We, the undersigned, on behalf of the Applicant and the Zoning Board of Appeals, respectively, as
provided in G.L. c. 40B, 5 21, hereby mutually agree that the time to open the public hearing
regarding this matter is extended through and including October 23, 2019, the Applicant hereby
waiving any claim that the public hearing was not opened within thirty days as provided in G.L. c.
40B, 5 21, the Zoning Board of Appeals hereby waiving any claim that the Application is
insufficient for filing purposes, and the Applicant and the Zoning Board of Appeals further
mutually agreeing that following the opening of said public hearing, the Zoning Board of Appeals
will continue the public hearing to January 22, 2020. Finally, the undersigned parties agree to
extend the time for the Zoning Board of Appeals to close the public hearing to July 22, 2020,
provided, however, that if either party has filed an interlocutory appeal of a safe harbor
determination, the time for closing the public hearing shall be tolled in accordance with 760 CMR
56.03(8).
