Mayor Harker called the regular meeting of the City Council to 2. order at 7:30 P. M. Councilman Nunamaker gave the invocation 3. followed by Mayor Harker leading the audience in the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker ABSENT: Councilmen -None ALSO PRESENT: City Treasurer Buchan, City Attorney Martin and City Manager Koski. 5. APPROVAL OF MINUTES: a. Regular meeting of March 15, 1966. Councilman Merritt moved to approve the minutes of the regular meeting of March 15, as mailed, Councilman Dickason seconded, and the motion was unanimously carried. b. Special meeting of March 29, 1966. Councilman Dickason moved to approve the minutes of the Special meeting of March 29, 1966, Councilman Nunamaker seconded, and the motion was carried unanimously. Councilmen Tyrell and Merritt both stated for the record that though unable to attend the Special Meeting that they both acquiesced to the holding of the meeting. UNFINISHED BUSINESS: 7 :30 P. M. OPENING OF BIDS FOR BONDS, VEHICLE PARKING DISTRICT NO. 3. Mayor Harker stated this was the time and place fixed for the opening of bids for $60,401.73 of bonds to be issued to represen unpaid assessments levied upon lands within Vehicle Parking District No. 3, and the following bids were opened and read by the City 'i reasurer and City Manager: Name of Bidder Interest Rate Premium if tie Charles L. Taylor & Co. 5.12% 6.00% 5.45% 5.30% $121.00 139.00 Stone & Youngberg 5.20% Each bid was accompanied by a good faith check in an amount not less than 3% of the principal amount of the bonds to be issued,. All bids were then referred to a committee consisting of City Treasurer Buchan, City Attorney Martin and City Manager Koski, for checking and computation, a report thereon to be given to the Council later in this meeting. Mayor Harker stated while awaiting the report from the Comrnitte, . that the Council would hear from anyone in the audience who wished to speak'; Richard Manners, 6253 Temple City Blvd., stated first he wish-e: to clear up a rumor regarding the Ackworth school property whit.:. was that they intended to sell the property to developers for residential development. He stated they wished to go on recorc' to state this was not true and they did not intend to sell for this purpose at any time: Secondly he stated they were not ad- vised of the cancellation of the meeting of April 4 and he had 880 Council Minutes, April 5. 1965, page 2 advised many members and other i:'eet i rigs that this was going to be discussed at the April .4 meeting. Councilman Dickason ad- vised Mr. Manners that when the Council does not have anything to discuss at a work session they don't have one, and recom- mended when they wished facts to call the City Hall. Mayor Harker stated these sessions set up the night before a Council meeting are only held when they felt there was something neces sary for them to review and discuss. No decisions are made at these sessions. These were held quite consistently for sever:: months due to the heavy work load at that time. We do not announce a study session as a regular council meeting, and it is the responsibility of the people who wish to attend to find out if there is one. These are open meetings but no decisions are reached. At this time the Committee reviewing the bids for the bonds returned and City Treasurer Buchan reported the bid of Charles L. Swanton with interest at 5.12% was the lowest bid received and his deposit is sufficient to cover the requirement, and he recommended the Council accept this bid. Following discussion and consideration of the various bids and the report thereon, it was moved by Councilman lyrell to accept this bid, and that Resolution No. 66- 591,RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, AWARDING BONDS TO BE ISSUED TO REPRESENT UNPAID ASSESSMENTS ON LANDS IN VEHICLE PARKING DISTRICT NO. 3 OF SAID CITY, be adopted, Councilman Nunamaker seconded, and Resolution No. 66 -591 was adopted by the follow- ing roll call vote: AYES: Councilmen- Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None 6. ORDINANCE NO. 66 -189: 2nd read. Re building code amendment increasing grading fees. City Attorney Martin read title to Ordinance No. 66 -189, AN ORDINANCE AMENDING ORDINANCE NO. 62 -65 OF THE CITY OF TEMPLE CITY RELATING TO FEES FOR GRADING PERMITS. Councilman Nunamaker moved to adopt Ordinance No, 66 -139, Councilman Tyrell seconded, and the motion was unani- mously carried. 