RESOLUTION NO. 2003-26 ADOPTED Fehnmry 1 i: 2003
A RESOLUTION: APPROVING CHANGE ORDER NO. 3 TO THE CONEWAGO ENTERPRISES,
INC. CONTRACT FOR THE HOSPITAL TANK PUMPING STATION
PROJECT
WHEREAS, Conewago Enterprises Incorporated (CEI), has fulfilled all contractual obligations
under the February 24, 2000 contract for construction of the Hospital Tank Pumping Station Project; and
WHEREAS, a final contract close-out change order has been negotiated providing $21,000.00 in
liquidated damages paid to the town by CEI, a 20 day extension to the contract completion date for project
delays, and a waiver of liquidated damages in regard to completion for final payment in the amount of
$96,000.00; and
WHEREAS, execution of this Change Order No. 3 signifies full acceptance and satisfaction of all
cost and time issues related to the work performed under this contract, and a waiver of further claims by
either party for changes to cost or time related to the work; and
WHEREAS, Change Order No. 3 has no financial impact on the project budget; and
WHEREAS, the Director of Utilities recommends approval of this Change Order No. 3.
THEREFORE, RESOLVED bY the Council of the Town of Leesburg in Virginia as follows:
That the Town Manager is hereby authorized to execute Change Order No. 3 to the February 24,
2000 Conewago Enterprises, Inc. contract in a form approved by the Town Attorney.
