HomeMy Public PortalAbout6.3.1982 Planning Board MinutesPlanning Board Minutes June 3, 1982 Convened at 7:32 PM Members present: Hilda Brody, Josephine Holman, Nancy Goodwin, Larry Carter, Myron Martin, Barbara Page, Judy Cox and Chairman Frank Sheffield and Rick Cannity Others: James Bennett, Art Plambeck, John Dorward, Jack Gilbert, Susan Frankenberg, Rick Haug Item #I- Mr. Jack Gilbert of 326 N. Cameron St. and expressed concern over property damage to his garden and backyard as a result of a Little League batting cage in his neighbor's yard. The neighbor is Mr. George Braxton. The situation has led in Mr. Gilbert's thinking, to a public recreational lot or park of sorts. Mr. Gil- bert referred to the lack of privacy created by the crowds of young people there and their lack of property respect. Nancy Goodwin pointed out the problem of the Zoning Ordinannce definitions that prevent rectifying the situation. Ms. Page suggested using the Dispute Settlement Center. Chairman Sheffield concurred and suggested contact with the Zoning Officer be made. Mrs. Judy Cox mentioned contacting the Institute of Goverment in Chapel Hill. Item #2- Courtesy review of Art Plambeck's proposed subdivision (minor). Mr. Plambeck identified the location of the property on St. Mary's Road across from Cameron Park school. The plat presented by Plambeck showed one acre being severed from the parcel of land . This acre would be to the rear of Plambeck's house. Easements were produced to show there was access to the proposed lot. Easements of 1925 and 1965 were presented. Neighbors to Mr. Plambeck are R.C.Minnis and Mr. Bacon. Plambeck assured the Board he would be responsible for maintaining the access. Frank Sheffield motion, " The Planning Board �cYi'treet to be a puB.lic right-of-way. No improvements are required on the road r/w and the Board recomm- ends approval of the minor subdivision." Judy Cox second. Unanimously passed. Item #3- Reconsideration of James Bennett Subdivision. Zoning Officer Haug gave background to the situation. Bennett had attempted to have a surveyor rectify a previous subdivision that was registered erroneously with the Register of Deeds. Officer Haug asked the Board to give consideration to Mr. Bennett due to circumstances involved. Mr. Bennett asked for permission to put in a class "A" road to the subdivision and allow two to two and one-half years to tar and gravel it. Class "A" road standards by the County were explained to the Board by Rick Cannity. Due to extenuating circumstances, the time element and need for flexibility (items mentioned by Board members) the following motion was made by Judy Cox, " The Planning Board recommends James Bennett's subdivision be approved with a twenty foot wide road in a sixty foot right of way , with appropriate base and four inches of gravel on surface . A recommendation to the Town Board that a contract be entered into with Mr. Bennett re: tar and gravel of road upon sale of any of the lots in the subdivision, or within three years, in any case." Josephine Holman second. Vote: For- Hilda Brody, Frank Sheffield, Larry Carter, Judy Cox, Myron Martin, Josephine Holman, Nancy Goodwin. Against- Barbara Page, Rick Cannity. Item #4- Planning Conference report by Josephine Holman. Ms. Holman reported on the seminars she had attended. She found them to be very informative . She shared with the Board the concepts of plans for recreation, growth and management in municipal planning, traffic control, industrial growth management and district control. Planning Conference report by Judy Cox. Ms. Cox reported on the Board of Adjust- ment seminar she attended. Reported that Hillsborough is not unique in her problems 'and that many surrounding communities have similar problems. Myron Martin presented sketch on same and reported on the field survey conducted by his committee. The problem presented in the rear yard buffer is one of the present Ordinance wording. Chairman Shfffield referred the rewording and clarification of buffer strips to the Goodwin Comm- ittee in their Section 8 amendment procedure. John Dorward of the Board of Adjustment explained the BOA'S conditions set for a chain link fence around the Byrd property. Item #6- North Hills Shopping Center. Josephine Holman reported on her contact with the County Health Dept. and Tony Laws. Mr. Laws suggests the Town Board pass an ordinance to help with the trash control problem created by the stores in the North Hills complex. Mrs. Judy Cox suggested the creation of an Appearance Commission by the Town Board to handle such problems. Item #7- Home Occupation.Chairman Sheffield stated the need to finalize a version of Home Occupation to send to the Town Board for another Public Hearing. Judy Cox reported on the results of the first Public Hearing. The consensus of the hearing is that we continue to have a Home Occupation section in the ordinance. The public had expressed concern over article "F" of the version submitted to the hearing. After much discussion the Board voted on the def- initions and articles item by item. Section A, B, C were approved unanimously. Section E was also approved unanimously. Section D and F as amended (see attachment) were approved unanimously. Motion to approve by Judy Cox, second by Barbara Page. Nancy Goodwin made a motion to, " Recommend approval of the Home Occupation amendment to the Town Board for their appropriate action." Second Rick Cannity Item #8- Nash & King St. mobile home problem. Myron Martin inquired about the problem of the mobile homes located there and their not being skirted and brought to conformance with the Ordinance. Zoning Officer gave background information and the financial situation involved for the occupants. Chairman Sheffield asked the Zoning Officer to continue to follow the matter up. Meeting adjourned.
