Others: John Dorward, Manly Palmer, Alois Calkmmyn and Cy Hogue. Meeting convened at 7:30 PM Frank Sheffield read a letter which he proposed that the Planning Board sign thanking Rick Haug for his service as Zoning Officer. The Board approved.. Item 1- Consideration of proposed subdivision of Dynasty Corporation. Cyrus Houge representing Mr. James Freeland was to provide answers to questions raised at the last planning board meeting, as well as answers to the points raised by the Orange County Planning Department in the memo of July 27, 1982. Mr. Houge said he could not say how much of the area would be paved since the prospective buyer, Foodtown, had not formalized their plans. Drainage from the area goes into a ditch on the west side of the service road and runs down to a concrete drain at the triangle of the service road and Rebecca Drive. "We would have no objection to providing a drainage easement," stated Mr. Houge. One area questioned, a bank, is on state property. Mr. Callamyn noted that there is a shallow ditch on the east side of the service road. Mr. Cannity pointed out that it would be better to settle the drainage questions prior to the transfer of the property. Mr. Sheffield questioned the status of Rebecca Drive and the Service Road in terms of paving and "public" versus "private." Mr. Cannity noted that the private road is maintained by the property owners who use it, while the public road is dedicated to the State of North Carolina and built to the State's secondary road standards. A public road could be offered to the Town of Hillsborough and built to some standards specified by the Town.. It was never the intent of the Orange County Subdivision Regulations to allow private roads to service commercial property, according to Mr. Cannity. Commercial use means heavier traffic so a road serving a commercial area would need to be properly maintainedand constructed to a safe standard to allow for police, fire, delivery trucks and customer traffic. On a public road, the police would enforce the traffic laws. Private road standards are 20 foot wide road with a 60 foot right of way and a 4 inch surface. The secondary road standards. would require 6 inches of crushed stone and 2 inches of asphalt, which would make it less subject to washouts. Currently Rebecca Drive is suitable for a residential street, but needs more paving for commercial traffic. Mr. Houge said that Mr. Freeland is not inclined to upgrade the roads, which would need more asphalt and possibly more gravel base. A maintenance agreement could be drawn up so that the stores using the road, Rebecca Drive, could agree to maintain the road and let the Town enforce the agreement, according to Mr. Houge, who also felt that the stores would maintain the road without having to be forced to do so. Mr. Cannity suggested that the Town Board be consulted regarding the road issue. If the Town Board feels that a private road is acceptable in this case, the County Planning Staff would agree. If the road were to be a private road, a road maintenance agreement needs to be drawn up and approved by the county attorney, which is a time- consuming process. Mr. Houge noted that there is a fire hydrant within 500 feet. Mr. Callamyn noted that there would be no pressure problem, since the hydrant is uphill. Mr. Houge noted that the sprinkler requirements would depend on the type of building and the building codes. Mr. Houge noted that the speed limit was too fast at that point on Churton Street and would need to be lowered with the additional traffic generated by additional development. If old 86 were widened by NC DOT the service road might be consumed by the process, but it would not affect the access to the property under discussion, according to Mr. Houge. Mr. Sheffield asked if Dynasty expected to have an access from the service road to this property. Mr. Houge said they did not. Page Two Mr. Sheffield recommended that the power lines on the property be put underground. Mr. Houge agreed that this was desirable and that the Town might want to amend the Zoning Ordinance in the future to allow for this. Mr. Sheffield also noted that although the Zoning.Ordinance does not include a requirement for landscaping, he wanted to recommend to Mr. Houge that landscaping be undertaken so that the area would be something more than building and asphalt. Ms. Cox noted that a study needed to be made of the need for a third lane and a traffic light on Churton near Duke Power. NC DOT should be asked for the study. Mr. Sheffield suggested that this topic be added to the Work Session with the Town Board on August 26, 1982, in order to finalize comments and move ahead with it expeditiously. Mr. Sheffield called on Nancy Goodwin for her committee report. The Section 8 *committee was interested in creating a new multi -family district. .rection IU Committee was leaving multi -family in R-10. Ms. Goodwin requested comments. Discussion ensued regarding spot zoning, conditional use process for multi -family housing and limitation of the number of units allowed in any one development. Discussion of possible sending of conditional use permits with town -wide impact potential to the Town Board for final approval if after discussion with Town Board Members this method would be satisfactory. Further discussion at Planning Board and Board of Adjustment Meetings is planned. General agreement on limiting the number of units of multi -family housing in one development to 40 on 5 acres at 8 units per acre as a proposed part of the possible changes to the Zoning Ordinance was noted. Screening of multi -family units from surrounding residential areas was discussed. 60 feet from the side lot lines was noted as desirable. The meeting was adjourned at 10;10. Amendments to the August 19, 1982 minutes of the Planning Board were made on October 7, 1982 and include correction of the spelling of names in the first part under members present and others as well as an additional sentence to be added to the paragraph on the Section 8 Committee report: *Consensus on creating a new multi -family district was expressed by the Planning Board.
