AGREEING TO REIMBURSE THE VIRGINIA DEPARTMENT OF
TRANSPORTATION UP TO $20,000 FOR FEDERAL FUNDS TO
INSTALL BUS SHELTERS, SHOULD THE TOWN SUSPEND OR
CANCEL THE PROJECT, AND APPROPRIATING $25,000 IN
GENERAL FUND MONIES FOR THE PROJECT
WHEREAS, in 2001, the Loudoun County Board of Supervisors voted to transfer the
management of up to $20,000 in Federal Congestion, Mitigation and Air Quality grant funds to
the town for bus shelter installation; and
WHEREAS, the Virginia Department of Transportation requires a resolution from the
town which states that if the town elects to cancel this project, the town agrees to reimburse
VDOT for any CMAQ grant funds that are expended; and
WHEREAS, Loudoun County will provide up to $5,000 in local matching funds for this
project; and
WHEREAS, the Virginia Regional Transportation Association will purchase, install and
maintain the bus shelters and will provide the reimbursement funds if the project is cancelled;
and
WHEREAS, the town staff, in consultation with the county and the town's Standing
Residential Traffic Committee, has identified three shelter sites on the VRTA transit routes; and
WHEREAS, the staff recommends the Council agree to VDOT' s programming
requirement.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:

THE PROJECT, AND APPROPRIATING $25,000 IN GENERAL FUND
MONIES FOR THE PROJECT
SECTION I. If the Town Council elects to stop or cancel this project, the town hereby
agrees to reimburSe VDOT for the total amount of the costs for preliminary engineering, right-
of-way, and construction expended by VDOT through the date VDOT is notified of such
suspension or cancellation.
SECTION II. The town manager is authorized to execute a contract with VDOT, in a
form acceptable to the town attorney, after VDOT approves the project,
SECTION III. The town manager is authorized to execute an agreement with VRTA for
bus shelter purchase, installation, maintenance as well as reimbursement of VDOT, if the project
is suspended or cancelled.
SECTION IV. Funds for the project are hereby authorized and appropriated from the
General Fund to the town manager's contractual services account, to be reimbursed from federal
CMAQ and county funds.
