HomeMy Public PortalAbout8.26.1982 Work Session MinutesWORK SESSION MINUTES PLANNING BOARD & TOWN BOARD August 26, 1982 Planning Board Members present: Brody, Cannity, Cox, Goodwin, Page, Plambeck and Sheffield Town Board of Commissioners: Brown, Lloyd, Martin, Smith and Stevens The Work Session convened at 7:30 PM. Frank Sheffield requested the Town Board's opinion on the status of Rebecca Drive which will provide access to a 3.3 acre tract of land proposed for sub- division by Mr. James Freeland for development by Dynasty, Inc. He questioned whether the Town wants to recommend to the County that Rebecca Drive be paved to State Standards or other standards and whether Rebecca Drive be dedicated to the Town as a public road. Mr. Sheffield pointed out that there were no intentions to use the Service Road to access the property. Cyrus Hogue stated that Mr. Freeland did not want to dedicate it as a public road, but wanted to keep it as a private road. Mrs. Johnson pointed out that the Town had adopted the County Subdivision Regulations which address private road standards. Rick Cannity noted that the private road standards given in the County Subdivision Regulations are not intended to be used as standards for commercial roads. Mr. Cannity noted that state road standards seemed to be more appropriate in this case due to the heavy traffic which will be generated by commercial development. Mr. Hogue stated, "We don't want to pave it. It would cost us $12,000 or maybe more." He felt the obligation to pave should be on the buyer, who would have liability for the customers. He suggested that the width of the road, number of lanes and maintenance be left to the property owner. He suggested that a private maintenance agreement could be made between the stores and dedicated to the Town. Mrs. Brody pointed out that the Foodtown. in Chapel Hill has a poor parking lot. Foodtown could let the road deteriorate. Mr. Hogue felt that the Town should take some of the burden of the cost in bringing in a large firm with a high tax base. Mr. Smith pointed out that it is a commercial venture. If developer and owner want the road as it is, let them have it. By two or three years, the road will have to be paved to maximum State standards. Mr. Martin noted that the Town Board does not have to accept it if it is offered as a public road. Mrs. Stevens said the Town should not sanction a sub -standard road. Mr. Brown suggested that the Town let the owner keep the road private. This concluded the discussion on the proposed subdivision road. Mr. Sheffield next referred to the Home Occupation Requirements. He noted that the requirements had been drawn to regulate the external impacts of home occupations. He noted that the Town Board's previous concerns had been with size and safety. Mr. Martin requested the square footage be cut since the other things had been answered. Page Two - Work Session Minutes Mrs. Stevens requested that the two parking areas required not be allowed to infringe on the 25 foot setback or 20 foot side yards, and home occupation additions should not be allowed in the setback areas. Mrs. Stevens stated that a zoning officer inspection should be stated and required. That portion of the home used for occupation should meet commercial standards, including electrical S 4. Mr. Cannity suggested that every home occupation should be required to have an approved electrical inspection and statement as to the safety of the wiring so as to avoid the need for the zoning officer's inspection for electrical usage. Mrs. Cox suggested that a list of standards be made for use in granting a home occupation certificate of occupancy and that every such business would have to conform and upgrade in three years. The Town Board agreed to a square footage of 250 feet. Mr. Smith asked for rebuttal from the Planning Board and Board of Adjustment. Mrs. Brody asked for discussion of retail sales of products not made in the home. Mr. Smith noted that he felt that "Retail sales of specialty items would be ok." Mr. Brown agreed. Mr. Clarence Jones requested action on two trailers which are not underpinned, skirted, etc. at the corner of Nash and King Streets. Mr. Smith said the Zoning Ordinance should be enforced in this matter. End of Work Session Planning Board remained to have an informal meeting. The Board decided to recommend Nancy Goodwin to have the term of Larry Carter, since her term would be expiring in February, 1982. Rick Cannity recommended Ronald Wagner for the vacancy; Mr. Wagner was to be called to see if he is interested. The Planning Board worked on Mr. Sheffield's draft of recommendations to the County Planning Staff. The final recommendations were informally agreed to and will most likely be adopted at the September 16,. 1982 meeting of the Planning Board. Mr. Mike Mills, NC DOT Assistant District Engineer, was to be contacted by Kay Maltbie to determine the turning radii needed on Rebecca Drive at the intersection with South Churton Street and to check on the number of feet required for three turn lanes (if 30 feet was appropriate). Recommendations to be made to the Town Board to make to NC DOT were that the speed limit be dropped to 35 mph and that a study of vehicular and pedestrian traffic on South Churton be made. The Meeting was adjourned at 10:10 PM.
