AUTHORIZING TIME EXTENSIONS FOR COMPLETION OF PUBLIC
IMPROVEMENTS AND APPROVING PERFORMANCE GUARANTEES
FOR NORTHLAKE SECTIONS 3 AND 8
WHEREAS, Northlake Homes, Inc., the developer of Northlake Sections 3 and 8 has not
completed all the required public improvements in accordance with the approved construction
drawings and town standards within the two-year period agreed to in the contract for public
improvements and previously approved time extension; and
WHEREAS, the developer has requested a time extension to complete the public
improvements; and
WHEREAS, this subdivision is in Loudoun County and the town's bonded improvements are
water and sanitary sewer only; and
WHEREAS, letters of credit in the amount of $48,153.00 for Section 3; and $27,582.50 for
Section 8, from the Mercantile-Safe Deposit and Trust Company were provided by the developer to
guarantee the installation of public improvements; and
WHEREAS, the town's Director of Engineering and Public Works recommends a time
extension to November 19, 2004 for Section 3; and January 28, 2005 for Section 8.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. The letters of credit from the Mercantile-Safe Deposit and Trust Company in
the amounts $48,153.00 and $27,582.50 are approved to guarantee the installation of public
improvements in Northlake Sections 3 and 8.

SECTION II. The time extensions to November 19, 2004 for Northlake Sections 3; and
January 28, 2005 for Northlake Section 8 for completion of the public improvements are approved.
