APPROVING SPECIAL EXCEPTION #SE 2002-02, 101 DAVIS
AVENUE, GOD'S CHILDREN LEARNING CENTER, TO PERMIT A
CHILD DAY CARE CENTER
WHEREAS, Ms. Patricia Bennett has requested special exception approval to permit a
child day care center at 101 Davis Avenue, S.W.; and
WHEREAS, the property is located in the B-2 (Established Corridor Commercial)
District and H-2 (Historic Corridor Overlay) District; and
WHEREAS, on October 3, 2002, the Planning Commission recommended conditional
approval of this application; and
WHEREAS, on November 13, 2002, the Town Council held a public hearing; and
WHEREAS, the proposed use meets the special exception standards for a child day care
center, as set forth in the Zoning Ordinance; and
WHEREAS, staff recommends approval, with the conditions set forth below.
THEREFORE RESOLVED by the Town Council of Leesburg, Virginia as follows:
Special Exception application #SE 2002-02, 101 Davis Avenue, God's Children Learning
Center, Ms. Patricia Bennett, at 101 Davis Avenue, S.W., identified in the Loudoun County Land
Records with Tax Map Identification Number 232-35-9476, is hereby approved subject to the
following conditions:
1. Approval of the special exception does not express or imply any waiver or modification
of the requirements set forth in the Subdivision and Land Development Regulations, the
Zoning Ordinance, or the Design and Construction Standards Manual, and that final plats,
development plans, and construction drawings are subject to the applicable town
regulations.

2. The applicant shall provide a 30-foot wide commercial entrance and full frontage
improvements along Davis Avenue and Valley View Avenue. Curb and gutter must be
continued in the entrance to the point where the entrance crosses the property line.
3. The hours of operation when childcare will be provided on-site shall be restricted to 6:00
a.m. - 6:30 p.m., Monday through Friday, and shall be closed on all recognized Federal
Holidays.
4. All landscaping shall be provided and maintained as shown on the landscaping plan dated
May 24, 2002 and revised through September 25, 2002.
5. No more than 49 children shall be enrolled at the facility. All children will be between
2.5 and 5 years of age.
6. No more than ten children shall be outside in the play area at a time.
7. The applicant shall provide a sign on this property stating "Left Turn Only" as motorists
exit onto Valley View Avenue, S.W.
8. The applicant shall provide "low voltage" lighting in the parking lot and along the
walkways leading to the building.
9. The applicant and the proposed childcare center shall meet and remain in compliance
with all state licensing requirements.
10. The applicant must demonstrate adequate onsite drainage and road drainage for the
proposed frontage improvements (in accordance with the DCSM) prior to development
plan approval.
11. The applicant must demonstrate an adequate offsite drainage outfall or provide storm
water management (in accordance with the DCSM) prior to development plan approval.
12. This special exception shall be in substantial conformance with the special exception plan
dated December 28, 2001 and revised through September 25, 2002.
