A RESOLUTION: AUTHORIZING GENERAL CONTRACTOR PREQUALIFICATION
PROCESS
WHEREAS; the upgrade and expansion of the Water Pollution Control Facility (WPCF) from
4.85 MGD to 7.5 MGD will be advertised next month; and
WHEREAS; the contractor for this expansion must be a well qualified contractor capable of
performing this sophisticated, sensitive and delicate work; and
WHEREAS; the Virginia Public Procurement Act (VPPA) allows municipalities to adopt
prequalification process prior to implementation of such process; and
WHEREAS; contractors be approved/denied at least thirty days prior to the date established for
submission of bids; and
WHEREAS; the bid opening date for the WPCF upgrade and expansion is currently scheduled for
early May 2004.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
The Town Manager is hereby authorized to proceed with the attached procedures established by
CH2M Hill, and Town Staff in compliance with VPPA documents attached herein for this
prequalification.

ADVERTISEMENT FOR PREQUALIFICATION OF BIDDERS
The Town of Leesburg, Virginia (OWNER) is conducting a prequalification process for the
Upgrade and Expansion Project 7.5 at the Water Pollution Control Facility in Leesburg,
Virginia and is accepting sealed Contractor's Prequalification Application Forms. The
project will be bid separately.
Sealed Contractor Prequalification Application Forms will be received at the following
address: Town of Leesburg, 25 West Market Street, Leesburg, Virginia, 20178, Attention:
Kathy S. Elgin, until ? ?, 2004, 2:00 p.m. local time. The forms will be opened and evaluated
in accordance with the Virginia Public Procurement Act. Applications will be received and
evaluated in private and a list of prequalified contractors will be made available to the public.
Applications received after the specified date and time will be considered non-responsive.
The Upgrade and Expansion Project 7.5
The estimated value of the Project is $25 to $30 million. It is anticipated that Invitations to
Bid will be sent to prequalified bidders on or about March 22, 2004. The construction
duration is expected to be 1000 days with a start in June of 2004. The work includes, but is
not limited, to the following:
1. Influent Pump Station
2. Influent Receiving Box
3. Emergency Storage Tank
4. Two BNR Reactor Basins - E and F
5. Two Secondary Clarifiers - C and D
6. Diurnal Equalization Flow Splitter Structure
7. Modifications to the Existing BNR Reactor Basin Flow Splitter Structure
8. Modifications to the Existing BNR Reactor Basins A, B, C and D
9. Modifications to the Existing Secondary Clarifiers A and B
10.25 MGD Effluent Pump Station
11. Modifications to existing Effluent PS to become a W3 pumping station
12. Modifications to Solids Building to include a new Gravity Belt Thickener, replacement of
existing Belt Filter Press Feed Pumps, and replacement of existing Grinders, addition of
stairs at truck bay silo platform, addition of platform at pellet cooler
13. Odor Control Systems to include built-in-place biofilters for Primary Treatment Facilities
and Influent Pump Station and prepackaged biofilter for Recycle Equalization Basin.
Included with these systems are fiat aluminum covers on process basins and facilities and
ductwork between process facilities and biofilters.
14. Regenerative Thermal Oxidizer (RTO) and ductwork at the existing Solids Processing
Building

Prequalification documents may be examined and downloaded from the Town of Leesburg
Bid Board located at the web site www.leesburgva.org (under Town Services tab). For
additional information regarding the proposed work, contact Bruce Mattheiss, CH2M HILL

Qualifications shall be submitted on Contractor's Prequalification Application Forms and in
the manner specified in the Instructions for Prequalification. Only prime contract bidders
who have been prequalified in accordance with the procedures indicated in the Instructions
for Prequalification of Bidders will be allowed to submit bids for the project. Subcontractors
are not required to be prequalified.
Issuance of this Advertisement for Prequalification of Bidders does not commit the OWNER
to award of any contract, to pay any costs incurred in preparation of a response, or to procure
or contract for services or supplies. The OWNER reserves the right to waive any minor
irregularities and informalities, to reject any and all responses, and to re-advertise.