7. ORDINANCE NO. 66 -190: 2nd read. Re amending zoning ordinance pertaining to side and rear yard set backs. City Attorney Martin read title to Ordinance No. 66 -190, AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 406, 409, 506, 509, 607, 610, 707, and 710 OF ARTICLE IX OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO YARD 'EQUIREMENTS. Councilman Dickason moved to waive further reading of Ordi- nance No. 66 -190, Councilman Merritt seconded, and the motion carried unanimously. Councilman Dickason moved to adopt Ordinance No. 66 -190, Councilman Merritt seconded, and the motion was unanimously carried. 8. ORDINANCE NO. 66 -191: 2nd read. Re amending Ordinance No 63 -107 with reference to Manor Land Subdivisions, City Attorney Martin read title to Ordinance No. 66 -195, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE C i T's AMENDING ORDINANCE NO. 63 -107 :rep I TH REFERENCE TO MINOR LAND SUBDIVISIONS. Councilman Merritt moved to waive further reading of Ordinance No. 66 -191, Councilman Dickason seconded, and the motion carried unanimously. Councilman Merritt moved to adopt Ordinance No. 66 -191, Councilman Dickason seconded, and the motion was unanimously carried. 9. ORDINANCE NO. 65 -192: 2nd read. Approving Annexation No. 10. The City Manager presented the report of the City Clerk on thk- canvass of the votes showing as follows: 881 Council Minutes, April 5, 1966, page 3 Precinct No. 1 total number of ballots voted: 196 Precinct No -„.,2 total number of ballots voted: 179 Number of Absentee ballots voted: 2 Total Ballots Voted 377 Yes Votes: 224 No Votes: 153 Total Votes 377 City Attorney Martin read title to Ordinance No. 66 -192, AN ORDINANCE OF THE CITY OF TEMPLE CITY APPROVING THE ANNEXATION TO THE CITY OF TEMPLE CITY OF CERTAIN INHABITED TERRITORY DESIGNATED AS "ANNEXATION NO. 10 ". Councilman Merritt moved to waive further reading of Ordinance No. 66 -192, Councilman Dickason seconded, and the motion carried unanimously. Coun- cilman Merritt moved to adopt Ordinance Not 66 -192, Council- man Dickason seconded, and the motion carried unanimously. City Attorney Martin presented Ordinance No. 66 -193 as an urgency ordinance and read title, AN ORDINANCE OF THE CITY OF TEMPLE CITY ADOPTING AN INTERIM ZONING ORDINANCE PURSUANT TO SECTION 65858 OF THE GOVERNMENT CODE TEMPORARILY RECLASSIFY - ING CERTAIN PROPERTIES HERETOFORE AN EXED. He stated this was a blanket R -1 for the time being (int1.the Planning Commission could make a study of the area.. Councilman Tyrell moved to waive further reading of Ordinance No. 6.6 -153, Councilman Merritt seconded, and the Motion car red unanimously. Council man Tyrell moved to adopt Ordinance 0.166 -193, Councilman Merritt seconded, and the motion was carried by the following roll call. vote: AYES: Councilmen- Dickason, Merrktti Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None Councilman Tyrell moved to refer this tp the Planning Commis- sion fob- study, Councilman Merritt seconded, and the motion carried unanimously. NEW BUSINESS: 10. ACCEPTANCE OF,STREET IMPROVEMENTS ANP CANCELLATION OF SURETY BOND: Tract #29678, St. James Dr. north of Garibaldi Ave. City Mdnager Koski presented a letter from the Road Dept. recommending the Council accept the streets in the above tract and authorize cancellation of the faithful performance bond #33S62522 in the amount of $7500. Councilman Dickason moved to accept the improvements and authorize cancellation of the bond #33S62522 in the amount of $7500, Councilman Merritt seconded, and the motion carried unanimously. 11. SET PUBLIC HEARING: CURB & GUTTER IMPROVEMENT PROJECT CHAP. 27, Streets & Highways Code, Broadway south side from Cloverly to Encinita. The City Manager presented the above request.. Councilman Tyrell moved to set the public hearing for 7:30 P.M on April 19, 1966, Councilman Merritt seconded, and the mottos was carried unanimously. 12. TREE PLANTING PROGRAM: a. Temple City Blvd.- Workman to Loner Azusa; b. Camellia Ave. - Garibaldi to Live Oak; c. Rowland - Las Tunas Dr. to Live Oak; d. Miscellaneous tree planting covering replacements. City Manager Koski advised in the Tree Planting program there were 261 trees to be planted. He requested approval of some 38 trees on various streets, stating this had been discussed at great length with the roadside tree department about the desirability of uniform planting. The purpose is to replace and put in, for the first time, trees along major streets. There are many existing trees of various species and age whic`-, do not lend themselves to the aesthetic beauty we are seeking,. 