A RESOLUTION: AWARDING OF THE CONSTRUCTION CONTRACT FOR THE
EAST MARKET STREET WIDENING PROJECT TO RUSTLER
CONSTRUCTION FOR $1,652,902.20 CONTINGENT UPON
FULL EXECUTION OF THE TOWN OF LEESBURG/VIRGINIA
DEPARTMENT OF TRANSPORTATION AGREEMENT
WHEREAS, the East Market Street Widening Project is fully funded by the
Virginia Department of Transportation and administered by the Town; and
WHEREAS, in response to a public solicitation for bids for this East Market Street
Widening Project, the Town received bids on February 7, 2003 from the following firms:
· Rustler Construction, Inc.
· Tessa Construction & Tech Company, LLC
· A&M Concrete Corporation
· Sagres Construction Corporation
· Ashburn Contracting Corporation
· Arthur Construction Company, Inc.
· JSI Paving & Construction
WHEREAS, this is a "Unit Price" contract; and
WHEREAS, the bids were evaluated by the
$1,652,902.20
$1,669,747.00
$2,008,582.81
$2,117,800.50
$2,199,542.35
$2,303,710.00
$2,492,880.50; and
Capital Projects Administrator in
accordance with .the bid documents and the Town Purchasing Policy; and
WHEREAS, the Commonwealth Transportation Board approVed award of this
contract to Rustler Construction Inc., of Lanham, Maryland at its March 2003 meeting; .and
WHEREAS, the Town Council adopted Resolution #2003-57 approving the
Town/VDOT Agreement and authorizing the Town Manager to execute this Agreement on
April 8, 2003; and
WHEREAS, the total project cost including engineering, inspection, management
and construction is anticipated to not exceed the project budget of $3,203,000.00; and

FULL EXECUTION OF THE TOWN OF LEESBURG/VIRGINIA
DEPARTMENT OF TRANSPORTATION AGREEMENT
WHEREAS, VDOT Regional Surface Transportation Funds (RSTP) in the amount
of $3,203,000.00 were allocated for this project; and
WHEREAS, the Town/VDOT Agreement has been sent to VDOT for signature by
the Commissioner.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
Section I. The construction contract for the East Market Street Widening Project is
hereby awarded to Rustler Construction Inc., in the amount of $1,652,902.20, contingent
upon full execution of the Town/VDOT Agreement.
Section II. The Town Manager is authorized to execute this contract.
