then adjourned