882 Council Minutes, April 5, 1966, page Following discussion by the Council about tree removal and placement of sidewalks which would also involve tree removal, the Council agreed to delete Temple City Blvd. from this actior, at this time as proposed, and to set some policy regarding sidewalks, which is to be determined at a work session. The Council also felt the larger trees should not be removed until the new planting had reached 15 -gal. size whenever possible. Councilman Tyrell moved to approve the proposed tree planting program under items b, c, and d, as amended, and to approve thr transfer of $500.00 from the tree maintenance account, and when old tree, if healthy, is not consistent with the program, put a new one near by with removal of the old tree at a later date, Councilman Nunamaker seconded, and the motion carried by the following roll call vote: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None Councilman Tyrell recommended that the program proposed for Temple City Blvd. and the sidewalk program be scheduled for the first Monday after the new Council is seated, which would be May 2. 13. STREET IMPROVEMENT PROJECT: OLIVE ST. SOUTH SIDE AT ROSEMEAD, CURB & GUTTER. City Manager Koski advised the Council this Installation was approved for construction at the expense of the City on April 12, 1965. The request was made by the property owners on the north side of the street. The 580 ft. being considered in- volves three property owners, and 186 Gas Tax Funds could be used. Considerable discussion followed regarding the narrow strip between the Flood Control and the street which is priva- tely owned but unusable For development. Councilman Tyrell moved to hold this over until the next Council meeting, Coun- cilman Nunamaker seconded, and the motion carried unanimously. 14. RESOLUTION NO. 66 -592: Appointing Public '.!orks Director. City Manager Koski presented Resolution No. 6c• -592, A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING ALBERT L. PIZZORNO AS PUBLIC WORKS DIRECTOR. Councilman Merritt moved to adopt Resolution No. 66 -592, Councilman Nunamaker seconded, and the motion carried unanimously. 15. RESOLUTION NO. 66 -593: Appointing a Deputy City Clerk. City Manager Koski presented Resolution No. 65 -593, A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING DOROTHY WIRTH AS DEPUTY CITY CLERK. Councilman Nunamaker moved to adopt Resolution No. 66 -593, Councilman Merritt seconded, and the motion was unanimously carried. 16. RESOLUTION NO. 66 -591+: Appointing recurrent personnel, Parks Maintenance Dept. City Manager Koski presented Resolution No. 66- 594, A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING A TEMPORARY EMPLOYEE. Councilman Nunamaker moved to adopt Resolution No. 66 -595, Councilman Tyrell seconded, and the motion carried unanimously. 17. RESOLUTION NO. 66 -595: Warrants 6 Demands Councilman Merritt moved to adopt Resolution No. 66 -595, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOle ING CLAIMS AND DEMANDS IN THE SUM OF $39,109.29, DEMAND NOS. 7829 THROUGH 7905. Councilman Nunamaker seconded, and the motion carried unanimously. 18. RESOLUTION NO. 66 -596: Opposing proposed amendments to legal- ize manufacture, sale, purchase, possession & transportation or marijuana. City Manager Koski preseoted,Resoluti'on No. 66 -596, A RESOLU- TION OF THE CITY COUNCIL OF TEMPLE CITY OPPOSING A PENDING INITIATIVE PETITION TO LEGALIZE THE USE OF MARIJUANA. Council, man Nunamaker moved to adopt Resolution No. 66 -596, Councilman Tyrell seconded, and the motion carried unanimously. 883 Council Minutes, April 5, 1966, page 5 19. RESOLUTION NO. 66 -597: Expressing support of armed forces. City Manager Koski presented Resolution No, 66 -597, A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY EXPRESSING SUPPORT AND DEVOTION TO THE MEMBERS OF THE ARMED FORCES OF TH1E COUNTRY FIGHTING IN VIET NAM. Councilman Tyrell moved to adopt Resolution No. 66 -597, Councilman Nunamaker seconded, and the motion carried unanimously. 20. COMMUNICATIONS: City Manager Koski presented a request from Chief Barton of the Fire Dept. for the Council to proclaim May 7, Saturday, as "Fire Services Day ". Councilman Merritt moved to have the Mayor so proclaim, Councilman Nunamaker seconded, and the motion carried unanimously. 21, TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Ray Burger, 9018 Rancho Real, spoke in reference to item 13, street improvement on the south side of Olive St. at Rosemead, and in support of the widening of the street as proposed. Lou Weidner, 6327 Primrose, spoke regarding the drainage ease - ment-at the rear of his property. Following discussion, it was decided to get some pictures of the problem area and the reports and consider them at a study session and on the agenda at the next Council meeting. 