A RESOLUTION: PRESENTED: July 8, 2003 2003-110 ADOPTED: July 8, 2003 APPROVING SPECIAL EXCEPTION//SE 2002-08, HOLY TRINITY LUTHERAN CHURCH, 605 W. MARKET STREET, TO PERMIT THE EXPANSION OF THE EXISTING CHILD CARE CENTER AND CHURCH USE WHEREAS, Mr. Peter H. Miller, has requested special exception approval to permit the expansion of the existing child care center and church use at 605 W. Market Street; and WHEREAS, the property is located in the R-4 (Single Family Residential) District, and H-2 (Historic Corridor Overlay) District; and WHEREAS, on April 17, 2003, the Planning Commission recommended conditional approval of this application; and WHEREAS, on June 24, 2003, the Town Council held a public heating; and WHEREAS, the proposed use meets the special exception standards for a child care center and church use, as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE, RESOLVED by the Council of the Town of Leesburg inVirginia as follows: Special Exception application #SE 2002-08, Holy Trinity Lutheran Church, 605 W. Market Street, identified in the Loudoun County Land Records with Parcel Identification Numbers 270-10-0619, is hereby approved subject to the following conditions: 1. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual, and that final plats, development plans, and construction drawings are subject to the applicable town regulations. A RESOLUTION: -2- APPROVING SPECIAL EXCEPTION #SE 2002-08, HOLY TRINITY LUTHERAN CHURCH, 605 W. MARKET STREET The applicant shall submit a development plan, subject to approval by the town, prior to issuance of a zoning permit for this special exception use, building addition, and parking lot expansion. The applicant shall provide a storm drainage easement along the southem boundary of the church property, prior to approval of the development plan for the special exception use. The easement should be based upon an analysis of the 100-year overland relief across the subject site and is required because the proposed building expansion is immediately adjacent to the floodplain. The applicant shall verify and incorporate necessary measures, including modification of the buildings and parking lot, if necessary, at development plan submission, to ensure that no building, parking lot, landscaping, or fill is placed in the 100-year floodplain. The applicant shall verify and incorporate necessary measures for storm water management in accordance with Loudoun County storm water management criteria in force at the time of development plan approval. The applicant shall provide full frontage improvements, including a left turn lane and a shared northbound right turn lane along the Catoctin Circle frontage, with a 6-foot wide asphalt trail in lieu of the standard 4-foot concrete sidewalk, at development plan submission. The applicant shall reserve for future dedication to the Town of Leesburg for public street purposes a 6~foot wide, 270-foot long area of land on-site, along the western property line, parallel to Catoctin Circle. This area shall be dedicated to the Town upon request in fee simple without compensation, free and clear of all liens and encumbrances and in a form approved by the Town Attorney. This reservation shall be for a period of not more than twenty-one (21) years from the date of approval of this application. If in the future this land is dedicated to the town for public street purposes, resulting in the removal of all or part of the perimeter parking lot buffer, the perimeter parking lot buffer will not need to be re-established elsewhere on the property. (Refer to the letter dated May 8, 2003, by Brian Boucher, Zoning Administrator, to Peter Miller, the applicant's representative, regarding this issue.) The hours of operation when childcare will be provided on-site shall be restricted to 8:30 a.m.- 3:15 p.m., Monday through Friday. No more than 110 children shall be enrolled at this facility. The ages of these children shall range from no less than 3 years of age up to and including 5 years of age. All structures to be built on-site, including the style of lighting fixtures, signage, and fencing is to be approved by the Board of Architectural Review prior to development plan approval. The additional security lighting in the play area shall be directed in a northwesterly direction and shall be reviewed at the time of development plan approval for conformance with the standards of the Design and Construction Standards Manual. All lighting will be in conformance with the lighting plan dated October 1, 2002 and revised through February 19, 2003. All landscaping will be in conformance with the landscaping plan dated July 17, 2002 and revised through April 11, 2003. The applicant shall maintain compliance with the Virginia Statewide Fire Prevention Code and the BOCA Building Code. This special exception shall be in substantial conformance with the special exception plan dated July 17, 2002 and revised through April 11, 2003. PASSED this 8th day of July 2003 ~i,~C.
