Chamberlin has requested special exception approval to permit a child care center at 818 South King Street; and WHEREAS, the property is located in the B-2 (Established Corridor Commercial) District, and H-2 (Historic Corridor Overlay) District; and WHEREAS, on April 17, 2003, the Planning Commission recommended conditional approval of this application; and WHEREAS, on May 28, 2003, the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for a child care center, as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE, RESOLVED by the Town Council of Leesburg, Virginia as follows: Special Exception application #SE 2002-05, South Street Day Care Center at the Park, Mr. Thomas B. Chamberlin, 818 South King Street, identified in the Loudoun County Land Records with Parcel Identification Numbers 232-36-2431,232-36-3335, 232-36-4533, 232-36-5840, and 232-36-6858, is hereby approved subject to the following conditions: 1. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual, and that final plats, development plans, and construction drawings are subject to the applicable town regulations. Full frontage improvements shall be provided by the applicant for the South King Street and Davis Court frontages. Full frontage improvements include turn lanes, road widening to the required width, concrete curb and gutter, storm drainage, concrete sidewalk, and street lights, but shall not include any redesign or reconstruction of bridge components. 3. In exception of note #9 on sheet one of the special exception plat, dated March 8, 2003 and revised through March 12, 2003, the applicant shall provide street trees in addition to what is required by the zoning ordinance (that ordinance adopted April 24, 1990 and amended through May 29, 2002) along the South King Street frontage, on the South King Street side of the fence. 4. The applicant shall not use any c hain link fencing on this special exception site. The applicant shall provide a solid masonry wall around the children's play area, as appropriate for security purposes as determined during development plan review. 5. The applicant shall provide two speed tables in the child care drop-off lane, along with pavement markings. 6. The applicant shall provide "one-way" signage at the opposite end of the one-way child pick-up/drop-off area. 7. All structures to be built on-site, including the style of lighting fixtures, signage, and fencing i s t o b e approved b y t he Board o f Architectural Review p riot t o development plan approval. 8. The applicant shall provide additional lighting along the eastern portion of the building as well as at the entrance to the child care center. The details of this lighting shall be reviewed for conformance with the Zoning Ordinance and Design and Construction Standards Manual at development plan stage. 9. The applicant and the proposed childcare center shall meet and remain in compliance with all state licensing requirements. 10. The hours of operation when childcare will be provided on-site shall be restricted to 7:00 a.m. - 7:00 p.m., Monday through Friday. 11. No more than 198 children shall be enrolled at this facility. No more than 20 employees will work on the largest single shift of operation at this establishment. At all times the applicant shall insure that the minimum number of staff members present onsite conform to Virginia regulations concerning child care facilities. 12. The applicant shall provide for the following: (1) the costs of removing the existing lane pavement markings on the westbound approach to the S. King Street/Davis Avenue intersection, and (2) the applicant shall provide for the cost of the new pavement markings to create a separate left turn lane and a shared right/through lane. The costs shall be due at the time an occupancy permit is issued for the child care center that is the subject of this special exception. 13.