22. MATTERS FROM CITY OFFICIALS: Councilman Dickason asked about an open house at the City Hall on election night and was advised there would be and he recom- mended publicity on this. He also commented on this being his lust session after serving six years, that he was proud of the progress that has been made and hopes that the future holds much more for the City. Mayor Harker spoke on behalf of the Council, stating his contribution in the formative years has been greatly appreciated by the Council and all the people in town, and wished him well. Councilmen Merritt, Tyrell, and Nunamaker joined in expressing their appreciation of Council- man Dickason's service to the City. The Hunters inn has submitted an application for an entertain- ment license which automatically requires a public hearing. Councilman Tyreli moved to set the public hearing for April 19, 1966, at 7:30 P.M., Councilman Merritt seconded, and the motioi; carried unanimously. The Council was requested to authorize the necessary expense of a deposit on room reservations for the Contract Cities Semi - nar to be held May 26, 1966, in Palm Springs, the amount to be determined as soon as all reservations are confirmed by those able to go. Councilman Nunamaker moved to approve, Councilman Tyrell seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None City Manager Koski presented to the Council a Grant of Ease- ment to the Southern California Edison Co. to place utilities in public parking lots in connection with the mall program. H requested authorization to execute the document. Councilman Tyrell moved to authorize the Mayor and City Clerk to sign the Grant of Easement on behalf of the City subject to approval of the City Attorney, seconded and carried, A discussion of the mall development regarding ingress and egress of property owners,and a concerted effort will be made to cet the balance of the releases in order to proceed with the Improvement, as a determination must be made within the next 30 to 45 days. 881+ 1 Council Minutes, April 5, 1966, pare u The City Manager reported on two petitions he had received calling attention to conditions existing at L:.906 and 4916 Encinita where dog kennels are operated. They cite violations of Ordinance No. 63 -112, the zoning ordinance, and the petitio, is sijned by 90 persons who are property owners or residents of this area. Councilman Tyrell requested this be made a part of the record to be considered when the other reports are made on previously filed petitions. City Manager Koski advised there was a communication in the circulating file concerning membership fees for SCAG which wig' be discussed at the next study session. He also advised final arrangements are being worked out on the proposed sidewalk program and the new Director of Public Works will be working on this so it can be considered at the next study session. The City Manager also advised he had been in contact with Dr. Jobe and a report will be in the hands of the Council prior to the June meeting. He also stated the Circle K market had applied for a beer and wine off -sale license from A.B.C. and he had checked and the proximity to Temple City Park is a basis for protest by the City if desired. Following discussion, Councilman Dickason moved, if the tape shows the applicant made a statement at the public hearing that he would not sell any alcoholic beverages, that the City write a letter of informal protest, and if not so stated on the tape, that no further action be taken, Coun- cilman Nunamaker seconded, and the motion was carried by the following called vote: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSEHT: Councilmen -None The Council also discussed the A.B.C. application where the applicant had prior convictions. Following! discussion, Coun- cilman Dickason moved a letter of informal protest should be written to A.B.C. calling attention to the record of the appli cant, Councilman Merritt seconded, and the motion carried unanimously. This application was for the business located at S'022 Las Tunas. City Manager Koski presented a letter requesting support for the preservation of the Santa Anita station located on Colo- rado Ave. in Arcadia, for the historical benefit to the area. They are not asking for money, only endorsement of the project. Councilman Merritt moved to endorse the project, Councilman Nunamaker seconded, and the motion carried unanimously. The City Manager asked to be absent April 6, 7 and 8, as part of his vacation. Councilman Nunamaker moved to approve, Coun- cilman Merritt seconded, and the motion carried unanimously. Councilman Tyrell moved to adjourn until 6 P.M. on April 13, 1966, seconded and carried. Council adjourned at 9:50 P.M.
