HomeMy Public PortalAbout2004_02_24_r023The Town of Leesburg, Virginia PRESENTED February_ 24, 2004 RESOLUTION NO. 2 0 0 4 - 2 3 ADOPTED February_ 24, 2004 A RESOLUTION: AUTHORIZING TIME EXTENSIONS FOR COMPLETION OF PUBLIC IMPROVEMENTS AND APPROVING PERFORMANCE GUARANTEES FOR RIVER CREEK PHASE I, SECTION IA, PHASES II & III, SECTION 1; PHASE I, SECTION 2 (LANDBAY B); PHASE I, SECTIONS 3&4 (LANDBAY A); PHASE II, SECTION 2 (LANDBAY C); PHASE Il, SECTION 2A (LANDBAY C); PHASE II, SECTION 2B (LANDBAY C); PHASE II, SECTION 2C (LANDBAY C); PHASE II, SECTION 3/3A (LANDBAY D); PHASE III, SECTION 2 (LANDBAY H); PHASE 1~ SECTION 3 ( LANDBAY G); PHASE III, SECTION 5 (LANDBAY I); PHASE III, SECTION 6 (LANDBAY R); PHASE IV, SECTION 1 (LANDBAY E); PHASE IV, SECTION lB (LANDBAY E); PHASE V, SECTION 1 (SHOAL CREEK DRIVE); PHASE vm, SECTION 2A (LANDBAY J); PHASE VIII, SECTION 2B (LANDBAY J); RIVER CREEK GOLF COURSE FACILITY; AND RIVER CREEK PARKWAY SOUTH WHEREAS, River Creek LLC, the developer of River Creek Phase I, Section lA, Phases H & HI, Section 1; Phase I, Section 2 (Landhay B); Phase I, Sections 3&4 (Landbay A); Phase II, Section 2 (Landhay C); Phase II, Section 2A (Landbay C); Phase 1I, Section 2B (Landbay C); Phase H, Section 2C (Landbay C); Phase II, Section 3/3A (Landhay D); Phase III, Section 2 (Landbay Iq); Phase IH Section 3 ( Landbay G); Phase HI, Section 5 (Landbay I); Phase m, 6 (Landbay R); Phase IV, Section 1 (Landbay E); Phase IV, Section lB (Landhay E); Phase V, Section 1 (Shoal Creek Drive); Phase VIII, Section 2A (Landbay J); Phase VIII, Section 2B (Landbay I); River Creek Golf Course Facility; and River Creek Parkway South has not completed all the r~quired public improvements in accordance with the approved construction drawings and town standards within the two-year period agreed to in the contract for public improvements and previously approved time extensions; and WHEREAS, the developer has requested a time extension to complete the public improvements; and WHEREAS, these sections of River Creek Subdivision with the exception of River Creek Parkway South are located in Loudoun County and the town's bonded improvements are water and sanitary sewer only; and A RESOLUTION: -2- AUTHORIZING TIME EXTENSIONS FOR COMPLETION OF PUBLIC IMPROVEMENTS AND APPROVING PERFORMANCE GUARANTEES FOR VARIOUS SECTIONS OF RIVER CREEK SUBDIVISION WHEREAS, corporate surety bonds from the Fidelity and Deposit Company of Maryland in the amount of $28,294.10 for Phase I, Section lA Phase II & III, Section 1; in the amount of $12,031.25 for Phase I, Section 2 (Landbay B); in the amount of $31,079.00 for Phas~ I, Sections 3&4 (Landbay A); in the amount of $7,597.30 for Phase II, Section 2 (Landbay C); in the amount of $9,096.70 for Phase II, Section 2A (Landbay C); in the amount of $4,970.70 for Phase II, Section 2B (Landbay C); in the amount of $18,797.90 for Phas~ II, Section 2C (Landbay C); in the amount of $42,514.67 for Phase II, S~-tion 3/3A (Landbay D); in the amount of $5,671.00 for Phase BI, Section 2 (Landbay H); in the amount of 15,449.90 for Phas~ BI, Section 3; in the amount of $21,394.67 for Phase III, Section 5 (Landbay I); in the amount of $19,707.90 for Phase III, Section 6 (Landbay R); in the amount of $22,000.00 for Phase IV, Section 1 (Landbay E); in the amount of $19,304.80 for Phase IV, Section lB (Landbay E); in the amount of $21,473.30 for Phase V, Section 1 (Shoal Creek Drive); in the amount of $208,318.00 for Phase VIII, Section 2A; in the amount of $141,403.00 for Phase VIII, Section 2B (Landbay J); in the amount of $4 1,889.10 for River Crook Golf Course Facility; and in the amount of $101,712.70 for River Crook Parkway South w~r¢ provided by the developer to guarantee the installation of public improvements; and WHEREAS, the town's Director of Engineering and Public Works recommends a time extension to August 7, 2004 for River Crook Parkway South and January 30, 2005 for the other listed sections of River Creek; and THEREFORE, RESOLVED by the Council of the Town of Loosburg in Virginia as follows: SECTION I. The corporate surety bonds from the Fidelity and Deposit Company of Maryland in the amount of $28,294.10 for Phase I, Section lA Phase II & III, Section 1; in the amount of $12,031.25 for Phase I, Section 2 (Landbay B); in the amount of $31,079.00 for Phase I, Sections 3&4 (Landbay A); in the amount of $7,597.30 for Phase II, Section 2 (Landbay C); in the amount of $9,096.70 for Phase II, Section 2A (Landbay A RESOLUTION: -3- AUTHORIZING TIME EXTENSIONS FOR COMPLETION OF PUBLIC IMPROVEMENTS AND APPROVING PERFORMANCE GUARANTEES FOR VARIOUS SECTIONS OF RIVER CREEK SUBDIVISION C); in the amount of $4,970.70 for Phase II, Section 2B (Landbay C); in the amount of $18,797.90 for Phase II, Section 2C (Landbay C); in the amount of $42,514.67 for Phase II, Section 3/3A (Landbay D); in the amount of $5,671.00 for Phase III, Section 2 (Landbay H); in the amount of 15,449.90 for Phase m, Section 3; in the amount of $21,394.67 for Phase m, Section 5 (Landbay I); in the amount of $19,707.90 for Phase m, Section 6 (Landbay R); in the amount of $22,000.00 for Phase IV, Section I (Landbay E); in the amount of $19,304.80 for Phase IV, Section lB (Landbay E); in the amount of $21,473.30 for Phase V, Section 1 (Shoal Creek Drive); in the amount of $208,318.00 for Phase VIIL Section 2A; in the amount of $141,403.00 for Phase VIII, Section 2B (Landbay J); in the amount of $41,889.10 for River Creek Golf Course Facility; and in the amount of $101,712.70 for River Creek Parkway South are approved to guarantee the installation of public improvements in these sections of the River Creek Subdivision. SECTION II. A time extenSion to August 7, 2004 for River Creek Parkway South and January 30, 2005 for the other listed sectionS of the River Creek Subdivision for completion of the public improvements are approved.
