A RESOLUTION: PRESENTED: November 12, 2003 2003-151 ADOPTED: November 12, 2003 APPROVING SPECIAL EXCEPTION #SE 2003-03, MOBIL CAR WASH, 1017 EDWARDS FERRY ROAD, N.E., TO PERMIT A SINGLE-LANE CAR WASH ADDITION TO AN EXISTING SERVICE STATION WHEREAS, GRK Battlefield L.L.C. c/o First Washington Realty has requested special exception approval to amend existing Board of Zoning Appeals Special Exception #90-197 to permit a 912 square foot single-lane car wash addition on the property leased by the existing Mobil Service Station in Battlefield Shopping; and WHEREAS, the property is located in the B-3 Community Retail/Commercial Zoning District; and WHEREAS, on October 3, 2003, the Planning Commission recommended conditional approval of this application; and WHEREAS, on September 4, 2003, the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for a car wash facility as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE, RESOLVED by the Council of the Town of Leesburg inVirginia as follows: Special Exception application #SE 2003-03, Mobil Car Wash, 1017 Edwards Ferry Road, N.E., identified in the Loudoun County Land Records as Parcel Identification Number 147-25-2096, is hereby approved subject to the following conditions: 1. The existing timber wall along the east side of the site and shrubs atop it will be replaced during site development. 2. If a final development plan is not required for these improvements, then prior to issuance of a A RESOLUTION: -2- APPROVING SPECIAL EXCEPTION #SE 2003-03, MOBIL CAR WASH, 1017 EDWARDS FERRY ROAD, N.E. o o zoning permit for the Mobil Car Wash the proposed landscape design will be revised to incorporate more acceptable plant material and planting arrangements in accordance with Zoning Ordinance requirements, and to remove potential conflicts with site distance at entrances and exits. Flat lenses or shields will be included on new lights, all perimeter lights and lights under the gas pumps canopy. Drop lens lights are not permitted. If a final development plan is not required for these improvements, then prior to issuance of a zoning permit for the Mobil Car Wash the Applicant will prepare and submit a grading and drainage plan in accordance with Section 10-135 Requirements for Grading and Drainage Plans on Lots of Record of the Design and Construction Standards Manual. Hours of operation shall be limited to the same hours as the gas station/convenience mart, which are currently 5:00 a.m. to 12:00 p.m. midnight, seven days a week. Condition 1.a. (3) of existing Special Exception #BZA 90-197 is hereby revised to read "One vehicle service facility use as defined by item number 16 to be located on 'pad' S." Development of this special exception use shall be in substantial conformance with the Special Exception Plat dated June 24, 2003 and revised through September 3, 2003. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual, and that final plats, development plans, and construction drawings are subject to the applicable town regulations.
