A RESOLUTION: AWARDING A CONTRACT TO RUSTLER CONSTRUCTION
INCORPORATED IN THE AMOUNT OF $313,903.36 FOR
CONSTRUCTION OF THE CATOCTIN CIRCLE TRAIL PROJECT
WHEREAS, in March 1999, the Town Council authorized the Department of Parks and
Recreation to submit a grant application to the Virginia Recreational Trails Fund for funding
assistance to develop the Catoctin Circle Trail Project; and
WHEREAS, in October 1999, the Virginia Department of Conservation and Recreation
approved a Virginia Recreational Trails Fund Program Grant in the amount of $100,000 to the
Town of Leesburg in support of the trail project; and
WHEREAS, in February 2000, the Department of Parks and Recreation submitted the
official grant agreement that requires completion of a trail project by December 31, 2002; and
WHEREAS, as part of the approved budget for fiscal year 2001, the Town Council
appropriated $30,000 for design and engineering services related to development of the project,
and in September 2001, staff approved a purchase order with the engineering firm of Dewberry
and Davis for the necessary design and engineering work; and
WHEREAS, the Virginia Department of Conservation and Recreation asked the town to
indicate its decision by December 31, 2002; and
WHEREAS, the recently approved 20-Year Comprehensive Plan for Parks, Recreation,
Open Space, Trails and Greenways identified the Catoctin Circle Trail as an important link in the
town's trail system; and

WHEREAS, the Director of Parks and Recreation and the Parks and Recreation Advisory
Commission recommended authorization to proceed with construction of the Catoctin Circle Trail
Project; and
WHEREAS, in December 2002, the Town Council approved funding to proceed with the
development of the Catoctin Circle Trail Project in accordance with the 1999 reimbursement grant
award in the amount of $100,000 from the Virginia Recreational Trails Fund and authorized the
use of Ida Lee Park surplus funds in the amount of $225,000; and
WHEREAS, the Town of Leesburg' s Capital Improvement Program includes funding for
construction of the Catoctin Circle Trail; and
WHEREAS, the Catoctin Circle Trail construction project includes development of a 1,500 ft.
asphalt trail, storm drainage, retaining walls, traffic signalization, guardrail installation, erosion and
sediment control, tree protection, tree removal and tree planting; and
WHEREAS, in July 2003, an Invitation for Bids (IFB) was issued for the construction of the
Catoctin Circle Trail in accordance with Section 8.1, Competitive Sealed Bidding of the Town of
Leesburg Purchasing Policy; and
WHEREAS, on July 31, 2003, one sealed bid was received, and the bid was publicly opened in
accordance with the bid documents; and
WHEREAS, the bid received was from Rustler Construction Incorporated; and
WHEREAS, the bid was evaluated by the Capital Projects Administrator pursuant to the bid
documents and the Town of Leesburg's Purchasing Policy; and

WHEREAS, Rustler Construction Incorporated is determined to be the only responsive bidder in
this unit price contract in the amount of $313,903.36 for construction of Catoctin Circle Trail; and
WHEREAS, the Director of Parks and Recreation and the Capital Projects Administrator
recommend approval of an award of contract to Rustler Construction Incorporated in the amount of
$313,903.36 for construction of Catoctin Circle Trail; and
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the Town
Manager is hereby authorized to award, on behalf of the town, a unit price contract with Rustler
Construction Incorporated in the amount of $313,903.36 for construction of Catoctin Circle Trail.
