RESOLUTION NO. 2003-25 ADOPTED February 11, 2003
A RESOLUTION: APPROVING CHANGE ORDER NO. 11 TO THE CONEWAGO
ENTERPRISES, INC. CONTRACT IN THE AMOUNT OF $263,785.50 FOR
THE KENNETH B. ROLLINS WATER FILTRATION PLANT PROJECT
WHEREAS, Conewago Enterprises Incorporated (CED, has fulfilled all contractual obligations
under the April 15, 1999 contract for expansion of the Kenneth B. Rollins Water Filtration Plant project;
and
WHEREAS, a final contract close-out change order has been negotiated providing $270,000.00 in
liquidated damages paid to the town by CEI, a 151 day extension to the contract completion date for project
delays, and a $263,785.50 increase in contract cost for additional work items; and
WHEREAS, execution of this Change Order No. 11 signifies full acceptance and satisfaction of all
cost and time issues related to the work performed under this contract, and a waiver of further claims by
either party for changes to cost or time related to the work; and
WHEREAS, the FY 2003 Utility Fund Budget provides sufficient funding for this Change Order
No. 11; and
WHEREAS, the Director of Utilities recommends approval of this Change Order No. 11.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
That the Town Manager is hereby authorized to execute Change Order No. 11 to the April 15, 1999
Conewago Enterprises, Inc. contract in the amount of $263,785.50 in a form approved by the Town
Attorney.