INSTRUCTIONS FOR PREQUALIFICATION
The Town of Leesburg Upgrade and Expansion Project 7.5

DEFINED TERMS.
Terms used in the Prequalification Documents have the meanings indicated below
which are applicable to both the singular and plural thereof.
1.1. Applicant--A Contractor who wishes to bid as a Prime Contractor and submits
an application to the OWNER for prequalification.
1.2. Bidder--A prequalified Contractor who submits a Bid to OWNER on the prime
contract, as distinct from a subbidder, who submits a Bid to a Bidder.
1.3. Final Completion--The point at which all contracted work is complete and the
OWNER issues final payment.
1.4. Prime Contract--The Contract between the OWNER and the prequalified
Contractor who is the low responsive bidder.
1.5. Responsible Contractor--All Contractors who wish to bid on the prime contract
and have submitted a Contractor's Prequalification Application Form and meet the
OWNER's minimum criteria for qualification to bid.
1.6. Substantially Complete--the point at which the OWNER has beneficial
occupancy but all contracted work is not complete.
PREQUALIFICATION DOCUMENTS.
2.1. Complete set of Prequalification Documents must be used in applying for
prequalification. Neither OWNER nor ENGINEER assumes any responsibility for
errors or misinterpretations resulting from use of incomplete sets of Prequalification
Documents.
2.2. Prequalification Documents consist of the Advertisement For Prequalification
Of Bidders, Instructions For Prequalification, and the Contractor's Prequalification
Application Form. Prequalification Documents are available as noted in the
Advertisement.
2.3. Prequalification Documents made available on the above terms are only for the
purpose of establishing the Bidder's responsibility prior to requesting Bids for the
Work and shall not be used for any other purpose.

OWNER'S INTENT.
3.1. It is the intent of the OWNER to afford Contractors the ability to prove they are
responsible prior to accruing the cost of preparing a bid. The OWNER also intends to
prequalify only those Contractors who can show sufficient financial ability and
appropriate experience to perform the construction work in question.
QUALIFICATIONS OF APPLICANTS.
4.1. To demonstrate qualifications to perform the Work, each Applicant must prepare
and submit to the OWNER written evidence of financial ability to perform the Work,
past experience on projects similar in scope, duration, and volume, and other data
called for in the Contractor's Prequalification Application Form.
4.2. The criteria used in examining Applicant's qualification shall include the
following:
4.2.1. Applicant's financial ability to perform the Work. Applicant financial
ability will be evaluated on the basis of its current capability to obtain all
bonding necessary for the performance of Work guaranteed by an acceptable
surety. Only sureties included on the current U. S Treasury Department list of
acceptable surety corporations shall be deemed acceptable.
4.2.2. Applicant's experience to perform the Work
4.2.3. Existence of any judgements against the Applicant, Applicant's officer,
director, or owner for breach of construction contracts within the last ten years
4.2.4. Applicant's substantial noncompliance with the terms and conditions
of prior construction contracts with a public body without a good cause
4.2.5. Conviction of any Applicant's officer, director, owner, project
manager, procurement manager, or chief financial official within the last ten
years for crime related to construction or contracting
4.2.6. Debarment of any Applicant's officer, director, or owner from bidding
or contracting by any municipal, state, or federal public body or agency within
the United States
4.2.7. Timely response to the information requested in paragraphs 4.2.1-4.2.6
above.
4.3. The OWNER will examine and verify, in determining the qualifications of an
Applicant, the information provided by the Applicant in the Contractor's
Prequalification Application Form. The OWNER reserves the right to contact, as
necessary, all concerned parties, including but not limited to owners, engineers,

sureties, subcontractors, state and federal agencies, public bodies, and law
enforcement agencies.
4.4. The OWNER expressly reserves the right to disqualify any Applicant if any data
provided within the form indicates that the Applicant is not in compliance with
requirements set forth in the Virginia Public Procurement Act, §2.2-4317
Prequalification Generally; Prequalification for Construction.
4.5. The Contractor's Prequalification Form is to be filled out in its entirety.
Typewritten or legible black ink handwritten entries are acceptable. If it is found that
information is omitted from the Application, the OWNER may reject the Application.
4.6. All information contained in the Contractor's Prequalification Application Form
is considered confidential and shall not be shared with other Applicants.
4.7. The Town of Leesburg will evaluate each Applicant's Contractor's
Prequalification Application Form. The Town will inform each Applicant of its
prequalification status within 30 days prior to the bid due date, at which time a list of
prequalified contractors will be made publicly available.
4.8. Nothing indicated herein will prejudice the OWNER's right to seek additional
information necessary to determine Applicant's qualification.
5. EXAMINATION OF PREQUALIFICATION DOCUMENTS.
5.1. It is each Applicant's responsibility, before submitting an Application to
promptly notify ENGINEER of all conflicts, errors, ambiguities, or discrepancies
which Applicant has discovered in Prequalification Documents.
5.2. The submission of an Application will constitute an incontrovertible
representation by the Applicant that Applicant has complied with every requirement
of this article; that without exception the Application is premised upon furnishing the
information required by the Prequalification Documents that Applicant has given
ENGINEER written notice of all conflicts, errors, ambiguities, and discrepancies that
Applicant has discovered in the Prequalification Documents, and the written
resolution thereof by ENGINEER is acceptable to Applicant; and that the
Prequalification Documents are generally sufficient to indicate and convey
understanding of all terms and conditions for preparing the Application.
6. INTERPRETATIONS AND ADDENDA.
6.1. All questions about the meaning or intent of the Prequalification Documents are
to be directed to ENGINEER. Interpretations or clarifications considered necessary
by ENGINEER in response to such questions will be issued by Addendum mailed or
delivered to all parties recorded by the office issuing documents as having received
the Prequalification Documents. Questions received less than 5 days prior to the date

for public acknowledgement of receipt of Applications may not be answered. Only
questions answered by Addenda will be binding. Oral and other interpretations or
clarifications will be without legal effect.
6.2. Addenda may also be issued to modify the Prequalification Documents as
deemed advisable by OWNER or ENGINEER.
CONTRACTOR'S PREQUALIFICATION APPLICATION FORM.
7.1. The Contractor's Prequalification Application Form and other attachments are
included with the Prequalification Documents. Substitution of forms will be allowed
only as noted.
7.2. All blanks on the Contractor's Prequalification Application Form must be
completed by typing or printing with black ink. No changes shall be made in the
phraseology of the forms.
7.3. Application by corporations must be executed in the corporate name by the
president or a vice-president (or other corporate officer accompanied by evidence of
authority to sign) and the corporate seal must be affixed and attested by the secretary
or an assistant secretary. The corporate address and state of incorporation must be
shown above the signature.
7.4. Applications by partnerships must be executed in the partnership name and
signed by a partner, whose title must appear on the line below the signature.
7.5. All names must be typed or printed on the line with the signature.
7.6. The Application shall contain an acknowledgement of receipt of all Addenda.
7.7. The address and telephone number for communications regarding the
Application must be shown.
SUBMISSION OF APPLICATIONS.
8.1. Contractor's Prequalification Application Form and attachments may be
photocopied for submission of Applications.
8.2. Submit Applications not later than the time prescribed, at the place, and in the
manner set forth in the Advertisement. Enclose Applications in an opaque sealed
envelope, marked with the Project title and name and address of Contractor and
accompanied by the other required documents. If the Application is sent through the
mail or other delivery system, the sealed envelope shall be enclosed in a separate
envelope with the notation "CONTRACTOR'S PREQUALIFICATION
APPLICATION FORM ENCLOSED" on the face of it.

PUBLIC ACKNOWLEDGEMENT OF RECEIPT.
9.1. Application will be acknowledged publicly. A summary of the number of
applications will be made available to all applicants within 7 days after the date of
acknowledgement.
